'7~~ ..t.41 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THE NECESSITY TO ADD ADDITIONAL PARKING PLACE IMPROVEMENTS AND CONFIRMING THE ASSESSMENTS WITH RESPECT THERETO WHEREAS, on April 2, ~979, the Mayor and Common Council of the City of San Bernardino (the "City") adopted Resolution No. 79-131, as amended by Resolution No. 79-169 adopted April 16, 1979, (the "Resolution") declaring its intention to add parking places to the Central City Parking District (the "District") in the City of San Bernardino, and, to that end acquire and install or cause to be acquired and installed, whether by lease or otherwise, necessary improve- ments and the acquisition of land, rights-of-way and easements necessary therefor, pursuant to the provisions of Ordinance No. 3589 of the City of San Bernardino, as amended, (the "Off-Street Parking Ordinance"); and WHEREAS, said Resolution determined and declared that an annual ad valorem assessment shall be levied on all land within the District to provide moneys for any or all of the purposes set forth in Section 2 of the Off-Street Parking Ordinance and, in particular, to pay all or any part of the costs and expenses of providing the additional parking places; and D123-3(ic) 5/16/79 T .( Llty tnglneer Date: April 20, 1979 Parking Place Commission. - 2 - are shown on Exhibit C. FINANCING The cost of the expansion will be financed through contributed funds, and a commercial loan obtained by the Redevelopment Agency. The loan will be secured by a lease of the expanded parking areas to the City. Funds for the lease payments will be derived through contributed funds and a percentage calculation of the existing.assessment, which is based on assessed valuation of land only. Residential property lying within the boundaries of the District will continue to be exempt from any assessment along with any governmental properties. The assessment shall be a separate and distinct charge, and will be levied, collected and enforced in the same manner, at the same time, and with same penalties and interest, as other taxes levied for the City. The commercial loan will be obtained for a 28 year term. The District will pay'interest only on the loan for the first three years, after which principal and interest payments will be paid to the term of the loan. The . ' annual cost, including maintenance, operation and security of the expanded parking is projected to be no more than 30% of the existing assessment. It is anticipated that the contributed funds will be sufficient to keep the projected assessment from increasing when payments on the principal become due. When the loan is retired, the City will receive title to the parking areas. Financing for the expansion will continue to be spread to all owners of real property within the existing District boundaries. Although property owners will realize an increase in their annual cost of "doing business", there will be offsetting benefits to many property owners since the increase of efficient, well-managed parking areas will add to the value of their properties. It is - 6 - .. likely that the expanded parking district will have positive impacts other than improved parking for many property owners in the project area. As an example, owners may not have to face the. possibility of purchasing prime property at top interest rates to provide for their own required parking, even if such land were avai~able. Through location and use of the expanded parking areas, each owner in the vicinity of these areas will gain wide exposure to potential customers by virtue of the area type parking rather than the limited exposures of the small individual parking areas. - 7 - IV. MAINTENANCE, OPERATION, AND SECURITY Responsibility for the maintenance, operation, and security of the expanded parking areas shall be vested in the Mayor and Common Council acting by and through the Parking Place Commission. It is anticipated that most of the expansion area adjoining Parking District Lot No.2 will be designated for customers, whereas most of the area adjoining Parking District Lot No.3 will be designated,at least in the initial period,for employees. Security and maintenance will be provided in the same manner and level of service as now being provided for the present District. - 8 - l " V. FUTURE PROPERTY DEVELOPMENT The City Planning Ordinance (No. 1991) was amended by Ordinance No. 3799, adopted on Feb. 21st, 1979. This amendment prescribed parking space requirements for new developments within the Parking District. These require- ments were needed to control land use in such a way that new.developments will not overburden the supply of parking spaces available to existing businesses, whil~ at the same time encouraging new_developments and expansion of existing facilities (See Exhibit D). Expansion of the Parking District will continue the availability of parking spaces for those who elect to make in-lieu payments or apply their credits toward their parking space requirement, as permitted by the City's Planning Ordinance as amended. - 9 - ~ VI. CHURCHES, FUNERAL CHAPELS, THEATERS, AUDITORlUNS, CLUBS, STADIU~IS, SPORTS AllERA.S, GYNNASIUi.1S AND SHIILAR PLA.CES OF ASSEl-lBLY - a. There shall be at least one (1) parking space for every five (5) permanent seats. b. In cases where seating or a portion.of the seating is to be by tem- porary or movable seats, there shall be at least one (1) parking space for every forty (40) square feet of area \~ithin the facility potentially usable for such seating. c. In cases of facilities where no seating is normally provided, there shall be at least one (1) space for each 1310 hundred fifty (250) square feet of gross floor area. 3. General Hospitals - There shall be at least one (1) parking for each bed, plus at least one (1) parking space for each three (3) plus at least one (1) parking space for each staff doctor. b. There shall be at least' one and one-quarter (1 1/4) parking spaces 12 for each dwelling unit containing two (2) bedrooms or less, and at least one 13 and three-quarter (1 3/4) parking spaces for each dwelling unit containing three 14 (3) bedrooms or more in a multiple d~/ellingbui1ding. The required parking 15 spaces for each dwelling unit shall be added to each other in determining the 16 total spaces required. 