Staff Report
SUBJECT:
Resolution authorizing and directing the execution of a Grant of Easement to Southern California
Edison, across Water Department property located on the south side of Industrial Road, east of
Waterman Avenue.
BACKGROUND:
This office received a request for a Grant of Easement to Southern California Edison, across
Water Department property located on the south side of Industrial Road, east of Waterman
Avenue, known as Assessor's Parcel No. 0141-342-04. A copy of the Assessor's map is attached
for reference. The easement is needed by Edison to provide electrical service to a current
development, Waterman Business Park, adjacent to this site.
The parcel across which the easement is being granted is an approximately 20 feet by 23 feet of
unimproved land. The Water Department has indicated that they have no present or planned
facilities at this location, and on September 18, 2007, the Board of Water Commissioners
approved the grant of easement across this parcel.
The attached resolution authorizes and directs the execution of a Grant of Easement to Southern
California Edison.

CITY OF SAN BERNARDINO, a municipal corporation (hereinafter referred to as "Grantor"), hereby grants to
SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter referred to as
"Grantee"), an easement and right of way to construct, use, maintain, operate, alter, add to, repair, replace, reconstruct, inspect
and remove at any time and from time to time underground electrical supply systems and communication systems (hereinafter
referred to as "systems"), consisting of wires, underground conduits, cables, vaults, manholes, handholes, and including above-
a,round enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful for distributing
..ectrical energy and for transmining intelligence by electrical means, in, on, over, under, across and along that certain real
property in the County of San Bernardino, State of California, described as follows:
ALL THAT PORTION OF LOT 9, BLOCK 75, RANCHO SAN BERNARDINO, AS PER MAP FILED IN BOOK 7,
PAGE 2 OF MAPS, BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT B IN THE EASEMENT DEED
AND AGREEMENT, RECORDED ON OCTOBER 06, 2006, AS DOCUMENT NO. 2006-0686035, OF OFFICIAL
RECORDS, BOTH IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY.
This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code.
Grantor agrees for himself, his heirs and assigns, not to erect, place or maintain, nor to permit the erection, placement or
maintenance of any building, planter boxes, earth till or other structures except walls and fences on the above described real
property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger
or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of
exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor, the
Grantee shall make the same in such a manner as will cause the least injury to the surface of the ground around such excavation,
and shall replace the earth so removed by it and restore the surface of the ground to as near the same condition as it was prior to

DIRECTING THE EXECUTION OF A GRANT OF EASEMENT TO SOUTHERN
CALIFORNIA EDISON ACROSS CITY WATER DEPARTMENT PROPERTY LOCATED
ON THE SOUTH SIDE OF INDUSTRIAL ROAD, EAST OF WATERMAN AVENUE (APN

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
directed to execute on behalf of the City, a Grant of Easement to Southern CalifomiaEdison across
City Water Department Property, generally located south of Industrial Road, east of Waterman
Avenue, known as Assessor's Parcel Number 0141-342-04, more fully described in the Grant of
Easement document attached hereto as Exhibit "A" and made a part hereof.
