2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A FIRST AMENDMENT TO AGREEMENT WITH HIGHLAND HILLS
3 PROPERTIES RELATING TO A PAYMENT SCHEDULE FOR THE DEPOSIT FOR
SPECIFIC PLAN OF DEVELOPMENT AND ENVIRONMENTAL IMPACT REPORT.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an Amendment to Agreement with Highland Hills Properties relating
9 to a payment schedule for the deposit for specific plan of
10 development and environmental impact report, a copy of which is
11 attached hereto, marked Exhibit "A" and incorporated herein by
12
reference as fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a regular meeting thereof, held
on the 2nd day of November , 1981, by the following

THIS FIRST AMENDMENT TO AGREEMENT is entered into between the

CITY OF SAN BERNARDINO, a municipal corporation, referred to as
6 "City", and HIGHLAND HILLS PROPERTIES, a limited partnership,
7 referred to as "Owner".
8 City and Owner agree as follows:

1. Recitals.
(a) City and Owner entered into an agreement on October

II 14, 1981 ("the agreement"), relating to Owner depositing with City
J2 certain funds to be used to enable City to have a specific plan o~
i
J3 development and environmental impact report prepared by an outsid~
14 consultant.

(b) The parties now desire to amend the agreement to
16 provide for a payment schedule for the deposit in lieu of payment
17 in one lump sum.

2. Amendment. Paragraph 2 of the agreement is amended to
J9 read:

"2. Deposit. Owner shall deposit with City the t.otal sum of
21 $48,500.00, to be paid in four installments, as follows:

upon execution of this agreement.

as described in Exhibit "B" of the
agreement with Eisner-Smith and
Associates, dated October 14, 1981.

3 Owner shall also, concurrently with the execution of this
4 agreement, provide City with a letter from Pacific Federal Saving
5 and Loan Association evidencing sufficient funds available to one
6 of the partners to make all deposits required by this agreement."

3. Other Provisions. All other terms, conditions and
8
covenants of the agreement shall remain the same and be in full
9
force and
effect.
