" Subject: Resolution authorizing the execution of a purchase order to Robertson's Ready Mix, L TO, for purchase of low permeability material for landfill cover repair materials of the former Waterman Landfill. Background: The City of San Bernardino operated a sanitary landfill for municipal solid waste between 1950 and 1960 on 19 acres of leased private property along the south bank of the Santa Ana .River, east of Waterman Avenue and north of Vanderbilt Way and Carnegie Drive. Landfill operations ceased in 1961 and the site was turned back over to the property owner at that time. I Under state law, the owner and operator of the site are responsible for maintenance and corrective actions relating to releases of landfill gas (methane) and potential contaminants to groundwater through leachate percolatiQn. The operator of the site bears primary responsibility; the owner bears ultimate responsibility in the event that the operator is no longer available to perform these functions and meet regulatory requirements. Currently, Glenborough owns the site. The City entered into a Limited Access Easement Agreement with Glenborough in order for the City to perform required maintenance activities on the former site. In this case, the City as the operator is the responsible party. The work performed at the site by the City includes on-going ground water sampling and monitoring, grading and cover maintenance and repairs to prevent surface water infiltration, and landfill gas monitoring and corrective action. The City has, through it's consultant Bryan A. Stirratt and Associates (BAS), performed various engineering studies to determine appropriate and required repairs to the landfill cover as a result of regulatory requirements set forth by the State Water Resources Control Board, and enforced by the Santa Ana Regional Water Quality Control Board (SARWQCB). On April 2, 2002, SARWQCB approved the proposed Cover Improvement Plans, and the Special Provisions and Technical Specifications for the Cover Improvements. Work on installation of the cover repairs by the City was scheduled to be performed in 2002; however, Glenborough identified a potential development for this site and requested a delay in order to fully explore this opportunity. Unfortunately, this opportunity did not materialize as hoped and it was determined that the cover repairs would need to proceed. This determination was made in mid 2003. Both the LEA and SARWQCB have put the City on notice that the Cover Improvements and Landfill Gas Collection System need to be completed, otherwise enforcement activities will be commenced. On May 3, 2004, the City awarded a contract to Bryan A. Stirratt & Associates for the design and construction of a landfill gas collection and treatment system and improvements to the landfill cover system. 1 As part of the improvements to the landfill cover system, it is necessary to purchase significant qu.antities of low permeability soils. These soils are specially designed to limit surface water infiltration into the landfill, thus preventing grou'ndwater contamination. Previously, BAS had identified only three potential sources within the southern California area that could provide this material; use of these sites would have required additional soil testing to ensure compatibility with the requirements set forth in the design specification as approved by the SARWQCB. In January, 2004, the County of San Bernardino, Solid Waste Management Division requested their purchasing department to solicit bids for low permeability soils for use at the Milliken Landfill. On January 13, 2004, the County received three solicitations in response to the request for bids. Of the three bids, one was a no-bid response from 4th Street Rock, the second bid was for $4.40/ton from Dispatch Trucking, Inc and the lowest responsible bid was from Robertson's Ready Mix, Ltd at $3.95/ton. The bid price included the cost for transporting the soils to the Milliken Landfill site, located north of Mission Boulevard and west of Milliken Avenue in Ontario. The County awarded a purchase order on February 10, 2004. A copy of the County's bid packag~ and agenda item are attached, Exhibit I. BAS contacted Robertson's Ready Mix, Ltd., regarding the availability of the City piggybacking on the County's bid purchase. On June 14, 2004, Robertson's provided a positive response; however, due to the incre.ased haul distance from Robertson's Gypsum Canyon facility to the Waterman Landfill, they have requested an additional $0.25 per ton increase in the price charged to the County. This additional transportation cost increases the per ton cost to $4.20 per ton; this is still lower than the second vendor from the County facility. A copy of the letter from Robertson's Ready Mix Ltd., is attached, Exhibit II. BAS has estimated 122,000 tons of materials will be needed to complete the landfill cover repairs at the Waterman Landfill, subject to final compaction and grading needs of the site. The total cost for this tonnage is $512,400.00, based on a $4.20 per ton rate. Staff is recommending that an additional 12,200 tons be factored into this estimate, in the event that additional tonnage is necessary. The total estimated cost for this purchase including the 10% contingency is $563,640.00. The final dollar cost will be based on actual tonnage delivered to the site. Currently, the cost for the design and construction of the landfill gas collection and treatment system and the improvements to the landfill cover system work performed by BAS is $784,604. The action contemplated under this staff report is $563,640. An additional $150,000 will be required for the purchase by the City of the actual Landfill Gas Pump and Treatment facility, and approximately $20,000 for miscellaneous hazardous materials disposal from the various drilling activities needed for installing the LFG. Financiallrnpact: Funds in the amount of $600,000 were included in the FY04-05 Refuse Fund Budget under Account 527-415-5111. BACKGROUND INPORMATION: The Milliken Sanitary Landfill (MSL) is an Inactive Class IJllandfill located at 2050 South Milliken ,Avenue, approximately 1 mile west of Interstate 15 end 1.2 miles southeast of the Ontario Intamatlonal Alrpol1, In the City of Ontario, COunty of san Bemardino. The site consists of 196 acres, or which 140 acres comprise the landfill's footprint Landfilling operations began in 1958, and continued until operations ceased on March 6, 1999, . Due to the large slze of the MSL's permitted footprint, closura coll5tr\1atlon was divided Into three construction phases. Phase 1, which was completed In the Spring of 1997, consisted of the closure constructlon of the 23-acr& East Mound with a 6-foot thick monolithic alternative COlIer system.
