2 (Repair of Mobile Homes and Trailers)
3 THIS AGREEMENT is made and entered into this 17th day
a ! of September 1979, by and between the CITY OF SAN
5 I BERNARDINO, a municipal corporation, hereinafter referred to as
6 i "City", and the COUNTY OF SAN BERNARDINO, a political subdivision
~ of the State of California, hereinafter referred to as "County".
g In consideration of the performance of the mutual
g i covenants and promises herein contained, at the time and in the
10 i manner specified herein, the parties hereto agree as follows:
1~ 1. Recitals.
l2 (a) City's Community Development Office has Community
i
!3 Development funds allocated for the purpose of rehabilitating
~q qualified housing within the City of San Bernardino.
l5 (b) City is authorized to enter into an agreement-with'
l6 the County of San Bernardino for its Community Services Department
17 to perform minor repair of mobile homes and trailers within the
~g City of San Bernardino.
t9 (c) City desires that County perform said minor
20 I repair of mobile homes and trailers, and County desires to perform
2] I said work.
22 i 2. County to Promote Services. County will provide
23 an outreach program to consist of press releases, flyers, and
2q personal contact with mobile home and trailer residents, through
2g residents' meetings, to explain the need for, and availability
26 of free residential energy audits, minor repairs offered, and
27 methods of application qualification. At that time, applications
28 will be taken ar~d appointments made for interested eligible

1 residents.
2 3. Qualifications of Applicants, County will determine
3 qualifications of applicants for the mobile home and trailer minor
q repair service. Each applicant must meet the following criteria:
5 I (a) Residence within the City of San Bernardino for
6 la minimum of one year;
7 II (b) Age 62 years or older;
g (c) Own and occupy the mobile home or trailer for
i
9 'which service is requested;
i
IO I (d) Gross annual income of less than 11,280
it ~ 4. Energy Audits and Estimates of Minor Repairs. County
!2 (will provide, without charge to applicants, energy audits designed
13 ~to determine present energy efficiency, no-cost and low-cost
~q methods of reducing energy consumption, and estimates of minor
IS repairs needed. These services shall be provided to a maximum of
16 1,000 qualified applicants.

i~ 5, County to Refer Applicants to Other Energy Programs,
lg County will refer each program applicant to other energy related
19 Programs, as needed.
20 6. County to Provide Minor Repairs. County will provide
21 the following minor repairs as needed:
22 (a) heater repair up to $250.00, to be done by
23 licensed contractor;
24 (b) window and door repair or replacement;
25 (c) weatherstripping;
26 ~ (d) caulking;
27 ~ (e) wrapping of water heater;
28 (f) installation of water-saving shower head;

1 (g) squaring up (leveling) of mobile home/trailer.
2 7. County to Provide Itemized Statement. County shall
3 I maintain applications, invoices, statements, vouchers, time

q ~ records, and supporting detail for all work completed. When
5 i a job is completed, County shall furnish City with a comprehensive
I
6 ~Iexpense statement which shall itemize all costs of the job.
? II 8. Advance Payment to County. City shall make an
g ~~advance payment to County in an amount of five thousand dollars
9 ~ ($5,000.00) for the program, to be used for the purchase of
10 necessary supplies and materials and for other initial costs.
11 ~I 9. Reimbursement to County for Completed Jobs. City shall
I
~ l2 ~ireimburse County for completed jobs on the basis of the expense
t3 statements submitted pursuant to paragraph 7 on a monthly basis.
tq Said reimbursements by City to County will be made during the
~
15 normal time period utilized by City for making such payments.
l6 Notwithstanding the foregoing, during the program, City shall have
lry 'the right, in its sole discretion, to off-set submitted expense
Ig ~ statements for jobs completed against the five thousand dollar
19 ($5,000.00) initial advance payment made by City to County
20 as provided in paragraph 8 hereof.
2] City may give notice to County that available funds will
22 imminently be exhausted, After such notice has been given,
23 County shall not undertake any new repair projects without
24 approval of City.
25 At the end of the program, County shall refund to City any
26 unexpended, unobligated funds remaining from its total receipts
try !from City for the program, and shall submit to City a detailed
2g I project expense statement in a form satisfactory to the City's

