Subject:
Resolution adopting the Three-Year Capital Improvement Program (2007-2010) for Measure "I"
Local Expenditures.
Background:
In November 1989, voters approved Measure I authorizing San Bernardino Associated
Governments (SANBAG), acting as the Transportation Authority, to impose a one-half of one-
percent retail transaction and use-tax applicable throughout the county for a period of 20 years
beginning April, 1990 and extending to March 31, 2010. This tax has become commonly
known as the %2-cent sales tax. In November of 2004, voters overwhelmingly approved an
extension of the I/2-cent sales tax for an additional 30 years from April 1, 2010, extending it to
March 31, 2040.
This 1/2 cent sales tax can only be used for transportation improvements and traffic management
programs authorized in the expenditure plans set forth in Ordinance No. 89-1 of the
Transportation Authority.
The referenced ordinance requires each local agency to expend funds based on a 5-year Capital
Improvement Program and 20-year Transportation Plan adopted by resolution. The Expenditure
Plan only relates to these funds and their expenditure; it is mandatory that each agency update
the plan and program each year. Since the current plan expires in year 2010, SANBAG is
requiring a 3-year Measure I Capital Improvement Program covering FY 2007 through FY 2010.
The proposed 3-Year Program for Measure I Local Funds (Attachment A) is based upon the first
three years of the City's 5-Year Capital Improvement Program(CIP).
Changes to the program during the year are permitted subject to approval of Amendments to the
plan year by action of the Mayor and Common Council.
This year, SANBAG is again requiring cities to provide an "Expenditure Strategy" statement.
Attached is a copy of the proposed statement(see Attachment"B") for this year.
SANBAG prefers to receive each agency's Measure I CIP and Expenditure Strategy during the
month of September. However, in consideration of the fact that San Bernardino's 5-Year CIP
was not adopted until August 20, 2007, SANBAG has agreed to allow us to submit during the
first week of October 2007. Other agencies are receiving similar consideration.
Financial Impact:
The financial impact related to the adoption of the Expenditure Plan is reflected in the attached
3-year Capital Improvement Plan (CIP) for the City.

4 WHEREAS, San Bernardino County voters approved passage of Measure "I" 1990-2010
5 in November, 1989, authorizing San Bernardino Associated Governments(SANBAG), acting as the
6 San Bernardino County Transportation Authority, to impose a one-half of one percent retail
7 transactions and use tax applicable in the incorporated and unincorporated territory of the County of
8 San Bernardino; and
9 WHEREAS, revenue from the tax can only be used for transportation improvements and
10 traffic management programs authorized in the Expenditure Plans set forth in Ordinance No. 89-1 of
11 the Authority; and,
12 WHEREAS, Expenditure Plans of the Ordinance require each local jurisdiction receiving
13 revenue from the tax to expend those funds pursuant to a Five-Year Capital Improvement Program and
14 a Twenty-Year Transportation Plan adopted by resolution of the local jurisdiction; and,.
15 WHEREAS, due to the expiration of the current Measure "I" Program in 2010, SANBAG
16 is allowing each local jurisdiction to submit a three-year plan; and
17 WHEREAS, Expenditure Plans of the Ordinance also require that each local jurisdiction
18 annually adopt and update its Capital Improvement Plan.
19 NOW THEREFORE, BE IT RESOLVED that the Common Council of the City of San
20 Bernardino hereby adopts the Measure I Three-Year Capital Improvement Program (2007-2010)
21 (attached and incorporated herein as Exhibit "A"); and the Expenditure Strategy (attached and
22 incorporated herein as Exhibit"B");except for Streets and Street Lighting CIP Projects SS-04-116 and
23 SS06-102,which shall be voted upon by separate motion to become part of this Resolution as Exhibit
24 "C", attached and incorporated herein.

MEASURE I FOUR-YEAR CAPITAL IMPROVEMENT PLAN
EXPENDITURE STRATEGY
2007-2010
The City of San Bernardino will continue to place emphasis on both the regional
and sub-regional arterial roadway system during the remaining three years of the
current Measure I program. At least fifty percent of our Measure I funds
allocation will be earmarked for specific capital projects that are geared towards
improving traffic flow and motorist convenience. Failing pavement surfaces will
be rehabilitated and traffic striping modified as needed to accommodate increased
traffic demand; and intersection capacity will be improved with new and modified
traffic signals.
In addition to the above capital projects program, San Bernardino will continue to
allocate up to fifty percent of our annual Measure I funds towards public works
maintenance activities. Maintenance work will continue to include the City's
traffic signal systems, sidewalk and curb repair, and pavement repair and overlay
on the local street system.

1. Mayor: Call Item -Staff report
2. Mayor: Due to potential conflicts of interest which require certain Councilmembers to
recuse themselves from voting on Measure"I"Capital Improvement Projects located within 500 feet
of real property which they own or in which they have an interest,we will take two separate actions
to approve the Resolution.
On the first action,all members of the Council may vote to adopt the Resolution and Exhibits
A and B, which includes all projects in the Measure "I" CIP, except those noted in the Resolution
which pose a conflict of interest for specified Councilmembers.
There will be one additional vote taken. On the second vote, Councilmembers Baxter and
Brinker will leave the Chambers,and the remaining members will vote on Exhibit C,those projects
which present a conflict to Councilmembers Baxter and Brinker.
3. Mayor: May I have a Motion to adopt the Resolution and Exhibits A and B. I will now call
for the first vote as referenced in Exhibits A and B which includes all Measure "I" Capital
Improvement Projects except those listed which pose a potential conflict of interest to
Councilmembers Baxter and Brinker. Please vote.

116, I shall abstain on this motion."
Brinker: 'Because I own or have an interest in real property within 500 feet of CIP No.
SS06-102, I shall abstain on this motion."
(Councilmembers Baxter and Brinker leave the Council Chambers.)
