Mayor City of San Bernar ino 3 2007-257 EXHIBIT "A" AMENDMENT NO.1 TO AGREEMENT FOR PROFESSIONAL SERVICES This AGREEMENT is made and entered into this 16th day of July , 2007, by and between the CITY OF SAN BERNARDINO, California, a municipal corporation, hereinafter referred to as the "City" and TY Un International, hereinafter referred to as "Consultant." WITNESSETH: A. WHEREAS, on December 6, 2004, the Mayor and Cornmon Council adopted Resolution No. 2004-383 approving Agreement for Professional Services in the amount of $249,050.00 with Consultant to provide a Project Study Report/Project Report and the supporting studies and documents for the University ParkwaylInterstate 2 I 5 Interchange Southbound Loop entrance ramp project, and B. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services, and C. WHEREAS, staff concurs that the additional work was not included in the original Agreement for Professional Services. NOW THEREFORE, the parties hereto agree as follows: I. Section I of said Agreement for Professional Services is amended to add that the Consultant shall redesign the connector ramp to meet Caltrans' requirements for geometries and perform additional biological, noise and cultural studies, as well as modification of environmental documents, needed to complete the environmental process due to the increased footprint of the project per proposal by Consultant dated April 3, 2007 (attached and incorporated herein as Attachment "I "). 2. Section 2 of said Agreement for PrOfessional Services is amended to add the following: "The term of this Agreement for Professional Services is extended for one additional year to and including July 16, 2008, unless terminated earlier as provided in the original Agreement for Professional Services." Un International April 3, 2007 Background Since the preparation of the original scope and fee included in the prime contract dated 12/6/2004, new requirements are now necessary to obtain Project Approval (PA&ED) from Caltrans and FHWA. Also, during the preparation of the initial studies and preliminary engineering, the City requested changes to the concept (wider cross section and horizontal alignment of the connector) that required additional work. Scope of Work Based on the above information T.Y. Lin International (TYLI) prepared the following scope of services; Task 1 - Project Approval (PSR/PR): Task 1.1 Project Management: TYLI will provide overall execution and financial management of the project, including City of San Bernardino and Caltrans coordination; coordination with other agencies, tracking progress of the work, preparing monthly invoices and project status reports, and conducting project meetings. TYLI's Project Manager will provide overall project management, coordination, and supervision of project staff to facilitate the performance of the work in accordance with the scope and requirements of City of San Bernardino and Caltrans. TYLI will work with the Project Development Team (pDn and will maintain close coordination amongst all of its members. TILl will also chair and conduct official monthly PDT meetings. TYLI will prepare monthly status reports to update the City and the cooperative agencies on the progress to date; work to be accomplished in the next period; and potential problems of a technical nature or forecasted budget/schedule requirement. TILl will coordinate all subconsultants such that they function as team members indistinguishable from direct employees of T. Y. Lin International. TILl will attend up to 10 meetings. Quality Control Project Management will include an established Quality Assurance/Quality Control (QA/QC) program already utilized on all TYLI projects. Budgets, schedules and progress will be closely monitored and controlled through TYLI's internal system. TILl will ensure that the project is being developed in accordance with its QA/QC procedures as well as Caltrans' QA/QC Guidelines. Task 1.2 Complete and obtain Caltrans approval on Traffic Study Report: TILl and its subconsultant, Transtech, will prepare and obtain Caltrans approval on a Traffic Study Report. The cross section was revised from 36 feet (4' inside shoulder, 2 12' lanes and an 8' outside shoulder) to 39 feet (5' inside shoulder, 2 12' lanes and a 10' outside shoulder). The APS will be incorporated as an attachment in the PSR/PR. Deliverables: · APS Task 1.6 Revise Modified Access Report (MAR) TYLI will revise and secure approval on the existing MAR based on the comments on the Traffic Study Report, input from the City on required cross section and incorporating the work required to coordinate with SANBAG's SR-21O project currently in PS&E. The environmental documentation will be prepared by lYLI subconsultant, Lilburn Corporation. Task 2.2 Technical Studies Task 2.2.1 Visual Impact Assessment Report Lilburn Corporation will prepare a Visual Resource Assessment (VIA) based upon the VIA guide prepared by Caltrans. Based upon our initial review and evaluation of the project, we anticipate the brief VIA format will be acceptable to Caltrans. This report format will entail evaluating the project based upon ten criteria