Synopsis of Previous Council Action:
July 17, 2007 — The Legislative Review Committee requested staff to draft an ordinance
establishing a Youth Advisory Commission, outlining the composition of its members and
duties.
August 7, 2007—The Legislative Review Committee recommended item for Council approval.

STAFF REPORT
Subject:
Ordinance of the City of San Bernardino adding Chapter 2.19 to Title 2 of the San Bernardino
Municipal Code establishing a Youth Advisory Commission.
Background:
At the July 17"' meeting of the Legislative Review Committee, staff was asked to provide the
Committee with a draft ordinance for a Youth Advisory Commission. In developing this
ordinance, staff researched cities with successful youth Commissions including Oakland,
Fremont and Huntington Beach.
The purpose of this Youth Advisory Commission is to involve young people in local governance,
to engage youth in creatin g p ositive social change,e, and to serve in an advisory capacity to the Mayor and Commo n Council an d other Commissions on topics cs relatin to needs priorities,
programs and opportunities for youth in the community. In addition to their primary roles,
commissioners are also responsible for promoting accomplishments that are being made by
youth in the community, as well as encouraging and promoting youth involvement in City and
Community activities.
This ordinance establishes the Commission and outlines the composition of its members and
their duties. It also establishes that the Commission will meet monthly and as requested by the
Mayor and Common Council.
It has been recommended by other cities that the Youth Advisory Commission have a strong City
staff presence. The Commission will be administered by the Parks and Recreation Department,
with assistance from Council Office staff. The Commission will also work closely with
community based organizations to develop a Youth Master Plan.
Fiscal Impact:
None.

7 SECTION 1. Chapter 2.19 is hereby added to the San Bernardino Municipal
Code to read as follows:

16 The purpose of this Youth Advisory Commission is to involve young people in local governance,
to engage youth in creating positive social change, and to serve in an advisory capacity to the
17 Mayor and Common Council on topics relating to needs, priorities,programs and opportunities
18 for youth in the community.
19 2.19.010 Members—Appointment—Terms
20 The Youth Advisory Commission is composed of students and youth serving without
21 compensation at the pleasure of the Mayor and Common Council. Commissioners shall be
appointed as follows:
22 a) 1 member representing each of the High Schools in the San Bernardino City Unified
23 School District
b) 1 member representing Aquinas High School
24 c) 1 member representing Rialto High School
25 d) 1 member representing the Public Safety Academy
e) 1 member appointed by each Council Member
26 f) 2 members appointed by the Mayor

Members must be residents of the city, between the ages of 13-19. The student body of each
3 High School shall serve as the appointing authority in selecting their school's representatives.
The initial term will begin in September 2007 and end in June of 2008. Following the initial
4 term, all terms shall be one year, beginning and ending in June. Students may be appointed to
5 serve more than one term. All appointees shall be subject to the approval of the Mayor and
Common Council.

2.19.015 Alternates

Each school shall nominate one (1) student to serve as an alternate. The alternate shall be a non-
8 voting underclassman, who shall attend meetings of the Commission and may participate in
9 discussions. When a regular member of the Commission is not in attendance, the alternate from
that school may vote and shall have all other rights and responsibilities of a member of the
10 Commission.
11 2.19.017 Absences
12 If a member of the Commission fails to attend three consecutive regular meetings without
13 contacting City staff prior to the absence(s), he or she will automatically cease to be a member of
the Commission. If a vacancy occurs prior to a Commissioner's term being completed,the
14 alternate member will be appointed to fill the position for the remainder of the term, unless that
school's appointing authority selects another student. Nomination and appointment of a
15 replacement member at any time shall terminate the appointment of any member so replaced,
16 without need for formal removal action.
17 2.19.020 Duties.
18 The Youth Advisory Commission shall:
19 (A) Provide an avenue for youth to express their concerns, ideas and recommendations.
(B) Act in an advisory capacity to the Mayor and Common Council and other City Commissions
20 in all matters pertaining to youth issues.
(C) Encourage and promote youth involvement and participation in City and community
21 activities.
22 (D) Work with community based organizations and government agencies to advocate for youth.
(E) Promote public understanding of the accomplishments being made by youth in the City.
23 (F) Positively represent and act as role models to youth in the community.
(G) Work with the City and community based organizations to develop a Youth Master Plan.

25 2.19.030 Meetings
26 Meetings shall be held monthly or as requested by the Mayor and Common Council. A quorum
shall consist of a majority of the membership of the Commission. A quorum shall be required for
27 official action. A staff member will be assigned the duty of administering the meetings and
28 working with the Commission to assist them in meeting their goals. Meetings of the

Commission shall be open to the public and subject to all of the terms of the Ralph M. Brown
3 Act, Section 54950.5 et seq., California Government Code.
4 2.19.040 Conduct
5 Each student is a representative of their school and community. Students should demonstrate the
6 high standards of behavior expected of Youth Advisory Commission members in and out of
organized activities. Participation in any illegal activity may be cause for dismissal from the
7 Youth Advisory Commission.