~ Finance Director. If any monies are due to County from City,
2 then County shall submit a final billing statement for authorized
3 expenses computed in accordance with paragraph 7 hereof exceeding
4 previous payments made to County.
S 10. County to Maintain Records. County shall maintain and
6 keep adequate books and records on a current basis recording all
7 invoices, statements, vouchers, time records, and the like, in a
8 form satisfactory to the City and in accordance with generally
9 accepted accounting principles. Said books and records shall be
l0 made available to the City for purposes of audit at all reasonable
it times and places. All such books and records shall be retained
12 for such periods of time as required by law; provided, however,
~3 notwithstanding any shorter period of retention, all books,
t4 records and supporting detail shall be retained for a period of
~S at least three years after the expiration of the term of this
16 agreement.
17 11. County to Maintain Insurance. County shall provide
~ l8 comprehensive insurance coverage for all work performed pursuant
19 to this agreement in a form satisfactory to City's Director of
20 Community Development. Said insurance coverage shall be at least
21 as follows:
22 One million dollars for each person injured;
23 One million dollars for each accident or occurrence; and
24 One million dollars for property damage.
25 A certificate of insurance shall be provided to City, and
26 I City shall be named as an additional insured in said policy.
27 ( 12. Term. The term of this agreement shall commence
28 September 1, 1979, and terminate June 30, 1980.

1 13. Termination. Either party may terminate this agreement
2 by giving written notice specifying the effective date of f
3 termination. County shall be allowed a two week grace period
a (after the effective date of termination in which to close down
5 and furnish City with a full accounting of projects accomplished
6 and costs thereof. Any adjustments to project funding and

~ (incurred costs shall be made within twenty (20) days after
g (termination.
9 14. Hold Harmless. County hereby agrees to, and shall,
t0 (hold City, its elective and appointive boards, commissions,
I
11 officers, agents and employees harmless from any liability for
12 damage or claims for damage for personal injury, including death,
13 as well as from claims for property damage which may arise from
i
iq County's operations under this agreement, whether such operations
~ 15 be by County or by any one or more persons directly or indirectly
16 employed by or acting as agent for County. County agrees to,
17 and shall, defend City and its elective and appointive boards,
ig commissions, officers, agents and employees from any suits or
t9 actions at law or in equity for damages caused, or alleged to
20 have been caused, by reason of any of County`s operations here-
21 under.
~ 22 15. Assignment. This agreement shall not be assigned by
23 either party without first obtaining the written consent of the
24 other party.
25 16. Entire Agreement. This agreement represents the entire
26 agreement of the parties hereto, and may be amended or modified
27 only by written agreements signed by both parties. Failure
28 on the part of either party to enforce any provision of this

1 agreement shall not be construed as a waiver of the right to
2 compel enforcement of such provision or provisions, nor act to
3 release any surety from its obligations under this agreement.
4 ~ 17. Notices. All notices herein required shall be in
5 writing and delivered in person or sent by first class mail,

REPAIR PROGRAM. (CSD)

RECOMMENDATION:
Approve a contract between the City of San Bernardino and Community
Services Department for energy conservation services and repairs
to mobile homes and trailers for the period September 1, 1979,
through June 30, 1980, in an amount estimated to be $200,000.00.
BACKGROUND:
The Board of Supervisors approved refunding of the Community
Services Administration Emergency Energy Conservation Program on
April 3, 1978, in the amount of $575,581. A portion of this pro-
gram dealt with the weatherization of homes within San Bernardino
County, including 225 which were within the city limits of San
Bernardino. Initial results indicate an average savings to each
client serviced, since inception, of $110.40. Mobile homes and
trailers were not initially considered under CSA Guidelines of
the refunding package.
REP.SONS FOR RECOi~'1MENDATION:
The City of San Bernardino, by formal Resolution Number 79-346,
has requested the CSD Weatherization Program be extended to include
weatherization of selected mobile homes and trailers for senior
citizens within the City. The City has agreed to assume all program
costs incurred with Community Development funding.
There are approximately 38 mobile home parks within the City of San
Bernardino with about 3400 city residents relatively untouched by
energy conservation technology. Of these residents, 75~ to 80$ are
senior citizens who will meet qualifying criteria. This program
will meet the needs of these senior citizens by weatherstripping
and/or making minor repairs to their mobile homes and trailers to
reduce the loss of energy through lack of weatherization.

To implement a weatherization program to assist senior citizens
residing in mobile homesjtrailers within the City o£ San Bernardino.
Under the Emergency ileatherization Program approved by the Board
~i of Supervisors on April 3, 1978, approximately 225 homes in the
City of San Bernardino were weatherized for loca-income and senior
citizens at an overall savings to each client serviced of 1728
kilowatts, 204 therms or $110.40.

The City of San Bernardino has requested that the CSD administer
a similar program for eligible senior citizens in the City of
San Bernardino according to contract specifications.
The contract period is September 1, 1979 through June 30, 1980.
The City of San Bernardino will advance $5,000 to Community Services
Department thereafter on the basis of monthly invoices submitted
to the City. Estimated funding under this contract is $200,000.
Funding will continue until the City notifies Community Services
Department that funding has been exhausted; thereafter, no new mobile
homes/trailers may be weatherized or repaired without prior city
approval.
