HomeMy WebLinkAbout1979-335 I i ~ RESOLUTION NO, ff'9-,3,~~ 2 i RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN AMEND- MENT TO THE CHARTER OF SAID CITY WHICH WOULD REQUIRE THAT AN 3 I ORDINANCE ESTABLISH THE AMOUNT IN EXCESS OF WHICH COMPETITIVE BIDDING IS REQUIRED FOR THE PURCHASE OF PERSONAL PROPERTY; AND q WHICH WOULD CONSOLIDATE RELATED LANGUAGE FROM ANOTHER SECTION. I 5 WHEREAS, in accordance with the Constitution of the State i~ II 6 'I of California, the City of San Bernardino, a municipal corpora- l ~ ~ tion, has heretofore framed and adopted a Charter for said City, g ~ which said Charter was duly and regularly approved by the Legis- 9 lature of the State of California; and 10 WHEREAS, the Mayor and Common Council of the City of San I Bernardino deem it advisable tb~submit the £ollbwing Charter 12 Amendment as hereinafter set forth, 13 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common ~q Council of the City of San Bernardino, that the following proposal !5 for amendment to the Charter of said City be submitted to the 16 qualified electors of said City for their approval or rejection 17 at the Municipal Special and Consolidated State-wide Election to l8 be held in sAid City on November 6, 1979. 19 PROPOSED CHARTER AMENDMENT N0. 20 It is hereby proposed that Article VIII Section 140 of the i 21 Charter of the City of San Bernardino be amended to read as 22 follows: 23 "Section 140. The purchase of any goods, equipment, materials, supplies, or other personal property, 2q except purchases from other governments or govern- mental agencies or as otherwise excepted by law, 25 shall be made in the manner prescribed by ordinance which shall provide that such purchases or contracts 26 for purchases where the amount therefor equals or exceeds an amount fixed by such ordinance, shall be 27 open to competitive bidding and that the procedures for such bidding shall include public advertisement 28 therefor and an award to the lowest and best bidder. ~ The Mayor and Common Council or any board or officer advertising for sealed proposals hereunder shall have 2 the power to reject any and all bids and readvertise at their discretion." i 3 It is further proposed that Article XIII Section 238 of the a Charter of the City of San Bernardino be repealed. 5 I HEREBY CERTIFY that the foregoing resolution was duly 6 adopted by the Mayor and Common Council of the City of San 7 Bernardino at a meeting thereof, held 8 on the day of ~6F~.Yit~ 1979, by the following ~ 9 vote, to wit: t0 ~ AYES: Councilman ~O~rtB~ ~ ~'2G~o®/`jr ~~,f/~ 11 12 ~ NAYS : ~ iAPS~f7lJ.J~J ~/~ir 13 ABSENT : ~~nn~r~on ~?~rva r ~'~~.?~n (4 l5 16 City Clerk 17 The foregoing resolution is hereby approved this day 18 of ~~nu~ 1979. 19 ~ 20 a r of e C ty of S Bernardino 21 Approved as to form: 22 23 24 City Att rney 25 26 27 28 -2-
