RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND
ESTABLISHING CHARGES FOR SERVICES AND FACILITIES FURNISHED BY THE
CITY SEWERAGE COLLECTION AND TREATMENT SYSTEM; PROVIDING A
REBATE TO LOW INCOME FAMILIES FOR SAID CHARGES; AND REPEALING
RESOLUTION NO. 12392.
BE IT RESOLVED BY THE MAYOR AND COr@10N COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Pursuant to the provisions of Ordinance No.
2175 of the City of San Bernardino, any premises which are served
by a connection to the system of sewage and waste t~eatment of
the City or are within 200 feet of and situated on real property
adjoining an existing sewer system and not connected thereto but
served by City water shall be charged and the owner thereof shall
pay a sewer service charge based upon the following'schedule:

Commercial dischargers total charge shall be computed
based upon actual water consumption as reflected by water meter
readings for the billing period. Such water consumption may be
reduced for the purpose of establishing sewer service charges
subject to "Seasonal" or "Consumptive" use as recognized and
approved by the Board of Water Commissioners of the City of San
Bernardino.
Residential dischargers, for the purpose of this Resolution.,
shall be any single family dwelling unit, any duplex or triplex

I family dwelling unit not requiring a City License for occupancy
2 and operation.

SECTION 2.
(a) A refund of fifty percent (50%) of the
4 amount of the monthly sewer service charge in excess of $3.30 per
5 month due and paid under the provisions of Ordinance No. 2175
6 rendered on and after July 1, 1978, and through June 30, 1979,
7 or for any such succeeding twelve month period, shall be made
8 whenever all of the following occur:

(1) The annual gross income of the household in
10 which a single person lives is less than $6,000 for the claimant's
II last preceding federal or state personal income tax reporting
12 period; or
13
(2) The annual gross income of.the household in
14 which a married couple or family lives is less than $9,000 for
15 the claimant's last preceding federal or state personal income
16 tax reporting period; and
17
(3) Claimant makes application and files a verified
18 claim in writing with the Director of Finance at City Hall for
19 such refund upon a claim form provided by said Director; and
20
(4) The claim is approved by said Director as being
21
in conformance with this section.

Only one member of each household may file a claim and
only one claim may be filed for each individual household.
(b) The claimant shall be the person in whose name the
bills for utility services were rendered. Income of the house-
hold means all income of the claimant's household from all
members living in such household who are related to the claimant

1 as a spouse or as defined in Sections 17056 and 17057 of the
2 Revenue and Taxation Code of California.
3 (c) "Gross income" shall mean the sum of adjusted gross
4 income as used for purposes of the California Personal Income Tax
5 Law, together with the net income from all sources of all kinds,
6 including but not limited to alimony, suppport money, cash public
7 assistance and relief, pensions, annuities, social security,
8 interest on securities (including tax free interest on govern-
9 mental securities), realized capital gatns, workmen's compensation
10 (not including medical benefits), unemployment insurance income,
I] insurance benefits of all kinds (other than medical), and gifts,
12 except that income shall not include Medicare benefits, MediCal
13 benefits, gifts of food and gifts betWeen members of the house-
14 hold, the receipt of surplus food or other relief in kind supplied
15 by a governmental agency.
16 (d) The claim for such refund, for the preceding twelve
17 month period ending on June 30, shall be made only during the
18 month of September or October of each year, and must be accom-
19 panied by a copy of the utility bill, together with proof that
20 the utility bill has been paid by the claimant or some member of
21 the household. No such refund shall be made on any claim filed
22 or postmarked later than the 31st day of October.
23 (e) No refund shall be made to any person on a utility
24 account for which any utility bill is due and outstanding for the
25 period which rebate is claimed or for any prior period. No
26 refund shall be made of any portion of a utility bill which was
27 paid with public assistance or relief funds which included an
28 allowance to pay the utility bill.

(f) Nothing in this section shall be construed to require
2 that any utility company has any obligation to make or furnish,
3 for the purpose of the refund provisions hereof, proof of utility
4 bills due or paid.

SECTION 3. This resolution shall be operative and
6 effective on August L, 1979.

SECTION 4. Resolution No. 12392 is hereby repealed,
8
effective on the operative date of thIs resolution.