contained within the Caltrans guide and reporting the results in memo form. Results of the VIA will be incorporated into the revised PEAR. VIA Report Task 2.2.2 Phase I Site Assessment/Initial Site Assessment Lilburn Corporation will conduct a Phase I Environmental Site Assessment focusing on the area where construction activities will occur. The purpose of a Phase I Environmental Site Assessment (ESA) is to determine and assess environmental issues associated with prior uses of the property that may impact the owner's future use and liability. At the conclusion of the site assessment, a report documents the observed potential impacts to the subject property that may have altered the site's ecology, environment, functional use, or economic value. The assessment only includes visual observations and inquiry into public records. No testing of soil, air, or water or any other matter is used to render a technical opinion in a Phase I Assessment. The environmental assessment prepared will follow the guidelines established by the American Society for Testing and Materials Standard Practice manual for the Phase I Environmental Site Assessment process (ASTM Designation E 1527). Results of the Phase I ESA will be summarized into the Caltrans Initial Site Assessment (ISA) format and incorporated into the revised PEAR and the PSR/PR. Deliverables: . ISA Task 2.2.3 Natural Environment Study (NES) Lilburn Corporation, in conjunction with Natural Resources Assessment, Inc. (NRA, Inc.) will update the Biological Analysis previously prepared for the interchange improvements. This includes aerial photos, information from San Bernardino County, California Natural Diversity Data Base (CNDDB), U.s. Fish and Wildlife Service (USFWS) and California Department of Fish and Game (CDFG), as well as data provided in other environmental reports from projects in the surrounding area. NRA, Inc. will review the most up-to-date version of the Natural Environmental Study Report (NESR) to ensure compliance with current Caltrans requirements. The existing biological assessment will be supplemented to include those items required by the NES. These items include the following: . An updated data request . Discussion of regional and local sensitive resources . An assessment of impacts to sensitive resources impacted by the project . Description of appropriate mitigation for impacts to sensitive resources, as appropriate "NLININTERNATIONAL A TT ~lIMF.NTar'll..t1 Scope of Work University PkwY/I-215 Ie Improvements Engineering Services April 3, 2007 Page 6 of 9 NRA, Inc. will review up-to-date aerial photos and topographic maps, as well as available data from the City of San Bernardino, California Department of Fish and Game (CDFG), U.s. Army Corps of Engineers (Corps) and the Regional Water Quality Control Board. Existing relevant information regarding the property, will also be reviewed including available documents on the soils of the project area, the original biological assessment, and any previously completed environmental documents. NRA, Inc. will conduct a one-day field survey to evaluate and measure the extent of the drainages on site. Areas of potential jurisdiction will be evaluated according to u.s. Army Corps of Engineers (Corps) and California Department of Fish and Game (CDFG) criteria. Potential jurisdictional areas will also be evaluated for a federal nexus as required by the Corps. Areas displaying potential wetland indicators will be evaluated according to the routine delineation procedures described in the Corps Manual. At each point, dominant plant species will be identified and soils examined. Notes will be taken on hydrologic conditions, including such hydrologic indicators as recent sediment deposits, evidence of inundation (such as accumulations of vegetation debris showing deposition by water), and surface scour. General site characteristics will also be noted. Wetlands meeting the definition of the CDFG will also be evaluated and documented. NRA, Inc. will include an analysis of the potential impacts of the proposed project on the jurisdictional drainages. The analysis will include those sections of drainages directly impacted by the project as well as indirect impacts to the drainage system. Mitigation measures will be recommended for the potential impacts identified during the study, including mitigation measures for elimination or minimization of impacts to the drainages, where possible. The development of detailed implementation measures, such as off-site drainage replacement, project redesign and mitigation monitoring, is not included in this SOW. The NES and Jurisdictional Delineation Analysis will be prepared as a stand alone report and the results incorporated into the revised PEAR. Deliverables: · NES Report Task 2.2.4 Air Quality Assessment Lilburn Corporation, in conjunction with Mestre Greve and Associates, will prepare the Air Quality Analysis as requested by Caltrans. The Caltrans comments indicate that -n:LININTERNATIONAL ATI~HMEN'rIlalWO Scope of Work University Pkwy/I-215 Ie Improvements Engineering Services April 3, 2007 Page 7 of 9 both a regional level air