I RESOLUTION NO. 19-,;20./ 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH LITTLE LEAGUE BASEBALL, INC. 3 RELATING TO FUNDING OF THE WESTERN REGIONAL LITTLE LEAGUE TOURNA- MENT. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY I 5 OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The funds paid to Organization shall be used by it 18 urposes, to wit: the Western Regional Little League Tournament nd the resultant promotion and publicity of the City of San 19 ernardino, 20 NOW, THEREFORE, it is mutually agreed between the parties 21 ereto as follows: 22 1. At the end of said term, 4 any unexpended grant funds shall be returned to City by Organiza- 5 tion. 6 3. Prior to the expiration of this agreement and at such 7 times as may be requested by the City Administrator or Director 8 of Finance of City, Organization shall submit to the City Admin- 9 istrator, with a copy to the Director of Finance, an accounting 10 of the proposed and actual expenditures of said funds, including 11 t the +ine item amounts and purposes for which said funds have "12 been' spent" or obligated. Fiscal records shall be maintained by 13 Organization in such a manner as to permit the City to easily 14 trace the expenditures of the funds. All books and records of 15 Organization are to be kept open for inspection at any time 16 during the business day by the City or its officers or agents. 17 The 'accounting report shall be submitted by Organization in 18 conformance with established City guidelines and Organization 19 shall comply with any rule or regulation of the Mayor and Common 20 Council concerning use of the funds granted hereunder as may be 21 now in effect or hereinafter enacted. 22 4. Organization shall not discriminate as to any person 23 because of race, color, creed, or sex. Organization shall have 24 and comply with Affirmative Action guidelines in its employment 25 practices. 26 5. City reserves the right to require Organization to 27 obtain the prior written consent of City for the imposition of 28 any charges or fees, and the amounts thereof for such funded -2- ." 10 11 12 15 20 22 _ >'-.~""''''' -........;, .. '.~ 1 activities, and of any rules and regulations governing said 2 activities. 3 6. Organization hereby covenants and agrees to indemnify 4 and save harmless the City and its employees and agents from all 5 liabilities and charges, expenses (including counsel fees), suits 6 or losses however occurring, or damages arising or growing out 7 of the use or receipt of the funds paid hereunder and all 8 operations under this agreement. Payments hereunder are made 9 with the understanding that the City is not involved in the performance of services or other activities of Organization. Organization and its employees and agents are independent con- tractors and not employees or agents of the City in performing 13 sa:l,d services. 14 7. If Organization shall fail to comply with any term, condition or provision of this agreement or to expend or use the funds as herein provided, the City may terminate this agreement by mailing written notice to Organization, and this agreement 16 17 18 shall thereupon terminate forthwith. 19 City shall have the right to terminate this agreement and any funding hereunder for any reason by mailing a ten (10) 21 day written notice to Organization and this agreement shall 23 terminate ten (10) days after the mailing of such notice; and thereafter any unused funds shall be returned to City. 24 8. Holcomb Mayor and Common Council 300 North D Street San Bernardino, California 92418 Dear Mayor Bob: Another Little League season is underway and our major event of the year, the Western Regional Little League Tournament, is just around the corner. It will be held during the period of August 10 through August 18, 1979. I am writing to respectfully request your consideration at the Council meeting to continue your annual allocation of $3500.00 the following facets of the Tournament. May 21 City to make possible Transportation (teams to and from Airport) Get Acquainted Picnic (feed 600) V. 1. P. Luncheon Transportation--Disneyland (14 teams) Parents--Community Luncheon $ 700.00 650.00 400.00 1100.00 650.00 $3500.00 This is the same budget I submitted in 1978 for these events and we spent $3,394.93. We returned the balance of $105.07 to the City. Each year the Tournament grows in popularity and we have already set the wheels in motion to make the 1979 tournament, the greatest ever. We expect to receive more media coverage for the Tournament in the Los Angeles media and thus, we should exceed in attendance the 55,000 people that we attracted in 1978. Our continuing physical. development is another plus in making our appearance more inviting and attractive, which certainly will impart a longer lasting and more favorable impression on the thouSands of visitors from outside our City, many of whom will be making their first visit to San Bernardino. ?l~as~ accept my most sincere thanks for your considerations in this matter and also the outstanding support you have given in the past.
