RESOLUTION NO. 82-316
RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION
OF DISTRICT NO. 330 (LAFC 2030A) AND DETACHING AREA FROM THE CENTRAL VALLEY
FIRE PROTECTION DISTRICT.
WHEREAS, pursuant to the provisions of the Municipal Organization
Act of 1977 (Gov. Code Section 35000, et seq.), proceedings were initiated
by the Common Council of the City of San Bernardino, to annex to the City
of San Bernardino certain contiguous uninhabited territory hereinafter
described; and
WHEREAS, a Negative Declaration was issued by the City Environmental
Review Committee in connection with said uninhabited territory and said
information is on file in the office of the Clerk of the Board of Supervisors
of the County of San Bernardino; and
WHEREAS, at its meeting of August 12, 1981, the Local Agency
Formation Commission of the County of San Bernardino duly adopted its
Resolution No. 1765, granting approval to proceed, subject to conditions;
established the City of San Bernardino as the conducting authority, and
set forth that the distinctive short form designation to be used throughout
(this proceeding shall be: LAFC 203OA; and
WHEREAS, on the 5th day of April, 1982, a resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
declaring that proceedings had been initiated'by.sdid Council,and proposing
the annexation of the hereinafter described uninhabited territory to the City
of San Bernardino, and that said resolution provided that the proposed
annexation should be generally known and identified as Annexation District
No. 330; and
WHEREAS, said resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the City to pay the bonded indebtedness and any and all
general indebtedness of the City of San Bernardino contracted prior to or
1 existing or outstanding at the time of the aforesaid proposed annexation
2 of said described property as provided in said Act; and
3 WHEREAS, said resolution did fix, determine and declare that a
4 hearing be held on the 17th day of May 1982, at the hour of 9:00 o'clock a.m.,
5 in the Council Chambers of the City Hall, 300 North "D" Street, San Bernardino
6 California, and the same was the day, hour and place designated where any
7 person owning real estate within such territory so proposed to be annexed and
8 having any objections to the proposed annexation might file a written protest,
9 appear before the Common Council of the City of San Bernardino and present
10 evidence or objections why such uninhabited territory should not be so annexed
11 to the City of San Bernardino; furthermore, said resolution provided that such
12 written protest should be filed with the City Clerk at any time before the
13 conclusion of said hearing; and
14 WHEREAS, there were no written protests filed with the City Clerk
15 of the City of San Bernardino prior to the conclusion of said hearing on
16 July 19, 1982; and thereafter, on the 19th day of July, 1982, Resolution
17 No 82-302 was adopted by the Mayor and Common Council declaring that
18 a majority protest has not been presented; and
19 WHEREAS, it appears to the Common Council of the City of San
20 Bernardino that the aforesaid annexation proceedings have been completed and
21 all acts performed in accordance with said Government Code, conditions of
22 LAFC Resolution No. 1765, adopted August 12, 1981, and any and all other laws
23 in any way connected with the said annexation procedure; and
24 WHEREAS, the Common Council of the City of San Bernardino desires
25 to approve at this time the annexation of the aforesaid territory.
26 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation

District No. 330 is hereby annexed and incorporated in and made a part of the
City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows, to wit:
Beginning at a point of the Present Corporate Limit Line of
the City of San Bernardino, said point being the intersection
of the centerlines of Palm Avenue and U.S. Interstate 15E
(U.S. Highway 395) thence leaving said City Limit Line,
Southwesterly along said centerline of Palm Avenue, 1750 feet
more or less to the Northeasterly line of Cajon Boulevard;
thence Northwesterly along said Northeasterly line of Cajon
Boulevard a distance of 1180 feet, more or less to the
Northeasterly prolongation of the Northwesterly line of that
certain parcel conveyed to Lois Wilson Stanke, et al by deed
recorded December 26, 1977 in Book 9332, Page 89 Official
Records of said County; thence Southwesterly along said
Northeasterly prolongation and said Northwesterly line, a
distance of 1450 feet more or less to its point of intersection
with the centerline of the Southern Pacific Railroad right-of-way;
thence Southeasterly and Southerly along said centerline a
distance of 5200 feet more or less to its intersection with
the Northerly line of certain parcel conveyed to Farm Homes
Corporation by deed recorded October 13, 1934 in Book 1011,
Page 14 Official Records of said County; thence Easterly along
said last mentioned Northerly line a distance 3400 feet more
or less to an angle point therein; thence Northeasterly along
said last mentioned Northerly line and the Northeasterly
prolongation thereof a distance of 450 feet more or less to
the Northeasterly line of the Atchison, Topeka and Santa Fe
Railroad Company's right-of-way; thence Southeasterly along
said Northeasterly line, 525 feet more or less to an angle
point on said City Limit Line; thence Northerly along said
City Limit Line 700 feet more or less to an angle point; thence
Easterly along said City Limit Line 200 feet more or less to
an angle point; thence Northeasterly along said City Limit
Line a distance of 1310 feet more or less to an angle point;
thence continuing along said City Limit Line Northwesterly
6680 feet more or less to the point of beginning.
(Containing approximately 632 acres)
SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $1,116,000.00 incurred for the acquisition

and construction of additions to, relocation of and replacements of the fire
fighting system of said City, the outstanding indebtedness thereon being
$75,000.00,bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and
2-1/2q per annum.
SECTION FOUR: That part of the annexed property lying easterly of
the centerline of Cajon Boulevard shall be in Ward 5, and that part of the
annexed property lying westerly of the centerline of Cajon Boulevard shall be
in Ward 6, and the boundaries of Wards 5 and 6 are hereby altered to include
said portions of the annexed property, with zoning classification of M-lA.
SECTION FIVE: That the area included in the above annexation is hereby
detached from County Service Area No. 38, Improvement Zone G of CSA No. 38,
County Service Area No. 70, and Improvement Zone "A" of CSA No. 70.
I HEREBY CERTIFY that the foregoing resolution was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a
regular meeting thereof held on the 2nd day of August
1982, by the following vote, to wit:
AYES: Council Members Castaneda, Reilly, IIernandez,
Quiel, Hobbs, Strickler
NAYS: None
ABSENT
None