quality analysis and a project level air quality analysis are required for the project. The regional air quality analysis focuses on the project inclusion and consistency with the Regional Transportation Plan (RTP) and the Regional Transportation Improvement Program (RTIP). This analysis will focus on showing that the project is included in the RTP and RTIP and is consistent with the plans that are included in these documents. A quick check indicates that this project is included in the RTIP, and this will facilitate the regional analysis. The project level analysis will focus on three topics; 1) carbon monoxide (CO) operational impacts, 2) particulate (PM2.s and PMIO) operational impacts, and 3) Mobile Source Air Toxics (MSAT). In California, the procedure for performing a CO analysis is detailed in the Transportation Proiect-Level Carbon Monoxide Protocol (Protocol) developed by the Institute of Transportation Studies at the University of California, Davis. The US EP A deemed the Protocol as an acceptable option to the mandated quantitative analysis. The Protocol incorporates ~93.1l5 - 93.117, ~93.126 - 93.128 into its rules and procedures. This protocol will be used for the CO analysis. The PM2.s and PMlOhotspot analysis is required per the Federal Air Quality Act Transportation Conformity Requirements (40 CPR 51.390 and Part 93) and the implementation of the new PM2.5 National Ambient Air Quality Standard. The EP A final rule that establishes the transportation conformity criteria and procedures for determining which projects must be analyzed for local air quality impacts in PM2.s and PMIO non-attainment and maintenance areas was published in the Federal Register on March 10, 2006. A guidance document for PM2.s Hotspot Analysis was published by the EP A on March 30, 2006. The first part of the EP A guidance is to determine if the project is a "project of air quality concern (POAQC)." This step requires a finding by SCAG's Transportation Conformity Working Group (TCWG). Mestre Greve and Associates will fill out the required form, which contains a project description, a summary of required traffic data, and other information depending on the project. On past submittals Mestre Greve and Associates has also found it necessary to write an addendum to the submittal that details why the project is not a POAQC. Mestre Greve and Associates will then participate in the TCWG meeting when they review the application, and provide any subsequent information requested. The P.M. 2.5 findings are required to circulate for public review for 30 days, support will be provided for this effort!. We feel strongly that this project should be classified as "not a POAQC," and our cost is based on the assumption that the TCWG will concur. The FHW A has issued a memorandum entitled "Interim Guidance on Air Toxic Analysis." We will follow their published methodology and perform the MSA T analysis as required. The air quality assessment will be presented in a report that includes background on the regulatory framework, the existing air environment, as well as documenting the CO, MSA T, and PM2.5/ PMIO analyses. The costs include one review and revisions by the City and one review cycle with Caltrans and FHW A. Deliverables: . Air Quality Report Task 2.2.5 Noise Assessment Lilburn Corporation, in conjunction with Mestre Greve and Associates will prepare the Noise Assessment as requested by Caltrans. The noise analysis will be prepared in a manner consistent the Caltrans "Traffic Noise Analysis Protocol" and FHW A Technical Advisories. The FHW A and Caltrans noise criteria are based on the peak hour of noise, and are in terms of the hourly equivalent level or Leq. The standard is essentially, that the peak hour Leq should not exceed 66 dBA for residential uses and 71 dBA for commercial uses with outdoor areas of frequent human use. The existing noise environment will be described through a noise measurement survey and computer modeling assessment of existing roadway noise sources. Short-term noise measurements, with concurrent traffic counts, will be made at up to 4 sites. The site selection will focus on the residential uses and commercial uses with outdoor areas of frequent human use along the project's limits. The FHWA's Traffic Noise Model (TNM) will be used for calculations of the Leq noise levels. The future noise exposure for the project will be developed and compared to the existing noise levels. These results will be presented in a tabular format showing the resultant noise levels at sensitive receptors potentially impacted by the project. Noise attenuation may be required in those sensitive areas where the Caltrans LEQ noise standards are approached or exceeded. If needed, the preliminary location of a sound barrier and the height of the barrier will be determined. The TNM Model will be used for all of the computations. The barrier analysis will be conducted at a level of detail consistent with preliminary engineering plans. Typically, a final barrier study (not included in this scope) is conducted as part of the final engineering plans which finalizes the barrier heights and precisely