2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 1963 ENTITLED IN PART "AN ORDINANCE REGULATING THE CONSTRUCTI N
3 OF CERTAIN IMPROVEMENTS IN OR UNDER STREETS. . .", AND AUTHORIZ-
ING THE ESTABLISHING OF CHARGES THEREFOR BY RESOLUTION.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 1963 Section Three is hereby
7 amended to read as follows:

"SECTION THREE: Fees Required. For construction, repair
9 or alteration of sidewalks, curbs, gutters, driveways, subgrades
10 and pavements, manhOles, catchbasins, retaining walls and other
11 structures, and for excavating, laying and backfilling sewers and
12 drainage pipe lines, concerning which specifications, lines and
13 grades therefor shall be determined by the City Engineer, charges
14 for inspections and construction staking shall be based upon a
15 SChedule of fees fixed by resolution duly adopted by the Mayor
16 and Common Council after the conclusion of a public hearing
17 relating thereto."

SECTION 2. Ordinance No. 1963 Section Three-A is hereby
19 amended to read as follows:

"SECTION THREE-A: Plan Fees. Charges shall be made by
21 the City Engineer and paid by the applicant for checking improve-
22 ment plans relating to street projects, except as otherwise pro-
23 vided in Ordinance No. 1984, based upon a schedule of fees fixed
24 by resolution duly adopted by the Mayor and Common Council after
25 the conclusion of a public hearing relating thereto."

SECTION 3. This ordinance is an emergency and urgency
27 measure necessary for the immediate preservation of the public
28 peace, health, safety and welfare of said City and its inhabitant

3 The charges and fees for inspections and staking, plan
4 checking, etc. on public projects are urgently necessary to cover
5 the costs of the services and material provided by the City
6 relating thereto and without which fees and charges there will be
7 insufficient revenues or funds on hand to defray the expense
8 thereof.
9 I HEREBY CERTIFY that the foregoing ordinance was duly
10 adopted by the Mayor and Common Council of the City of San