17 c. Multiple [h/elling Residential Projects Designed Specifically for 18 Elderly and/or Handicapped - There s~all be at least three-quarters (3/4) 19 of a parking space for each dwelling unit containing tv/o (2) bedro~~s or less, 20 and at least one and one-quarter (1 1/4) parking spaces for ea~h dwelling 21 unit containing three (3) bedrooms or more. ADDITIONS OR'STRUCTURAL ENLARGHlENT OF EXISTING BUILDI1IGS - Buildings and structures within the Parking District constructed prior to the effective date of this Section shall be governed by the parking space and non- conforming regulations, if any, in effect at the time of their construction. In the event of an addition or structural enlargement to a building or structure, after the effective date of this Section. located within the park~ I ,ing District and in existence at the time.of the effective date of this Sectlon, parking spaces required by this Section shall be provided for the additi~n or I I I 1. TED AFTER THE EFFECTIVE DATE OF THIS SECTION ~ In the event of an addition or structural enlargement of a building or structure. located within the Parking District. and said building or structure was constructed after the effective date of this Section. parking spaces required by this Section shall be provided for the addition or structural enlargement. 1. The number of parking spaces required for the addition or structural enlargement to such buildings shall be reduced in an amount equal to one (1) parking space for each seven hundred fifty (750) square feet that the gross , parcel area exceeds the gross ground floor area of the building or structure as it existed prior to the addition or structural enlargement. No reduction shall be made for a fraction of a space. 2. The number of parking spaces required for the addition or structural enlargement to such buildings shall also be reduced in an amount equal to one (1) p~rking space for each in-lieu parking space payr..ent made pursuant to subparagraph J at the time the building I'tas constructed. E. CHANGE OF USE - Any structure which has a change of use after the effective date of this Section. resulting in a requirement for more parking spaces than the previous use. such requirement shall be reduced by one (1) parking space for each seven hundred fifty (750) square feet of gross parcel space. 1. For a change of use in a portion of a structure. the parking required shall be based on the actual floor area involved. In o,'der for parking spaces to be eligible for meeting the parking requirements of this amendment, and to be credited against the annual Parking District assessment, such parking spaces shall be located within six hund.'ed (600) feet of the su~ject property. The parking spaces may be located within or outside the boundaries of the Parking .District. G. Hhere parking requirer.1ents set forth in this subsection result in a fraction of a parking space being required, the next higher whole number shall be the parking requirement, H. Whenever parking is required by this Section, handicapped parking facilities shall be provided in accordance with State Guidelines. 1. OTHER CmmITIONS - 1. For use not specifically mentioned, the requirer.1ents for off-street parking spaces shall be the same as for similar mentioned uses. In cases where conflict may arise, the Parking Place C~nmission shall determine the required number of parking spaces and such determination shall be based upon the requirements for the most comparable uses specified herein. 2. IUXED OCCUPAtlCIES - In the 'case of mixed occupancies, the total requirement for off-street parking shall be the sum of the requirements for the various uses computed separately, -J. HI-LIEU PAYI-1ENTS - Upon the approval of the Parking Place COITt:1ission, a cash payment may be made in lieu of providing the number of parking spaces, or any portion thereof, required by this section. 1. Such in-lieu payments shall be the product of multiplying the number of spaces not provided by the total estimated cost of acquiring and improving land within the District for providing one (1) parking space. 2. The in-lieu paynlent shall be. made to the City prior to the issuance of a building pennit for the subject development. 4. All funds received from in-lieu payments shall be used only to acquire land for and construct and improve additional parking facilities to serve the Parking District. Such additional parking spaces shall be provided when determined to be appropriate by the Mayor and Co~on Council upon the recommendation of the Parking Place Commission. K. All off-street automobile spaces and areas required, or othen1ise provided, shall comply with all the conditions set forth in this subsection and shall be maintained as such thereafter in a reasonably clean and safe condition to insure the efficient use thereof. . i - -\ L. Off-street parking facilities required by this ordinance not c\'med or operated by the Parking District shall be a continuing obligation of the property owner so long as the use requiring vehicle parking facilities con- tinues_ It shall be unlawful for an owner of any building or use, to dis- continue or dispense with required vehicle parking facilities without providing other vehicle parking facilities which meet the requirements of this ordinance or making such in-lieu payments to the Parking District as hereafter I' set forth. I H. The required off-street parking facilities shall be kept available fori parking purposes and shall not be used for storage of materials, construction areas, loading areas or similar uses which prohibit the use for parking purp- oses. It shall be unlawful for any owner of any building or use, to cause the required off-street parking spaces to become inaccessible, except for emergency use or reasonable and necessary construction, repair and ~aintenance activities on subject parcel or on adjoining property. 11.