determines the starting and stopping points of the barrier. This work effort also includes one round of responding to City comments, and one round of responding to Caltrans and FHW A comments and making revisions to the report as necessary. Once the original round of Caltrans comments are properly responded to, any additional coordination with Caltrans and FHW A will be an extra cost. Based upon the comments contained in the Caltrans memo dated July 19, 2006, we anticipate the preparation of an Area of Potential Effects Map (APE), Archaeological Survey Report (ASR), Historic Resources Evaluation Report (HRER), and a Historic Property Survey Report (HPSR). In addition, we will coordinate these efforts with the State Historic Preservation Officer (SHPO) as well as coordinate inquiries with the Native American Heritage Commission. Our efforts will include a Paleontological Overview of the project area and preparation of a Historic Cultural Visual Assessment as required by Section 106 guidelines. Results of the Cultural Assessment will be incorporated into the revised PEAR. Deliverables: · APE map . ASR · HRER . HPSR Task 2.3 Coordination of Categorical Exemption (CE) (CEQA) / Categorical Exclusion (CE)(NEP A) Based upon the results and information gathered as outlined in Tasks 1 through 6, Lilbum Corporation will coordinate completion of necessary documentation for adoption of a CEQA Categorical Exemption and NEP A Categorical Exclusion. Our objective is to complete these studies as detailed below in accordance with Caltrans guidelines for the resulting issuance of a Categorical Exemption. Task 1: Visual Impact Assessment Lilburn Corporation will prepare a Visual Resource Assessment (VIA) based upon the VIA guide prepared by Caltrans. Based upon our initial review and evaluation of the project, we anticipate the Brief VIA format will be acceptable to Caltrans. This report format will entail evaluating the project based upon ten criteria contained within the Caltrans guide and reporting the results in memo form. Results ofthe VIA will be incorporated into the revised PEAR. Task 2: Phase I Site AssessmentlInitial Site Assessment Lilburn Corporation will conduct a Phase I Environmental Site Assessment focusing on the area where construction activities will occur. The purpose of a Phase I Environmental Site Assessment (ESA) is to determine and assess environmental issues associated with prior uses of the property that may impact the owner's future use and liability. At the conclusion of the site assessment, a report documents the observed potential impacts to the subject property that may have altered the site's ecology, environment, functional use, or economic value. The assessment only includes visual observations and inquiry into public records. No testing of soil, air, or water or any other matter is used to render a technical opinion in a Phase I Assessment. The environmental assessment prepared will follow the guidelines established by the American Society for Testing and Materials Standard Practice manual for the Phase I Environmental Site Assessment process (ASTM Designation E 1527). 1905 Business Center Drive. Task 3: Natural Environment Study (NES) Lilburn Corporation, in conjunction with Natural Resources Assessment, Inc. (NRA, Inc.) will update the Biological Analysis previously prepared for the interchange improvements. This includes aerial photos, information from San Bernardino County, California Natural Diversity Data Base (CNDDB), U.S. Fish and Wildlife Service (USFWS) md California Department of Fish and Game (CDFG), as well as data provided in other environmental reports from projects in the surrounding area. NRA, Inc. will review the most up to date version of the Natural Environmental Study Report (NESR) to ensure compliance with current Caltrans requirements. The existing biological assessment will be supplemented to include those items required by the NES. These items include the following: . An updated data request. . Discussion of regional and local sensitive resources, . An assessment of impacts to sensitive resources impacted by the project. . Description of appropriate mitigation for impacts to sensitive resources, as appropriate. NRA, Inc. will review up to date aerial photos and topographic maps, as well as available data from the City of San Bernardino, California Department of Fish and Game (CDFG), U.S. Army Corps of Engineers (Corps) and the Regional Water Quality Control Board. Existing relevant information regarding the property, will also be reviewed including available documents on the soils of the project area, the original biological assessment, and any previously completed environmental docunlents. NRA, Inc. will conduct a one-day field survey to evaluate and measure the extent of the drainages on site. Areas of potential jurisdiction will be evaluated according to U.S. Army Corps of Engineers (Corps) and California Department of Fish and Game (CDFG) criteria. Potential jurisdictional areas will also be evaluated for a federal nexus as required by the Corps. Areas displaying potential wetland indicators will be evaluated according