June 21, 1999 - The Mayor and Common Council approved resolutions implementing a
Memoranda of Understanding between the City of San Bernardino and employees in
the Fire Safety employees' bargaining unit represented by the San Bemardino City
Professional Firefighters.

STAFF REPORT
SUBJECT
A resolution of the City of San Bernardino approving a side letter to the Memorandum of
Understanding between the City of San Bernardino and employees in the fire safety
employees bargaining unit represented by the San Bernardino City Professional
Firefighters' Association (SBCPF).
BACKGROUND
In July 2000, a grievance was filed by the San Bernardino City Professional Firefighters'
(SBCPF) involving language changes in the then recently negotiated Memorandum of
Understanding (MOU).
During negotiations, at the suggestion of the Department, language in Article III. Section
1. of the MOU has been changed to read:
"Employees in the classification of P-2 and P-3 may provide paramedic
service if they are certified to state and county regulations, and approved
to do so by the Fire Chief. Compensation for this additional job duty will
be the amount paid to a P-2 over a P-2 salary at the same step pay range,
e.g., P-2 step 3 minus P-2 step 3 = the compensation."
Historically, paramedic pay had been limited to those individuals who were in the P-2
classification. Firefighters who had maintained their paramedic certification, but were
not assigned as P-2's, were expected to perform these duties on an occasional basis.
SBCPF argued that under the new language those individuals who were certified and
performed duties when necessary, based on the nature of the call, had the tacit
approval of the Chief and should be paid at the agreed P-2 rate. After a review by the
City Attorney's office and meetings with the union, a settlement was tentatively reached
with SBCPF.
The following components constitute the City's proposal:
1. Employees in the classification of P-1 and P-3 may provide paramedic
service if approved by Chief to do so and they provide payroll with a copy
of their certifications to all state and county regulations.
2. The Fire Chief will assign each P-1 and P-3 approved and certified to
"lead" paramedic duties on an engine company and they will be paid 96
hours (4 shifts) of premium pay. Premium pay is defined as the hourly
rate difference between a top step P-1 and a top step P-2. The premium
pay will be paid 50% on the first semi-monthly check and 50% on the
second semi-monthly check.

3. Since the assigned P-1's and P-3's will be compensated for 96 hours of
premium pay per month, only for extraordinary circumstances will the
individuals be excused from actually working those hours, (e.g. vacation,
sick leave, injury.)
4. Fulfillment of the 96 hours can be accomplished by either working full 24-
hour shifts, partial shifts of 8-hour increments (up to three, 8-hour partial
shifts in any given 24-hour shift) or a combination of both. Hours worked
will be recorded on the employee's timesheet and will be tracked by the
Department and Payroll. Each employee will receive a minimum of 8
hours credit when called to perform paramedic duties. If an employee
actually works less than 8 hours, they will still put 8 hours on their
timesheet. If an employee works 8 hours or more, then the actual number
of hours worked will be recorded on the timesheet.
5. If a P-1 or P-3 is assigned and works paramedic duties in excess of the 96
hours per month, he/she would receive additional premium pay for the
hours worked over the 96 hours.
6. After the Mayor and Council approve this settlement, compensation will
begin as rapidly as the City can set it up. There will be no retroactive
payment. The City will make a good faith effort to expedite the
processing.
The adoption of this resolution will approve the attached side letter, which amends the
Memorandum of Understanding between the City and the San Bernardino City
Professional Firefighters (SBCPF). This settlement was previously approved by the
Mayor and Common Council, in closed session, and has been accepted by SBCPF.
FINANCIAL IMPACT
It is estimated that the annual cost of this settlement will be approximately $29,800.
RECOMMENDATION
Adopt resolution.

9-154, amending Article III, Compensation, Section 1, Salaries, Subsection G, a copy
f which amendments are attached hereto and incorporated herein marked Exhibit A.

FOR FIRE SAFETY EMPLOYEES
This exhibit sets forth the Side Letter to Resolution No. 99-154 for full-time,
regular active Fire Safety employees:
