RE~OLUTION NO, 7 r, J.19 RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLU- TION NO. 6433 ENTJTLED IN l?ART "A RESOLUTION . , , CREATING AND ESTABLISHING POSITION~ FOR THE VARIOUS DEPARTMENTS OF THE CITY , . ."; PRQVIDING FOR THE PAYMENT TQ MANAGEMENT AND CONFIDENTIAL EMPLOYEES OF FIFTY PERCENT OF ACCUMULATED/ UNUSED SICK LEAVE UNDER SPECIFIED CONDITIONS; AND PROVIDING FOR MANDATORY ANNUAL PHY~ICAL EXAMINATION~ FOR MANAGEMENT AND CONFIDENTIAL EMPLOYEES TO BE PAID BY CITY. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS; SECTION 1. Resolution No. 6433 Section Five and Three- Quarters Subsection (a) (1) is hereby amended to read as follows: "(1) Every general employee/ including the above men- tioned Federally funded temporary full-time positions, or the estate of any such deceased employee who dies during employment, shall upon retirement, or death, receive compensation for fifty percent (50%) of accumulated, upused sick leave provided that in no event shall such compensation exceed sixty working days of such leave." SECTION 2. Resolution No. 6433 Section Five and Three- Quarters Subsection (al (2) is hereby amended to read as follows: "(2) Employees in the classifications P5 and P6 in the Police Department and in the classification of P5 in the Fire Department, or the estate of any such employee who dies during employment/ shall upon retirement or death, receive compensation for fifty percent (50%) of accumulated, unused sick leave, pro- vided that in no event shall such compensation exceed sixty working days of such leave. . . , . . . _T"' --,.,' k.... ,-. . <"'.~,l C - . - , "- ~ .. . 1 2 3 4 5 6 7 8 9 to 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I L__ ~. ci.;.,,"__~"~'" i;itii~;':" ,:;,~,:>'.,~:~'t+'.-r~~~-'T;: }f~)'~;;:;'~-::~_:~,..-" ..- ',~.J;_;.,:t i..i"." _.~.'-'. , Upon retirement, death, or termination of employment, except dismissal or resi'Jnation with prejudice, as defined in Rule 514 of the Civil Service Rules and Re'Julations of the City of San Bernardino, of a mana'Jement or confidential employee, including the classification of P7 in the Police Department and the classifications of P6 and P7 in the Fire Department, the City shall pay to said employees, or to their estate, payment for fifty percent (50%) of accumulated, unused sick leave." SECTION 3. Resolution No. 6433 Section Twelve Subsectio (c) is hereby amended to read as follows: "(c) An annual physical examination is mandatory for , management and confidential employees, including employees in the classification of P7 in the Police Department and the classi- fications of P6 and P7in the Fire Department. The City shall pa medical fees for the physical examination of said employees when such examination is required by the City after ori'Jinal employ- ment. The City may arrange with a physician or a medical group for such examinations. If the employee chooses to be examined by a doctor of his/her choice, reimbursement to the employee for the examination will be limited to that amount paid by the City under its arrangement with a medical group or physician. The City shall pay medical fees for the physical examin- ation of a 'Jeneral employee when such examination is required and directed by the City. The City shall pay for physical examinations for middle- mana'Jemerit employees, as identified in Resolution No. 10584, as amended, and for the classification of P6 in the Police Depart- ment and the classification of P5 in the Fire Department, -2- ",......~,.,.''7-~~~~-~.,;.:~.>",::;~...m~~'"/,'''',~''''' ~. after receipt of the report of the results of the examination and presentation of the bill from the examining physician, provided that such payment shall not exceed seventy-five dollars ($75.00) during any fiscal year. A report of the results of the examination shall be filed in the employee's personnel file."