to the routine delineation procedures described in the Corps Manual. At each point, dominant plant species will be identified and soils examined. Notes will be taken on hydrologic conditions, including such hydrologic indicators as recent sediment deposits, evidence of inundation (such as accumulations of vegetation debris showing deposition by water), and surface scour. Wetlands meeting the definition of the CDFG will also be evaluated and documented. NRA, Inc. will include an analysis of the potential impacts of the proposed project on the jurisdictional drainages. The analysis will include those sections of drainages directly impacted by the project as well as indirect impacts to the drainage system. Mitigation measures will be recommended for the potential impacts identified during the study, including mitigation measures for elimination or minimization of impacts to the drainages, where possible. The development of detailed implementation measures, such as off-site drainage replacement, project redesign and mitigation monitoring, is not included in this SOW. The NES and Jurisdictional Delineation Analysis will be prepared as a stand alone report and the results incorporated into the revised PEAR Task 4: Air Quality Assessment Lilburn Corporation, in conjunction with Mestre Greve and Associates will prepare the Air Quality Analysis as requested by Caltrans. The Caltrans comments indicate that both a regional level air quality analysis and a project level air quality analysis are required for the project. The regional air quality analysis focuses on the project inclusion and consistency with the Regional Transportation Plan (RTP) and the Regional Transportation Improvement Program (RTIP). This analysis will focus on showing that the project is included in the RTP and RTIP and is consistent with the plans that are included in these documents. A quick check indicates that this project is included in the RTIP, and this will facilitate the regional analysis. The projecI level analysis will focus on three topics; i) carbon monoxide (CO) operational impacts, 2) particulate (PM2.5 and PMIO) operational impacts, and 3) Mobile Source Air Toxics (MSAT). In California, the procedure for performing a CO analysis is detailed in the Transportation Proiect-Level Carbon Monoxide Protocol (Protocol) developed by the Institute of Transportation Studies at the University of California, Davis. The US EPA deemed the Protocol as an acceptable option to the mandated quantitative analysis. The Protocol incorporates ~93.115 - 93.117, ~93.126 - 93.128 into its rules and procedures. This protocol will be used for the CO analysis. The PM25 and PMIO hotspot analysis is required per the Federal Air Quality Act Transportation Conformity Requirements (40 CFR 51.390 and Part 93) and the implementation of the new PM2.5 National Ambient Air Quality Standard. The EPA final rule that establishes the transportation conformity criteria and procedures for determining which projects must be LILBURN CORPORATION ATTACHMENT "1" Mr. Rodrigo Gonzalez March 13,2007 Page 4 analyzed for local air quality impacts in PM2.5 and PMIO non-attainment and maintenance areas was published in the Federal Register on March 10, 2006. A guidance document for PM2.5 Hotspot Analysis was published by the EPA on March 30, 2006. The first part of the EPA guidance is to determine if the project is a "project of air quality concern (POAQC)." This step requires a finding by SCAG's Transportation Conformity Working Group (TCWG). Mestre Greve and Associates will fill out the required form, which contains a project description, a summary of required traffic data, and other information depending on the project. On past submittals Mestre Greve and Associates has also found it necessary to write an addendum to the submittal that details why the project is not a POAQC. Mestre Greve and Associates will then participate in the TCWG meeting when they review the application, and provide any subsequent information requested. The P.M. 2.5 findings are required to circulate for public review for 30 days, support will be provided for this effortl. We feel strongly that this project should be classified as "not a POAQC," and our cost is based on the assumption that the TCWG will concur. The FHW A has issued a memorandum entitled "Interim Guidance on Air Toxic Analysis." The analysis requires the combination of traffic data, emission factors, speed data, project length and speciation data to project the amount of air toxics generated. We will follow their published methodology and perform the MSAT analysis as required. The air quality assessment will be presented in a report that includes background on the regulatory framework, the existing air environment, as well as, documenting the CO, MSA T, and PM2.5/PMIO analyses. The costs include one review and revisions by the City and one review cycle with Caltrans and FHW A. Task 5: Noise Assessment Lilburn Corporation, in conjunction with Mestre Greve and Associates will prepare the Noise Assessment as requested by Calirans. The noise analysis will be prepared in a manner consistent the Caltrans "Traffic