RESOLUTION OF THE CITY OF SAN BERNARDINO
FINDING AND DETERMINING THAT PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE
ADDITION OF PARKING PLACES TO THE CENTRAL
CITY PARKING DISTRICT AND THAT THE SPECIAL
ASSESSMENT, INVESTIGATION AND LIMITATION
ACT OF 1931 SHALL NOT-APPLY
WHEREAS, the Mayor and Common Council of the City
of San Bernardino have preliminarily found that the public
interest, convenience and necessity require the acquisition
and installation of property improvements for providing
additional off-street public parking facilities in a portion
of the City, within the Central City Parking District, as
more fully hereinafter described, including the acquisition
of land, rights-of-way and easements necessary therefor,
and grading, leveling, paving, installation of curbs, gutters
and sidewalks, lighting and striping of parking areas and
other site improvements necessary to prepare the property
to be acquired as public parking places; and
WHEREAS, in pursuance thereof, the Mayor and
Common Council of the City of San Bernardino adopted a
Resolution entitled:

AND DIRECTING PUBLICATION OF
NOTICE OF A TIME AND DATE OF A
PUBLIC HEARING"; and
WHEREAS, a full and f~ir public hearing in
accordance with Section 5 of Ordinance No. 3589, as amended,
(the "Off-Street Parking Ordinance") has been held, and
the Mayor and Common Council are fully advised in the premises.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED
AND ORDERED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, AS FOLLOWS:
Section 1. Protests Overruled. That a full and
fair public hearing having been held, as stated in the recitals
herein, and the Mayor and Common Council, having heard and
considered all comments received thereon and being fully
advised in the premises, hereby overrules all protests received.
Section 2. Public Convenience and Necessity. That
it is hereby found and determined that the public convenience
and necessity require the acquisition and installation of
property improvements for providing additional off-street public
parking facilities in a portion of the City as proposed and
that the Special Assessment, Investigation and Limitation Act
of 1931 shall not apply.

Section 3. Effective Date. This Resolution shall
became effective immediately upon its adoption by an affirma-
tive vote of six-sevenths (6/71 of the llIernDersof the Conunon
Council.
