2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; AND SETTING
3 FORTH REQUIREMENTS FOR STREET IMPROVEMENTS AND RELOCATION OF
PUBLIC FACILITIES IN ARTERIAL OR COLLECTOR STREETS OR STATE
4 HIGHWAYS.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 1991 Section 20.2 Subsection E

Paragraph 5 is hereby amended to read as follows:
"5. The owner, developer or applicant for the building
permit shall pay all costs of dedication and improvement, includ-
ing any cost for the removal or relocation of utilities, includin
fire hydrants, traffic signals, street lighting, drainage culverts,

and of preparation of plans and blueprints.
Whenever the property being erected or enlarged is on a
corner lot with street improvements required to be made on at
least two adjoining streets, the owner, developer or applicant
may apply for a contribution from the City's "Force Labor
Account" for the relocation of fire hydrants, traffic signals and
drainage culverts, provided that the City has available personnel
20 and funds for such purpose. Application for said labor contri-
21 bution shall be made to the Mayor and Common Council and their
22 decision shall be final and based upon a disproportionate
23 financial burden and comparative hardship. The decision as to
24 nature and extent of any such labor contribution made by the City
25 shall rest solely on the discretion of the Mayor and Common
26 Council. "

SECTION 2. Ordinance No. 1991 Section 20.2 Subsection E
28 Paragraph 6 is hereby amended to read as follows:

"6. Any person required to make street improvements re-

qui red by the provisions of this Subsection shall make and con-

struct the same in compliance with the requirements of the City
4
Engineer, or upon his approval, shall file with the City Engineer
5
a bond, cash or certificate of deposit in such amount as the City
6
Engineer shall estimate and determine to be necessary to cover
7
the costs of all the improvements required, provided, all street
8
improvements and related costs shall be required to be completed
and approved prior to the issuance of a certificate of occupancy
9
by the City and the actual commencement of the use of the premises
unless an extension is granted pursuant to ParagraphS of this
Subsection E."
SECTION 3. Ordinance No. 1991 Section 20.2 Subsection E
ParagraphS is hereby amended to read as follows:
"S. Upon approval of the Superintendent of the Building
and Safety Department and the City Engineer the owner, developer
or applicant for the building permit may delay the construction
of said improvements no later than the time for final inspection
under any building, plumbing, wiring or other permit relating to
said building; provided, however, that whenever the property
being erected or enlarged is on a corner lot with street improve-
ments required to be made on at least two adjoining streets and
the owner, developer or applicant has filed a. good and sufficient
bond, cash or certificate of deposit, as set forth hereinabove,
the City Engineer and the Superintendent of Building and Safety
may, for good cause shown, extend the time for the completion of
the required street improvements for a period of not more than
one year after issuance of the certificate of occupancy."
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