Noise Analysis Protocol" and FHW A Technical Advisories. The FHW A and Caltrans noise criteria are based on the peak hour of noise, and are in terms of the hourly equivalent level or Leq. The standard is essentially, that the peak hour Leq should not exceed 66 dBA for residential uses and 71 dBA for commercial uses with outdoor areas of frequent human use. The existing noise environment will be described through a noise measurement survey and computer modeling assessment of existing roadway noise sources. Short-term noise measurements, with concurrent traffic counts, will be made at up to 4 sites. The site selection will focus on the residential uses and commercial uses with outdoor areas of frequent human use along the project's limits. The FHW A's Traffic Noise 1 We have assumed the City will be responsible for all legal notilication/advertising for newspapers and/or Federal Registry. LILBURN CORPORATION ATTACHMENT "I" Mr. Rodrigo Gonzalez March 13, 2007 Page 5 Model (TNM) will be used for calculations of the Leq noise levels. The future noise exposure for the project will be developed and compared to the existing noise levels. These results will be presented in a tabular format showing the resultant noise levels at sensitive receptors potentially impacted by the project. Noise attenuation may be required in those sensitive areas where the Caltrans LEQ noise standards are approached or exceeded. If needed, the preliminary location of a sound barrier and the height of the barrier will be determined. The TNM Model will be used for all of the computations. The barrier analysis will be conducted at a level of detail consistent with preliminary engineering plans. Typically, a final barrier study (not included in this scope) is conducted as part of the final engineering plans which finalizes the barrier heights and precisely determines the starting and stopping points of the barrier. This work effort also includes one round of responding to City comments, and one round of responding to Caltrans and FHW A comments and making revisions to the report as necessary. Once the original round of Caltrans comments are properly responded to, any additional coordination with Caltrans and FHW A will be an extra cost. Task 6: Cultural Assessment Lilbum Corporation in conjunction with McKenna et al will prepare the Caltrans requested Cultural resource investigations. Based upon the comments contained in the Caltrans memo dated July 19, 2006, we anticipate the preparation of an Area of Potential Effects Map (APE), Archaeological Survey Report (ASR), Historic Resources Evaluation Report (HRER), and a Historic Property Survey Report (HPSR). In addition, we will coordinate these efforts with the State Historic Preservation Officer (SHPO) as well as coordinate inquiries with the Native American Heritage Commission. Our efforts will include a Paleontological Overview of the project area and preparation of a Historic Cultural Visual Assessment as required by Section 106 guidelines. Results of the Cultural Assessment will be incorporated into the revised PEAR. Task 7: Coordination of Categorical Exemption (CEQA)/Categorical Exclusion (NEP A) Based upon the results and information gathered as outlined in Tasks I through 6, Lilburn Corporation will coordinate completion of necessary documentation for adoption of a CEQA Categorical Exemption and NEP A Categorical Exclusion. Task 8: Project Management/Coordination Management of the project includes on-going coordination with T.y. Lin International, preparation of memos, and meeting preparation and attendance. In order to maximize our efforts LILBURN CORPORATION " Mr. Rodrigo Gonzalez March 13,2007 Page 6 ATTACHMENT "1" to conduct the environmental evaluation and keep the project on track, we propose to attend up to eight meetings with T.y. Lin International and City staff at milestone intervals. Project management also includes interaction with our subconsultants, monitoring of their schedule, and review of their work products. Lilbum Corporation will coordinate with T.y. Lin on the completion of the above tasks. Additional coordination may be required with the USFWS, CDFG, Army Corps of Engineers, and the City. Many of the studies proposed to be performed under this scope of work will require assess to Caltrans property. This access is typically permitted through a Caltrans issued Encroachment Permit. Lilbum Corporation and their subconsultants will attempt to obtain the necessary encroachment permit in a timely manner. Permit application costs and/or bonding requirement by Caltrans cannot be estimated at this time and therefore will be additional costs billed as a pass through. Schedule We anticipate the field survey portions of this Scope of Work can be completed within six weeks from authorization to proceed and receipt of authorized Encroachment Permit. Air Quality and Noise Assessment schedules are dependent upon receipt of an approved Traffic Analysis but can be completed within six weeks of said receipt. Poor weather conditions or prohibited access may inhibit the completion of the field studies or unduly affect field observations.
