HomeMy WebLinkAbout1979-334 i 1 RESOLUTION NO. f'9 2 RESOLUTION OF THE CITY OF SAN BERNARDINO PROPOSING AN AMEND- MENT TO THE CHARTER OF SAID CITY WHICH WOULD PERMIT THE PUBLICA- 3 i TION OF ORDINANCES IN A NEWSPAPER OF GENERAL CIRCULATION BY PUB- LICATION OF SUMMARIES OF ORDINANCES WITH STATEMENTS THAT THE 4 ~ ENTIRE ORDINANCE IS AVAILABLE FOR INSPECTION IN THE OFFICE OF THE CITY CLERK. 5 WHEREAS, in accordance with the Constitution of the State 6 of California, the City of San Bernardino, a municipal corporatio , 7 has heretofore framed and adopted a Charter for said City, which 8 said Charter was duly and regularly approved by the Legislature 9 of the State of California; and 10 WHEREAS, the Mayor and Common Council of the City of San I1 Bernardino deem it advisable that said Charter be amended in 12 certain particulars, as hereinafter set forth, 13 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common 14 Council of the City of San Bernardino, that the following proposa IS for amendment to the Charter of said City be submitted to the l6 qualified electors of said City for their approval or rejection 17 at the Municipal Special and Consolidated Election to be held in t8 said City on November 6, 1979. 19 PROPOSED CHARTER AMENDMENT NO. 20 It is hereby proposed that Article III Section 33 of the 21 Charter of the City of San Bernardino be amended to read as 22 follows: 23 "Section 33. After the passage of each ordinance, 24 and at all times thereafter, the City Clerk shall maintain on file and open to public inspection a 25 certified copy of the full text of the ordinance. Within fifteen (15) days after the passage of each 26 ordinance, it shall be published by the City Clerk once in a newspaper of general circulation pub- ~ 27 lished and circulated in the City with the names of the members of the Common Council voting for 28 and against the ordinance and the name of the I ~I t Mayor approving or disapproving the ordinance. The publication of the ordinance may be satis- 2 ii fied by the publication of the entire ordinance or by the publication of a summary of the ordi- 3 I nance, the number and title of the ordinance, ' and the names of the members of the Common Council a voting for and against the ordinance and the name of the Mayor approving or disapproving the ordi- 5 nance. Such summary shall be prepared by the City Clerk, or other official designated by the 6 Mayor and Common Council, and approved by the City Attorney. The publication shall include a state- ? ment that the full text of the ordinance is avail- able for inspection in the office of the City g Clerk. The Mayor and Common Council may direct the publication of the entire ordinance in special q cases. Ordinances shall not be published in a newspaper if the charge exceeds the customary rate 10 charged by the newspaper for publication of private i legal notices, but such ordinances shall be posted 11 by the City Clerk in at least three public places in the City within fifteen (15) days after passage of ~2 the ordinances.
