Recommended Motion:
I. Adopt Resolution.
2. Authorize the Director of Finance to amend the FY 07-08 Sewer Line Maintenance Budget by
appropriating $310,000 from the Sewer Line Maintenance available fund balance for sewer
improvements on Sierra Way from 16th Street to 19th Street, per Project plan No. 12187.

STAFF REPORT
Subject:
Resolution awarding a contract to Nikola Corporation for Sewer Improvements on Sierra Way from
16th Street to 19th Street, per Project Plan No. 12187.
Background:
This project consists of the following:
I. Abandonment of sewer main.
2. Installation of new sewer main and laterals.
3. Roadway improvements.
The plans and specifications for this project were completed and the project was opened to public
bidding on June 26, 2007. The project was advertised locally in the San Bernardino County Sun
Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily
Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction
Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.

Based on review of the sealed competitive bids received, staff has determined Nikola Corporation of
Irvine, the apparent low bidder, has met the minimum requirements of the specifications and bid
guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced
contract to Nikola Corporation.
The estimated project costs are as follows:

If approved, this project is expected to begin construction in September of 2007 and be completed by
December oflOOT.

STAFF REPORT - Continued
Financial Impact:
Due to the significant estimated cost for this project, staff is recommending that a new, individual
Capital Improvement project be set up for this item. CIP No. SW-E has been assigned. Funding for
this CIP is recommended to come from the available estimated fund balance of $2.5 million in the
Sewer Line Maintenance Fund. A budget amendment is necessary to appropriate the funds for this
project.
Recommendation:
I. Adopt Resolution.
2. Authorize the Director of Finance to amend the FY 07-08 Sewer Line Maintenance Budget by

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO NIKOLA CORPORATION FOR
SEWER IMPROVEMENTS ON SIERRA WAY FROM 16TH STREET TO 19TH
STREET (SW-E), PER PROJECT PLAN NO. 12187.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Nikola Corporation, 18012 Cowan, Suite 290, Irvine, CA 92614, is the
lowest responsible bidder for sewer improvements on Sierra Way from 16th Street to 19th Street (SW-
E), per Project Plan No. 12187. A contract is awarded accordingly to said bidder in a total
amount of $238,956.00, with a contingency amount of $35,844.00, but such award shall be
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
rejected. The City Manager is hereby authorized and directed to execute said contract on
behalf of the City; a copy of the contract is on file in the office of the City Clerk and
incorporated herein by reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements, amendments,
modifications or waivers are intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of passage of the resolution.
