HomeMy WebLinkAbout2007-230 (AMENDED'BY RESOLUTION 2010-79) 1 RESOLUTION NO. 2007 - 230 2 3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF AN BERNARDINO ESTABLISHING THE SAN BERNARDINO BICENTENNIAL AD 4 OC COMMITTEE OF NINE MEMBERS WITH TWO ALTERNATES FOR THE URPOSEOFPLANNINGTHE CELEBRATION OF THE 200TH ANNIVERSARY OF THE 5 OUNDING OF SAN BERNARDINO 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF AN BERNARDINO AS FOLLOWS: 7 8 Whereas, May 20,2010 will mark the 200th anniversary ofthe date when Father Dumetz, 9 Franciscan missionary, traveled from Mission San Gabriel to establish the first Spanish mission 10 n the valley and named the area "San Bernardino" after Saint Bernardine of Sienna, the patron saint 11 fthe day on the Catholic calendar. 12 SECTION 1. PUl:pose. It is the desire ofthe Mayor and Common Council to establish an 13 d Hoc Committee for the purpose of celebrating the 200th anniversary of the founding of San 14 Bernardino. 15 SECTION 2. Name of Committee/Members. The Committee formed for the purpose of 16 elebrating the 200th anniversary of the founding of San Bernardino shall be called The San 1 7 ernardino Bicentennial Ad Hoc Committee and shall consist of nine members appointed "at- 18 arge" by the Mayor and Common Council. 19 The Mayor shall nominate two members who shall serve during and for the term of the 2 0 ayor. Notwithstanding any language to the contrary herein, the Mayor may nominate up to two 21 embers to the committee that reside outside the City. These two members may be either regular 22 r alternate members or a combination thereof. Each Council member shall nominate one member 23 ho shall serve during and for the term of the nominating member. The terms of the committee 24 embers shall coincide with the term ofthe nominating Council member or the Mayor. If a vacancy 25 ccurs in the office ofthe Council member ofthe Mayor who originally nominated any member, the 26 pplicable term ofthat member shall continue until a successor has been appointed. Nomination and 27 ppointment of a replacement member at any time shall terminate the appointment of any member 28 0 replaced, without need for formal removal action. 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 2 SAN BERNARDINO ESTABLISHING THE SAN BERNARDINO BICENTENNIAL AD HOC COMMITTEE OF NINE MEMBERS WITH TWO ALTERNATES FOR THE 3 PURPOSE OF PLANNING THE CELEBRATION OF THE 200TH ANNIVERSARY OF THE FOUNDING OF SAN BERNARDINO 4 5 6 7 SECTION 3. Alternate Members. The Mayor shall nominate two alternate members who shall serve during and for the term of the Mayor. Such alternate members may attend the meetings of the Ad Hoc Committee and may participate in the discussions but shall not be 8 considered for the determination of a quorum, unless a quorum is not otherwise present. When a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 quorum is not otherwise present, such alternate member or members shall be counted in the determination of a quorum and may vote and have all other rights and responsibilities of a member of the Ad Hoc Committee for that meeting. When any regular member of the Ad Hoc Committee is not in attendance, but a quorum still exists, the most senior alternate member may vote on any matter pending before the Ad Hoc Committee and shall have all other rights and responsibilities of a member of the Ad Hoc Committee for that meeting. If two or more regular members are not in attendance, then both alternate members may vote and have such rights and responsibilities. SECTION 4. ADDointment of Members. Each member of the Ad Hoc Committee, after having been nominated, shall be appointed by the Mayor, with the approval of the Common Council. Each member shall be and remain a registered voter and each member of the Ad Hoc Committee nominated by a Council member shall be and remain a resident of the City of San Bernardino. Members shall serve, without compensation, at the pleasure of the Mayor and Common Council.. Any vacancy shall be filled and appointment shall be made in the manner hereinbefore set forth as for an original appointment. 2 . , 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 2 SAN BERNARDINO ESTABLISHING THE SAN BERNARDINO BICENTENNIAL AD HOC COMMITTEE OF NINE MEMBERS WITH TWO ALTERNATES FOR THE 3 PURPOSE OF PLANNING THE CELEBRATION OF THE 200TH ANNIVERSARY OF 4 THE FOUNDING OF SAN BERNARDINO 5 SECTION 5. Oath of Office. Prior to undertaking his or her duties as a member of the 6 Ad Hoc Committee, the member shall subscribe and file his or her official oath of office with the 7 City Clerk. 8 9 10 shall serve for a term of one year. The Ad Hoc Committee shall meet not less than once a month 11 12 SECTION 6. Chairman Meetings Absences. The Ad Hoc Committee shall elect a chairman and a vice-chairman from among its members, and the chairman and vice-chairman in the City Hall, San Bernardino, California, or such other place within the City as the Ad Hoc 13 Committee may select. 14 If a Committee member fails to attend three consecutive regular meetings without excuse 15 from the chairman, which excuse must be obtained before or within five calendar days after any 16 meeting date, he or she shall automatically cease to be a member of the Ad Hoc Committee and 17 18 the chairman shall notify the former member and the nominating official of the declared 19 vacancy. The vacant office shall be filled by nomination and appointment made in the manner of 20 21 22 23 24 25 26 27 28 the original appointment. Meetings of the San Bernardino Bicentennial Ad Hoc Committee shall be open to the public and shall be governed by the provisions of the Ralph M. Brown Act, Sections 5495Q.5, et seq., California Government Code. SECTION 7. Ouorum. Any five members in attendance at any meeting shall constitute a quorum. Except for public hearings (which shall not be conducted without a quorum), the Ad Hoc Committee may meet in the absence of a quorum as a committee of the whole, and 3 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 2 SAN BERNARDINO ESTABLISHING THE SAN BERNARDINO BICENTENNIAL AD HOC COMMITTEE OF NINE MEMBERS WITH TWO ALTERNATES FOR THE 3 PURPOSE OF PLANNING THE CELEBRATION OF THE 200TH ANNIVERSARY OF 4 THE FOUNDING OF SAN BERNARDINO 5 6 7 recommend actions and propose resolutions which, if ratified at a subsequent meeting of the committee at which a quorum is present, shall constitute the official action of the Committee. SECTION 8. MonthlvNearlv Reoorts. The Committee is required to submit to the City 8 Manager a monthly report of its activities. The report to the City Manager is due on the lOth day 9 10 of each month, until such time as the Committee is disbanded. In addition, beginning with the first Council meeting in January 2008, the Committee is required to submit an annual report to 11 12 13 14 15 the Mayor and Common Council noting its activities and plans for the celebration of the 200th anniversary of the founding of San Bernardino. Such annual reports will be submitted in subsequent years at the first Council meeting in January until such time as the Ad Hoc Committee is disbanded. SECTION 9. Dissolution of the Committee.
