2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE REDEVELOPMENT AGENCY OF THE
3 CITY OF SAN BERNARDINO RELATING TO THE SALE OF TREATMENT PLANT
NO.1.

BE IT RESOLVED BY THE MAYOR AND CO~ION COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized and directed to execute on behalf of said City
8 an Agreement with the Redevelopment Agency of the City of San
9 Be~nardino relating to the sale of Treatment Plant No. I, a
10 copy of which is attached hereto, marked Exhibit "A" and incor-
11 porated herein by reference as fully as though set forth at
12 length.
13 I HEREBY CERTIFY that the foregoing resolution was duly
14 adopted by the Mayor and Common Council of the City of San

(Treatment Plant No.1)
THIS AGREEMENT is made and entered into this 7;,( day of
ti11~ ,1979, by and between the CITY OF SAN BERNARDINO,
a municipal corporation, hereinafter referred to as "city", and

the REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, a public
7
body, corporate and politic, hereinafter referred to as "Agency".

IN CONSIDERATION of the agreements, covenants, conditions,
9
promise~ and legal detriments herein contained, the parties
10
hereto agree as follows:

1. City agrees to convey to Agency, and Agency agrees to
12 purchase from City, pursuant to the terms and conditions of this
13 agreement, in its present condition, the real property, referred
14 to in this agreement as "the premises", more particularly des-
15 cribed in Exhibit "I" attached hereto and incorporated by
16 reference herein as fully as though set forth at length.
2. The purchase price of the premises is $740,302.00.

18 AgenQyagrees to pay said amount to City as follows. Agency shall
19 pay to City a down payment of $5,000.00 concurrent with the
20 execution of this agreement. Agency shall at the same time
21 execute and deliver to City a promissory note for the balance of
22 the purchase price, bearing interest at 7% per annum, due and
23 payable one year after the date of execution of this agreement.
24 Said note shall be secured by a recorded deed of trust on the
25 premises.

3. It is understood and agreed that Agency will use its
27 best efforts to resell the premises for development, such
28 development to be consistent with the Redevelopment Plan for the

1 Southeast Industrial Park. All necessary work in connection
2 with marketing and reselling the premises, including but not
3 limited to preparation and filing of parcel maps and any required
4 earth filling, excavation, or other work on the premises shall
5 be the responsibility of Agency.
6 IN WITNESS WHEREOF, the parties hereto have executed this
7 Agreement on the date and year first hereinabove written.
