'/(1'..1 ( - 1-.'- ./'(' //./> RESOLUTION NO. 7'?-/L?tb RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH A NOTICE CALLING FOR APPLI- CATIONS FROM COMPANIES INTERESTED IN ENTERING INTO PROJECT FINANCING AGREE- MENTS UNDER ORDINANCE NO. 3815 WHEREAS, Ordinance No. 3815 authorizing the financing of projects for the encouraging of increased employment within the City of San Bernardino became effective on May 17, 1979; and WHEREAS, Section 7 of said Ordinance provides that, upon said Ordinance becoming effective, the City Clerk shall publish in a newspaper of general circulation within the City a notice (hereinafter referred to as "Notice Inviting Applications") setting forth substantially the following: (i) That the City has duly adopted and approved said Ordinance seeking to promote industrial growth within the City so as to encourage increasing long-term employment for the residents thereof; (ii) that on and after the effective date of said Ordinance, the City will accept applications on forms approved by the City from companies interested in entering into project agreements for the B45/4 (gl) 5/16/79 .' ~ an ernar J.no 60, 0'99-4~~ financing of facilities hereunder; and (iii) that the City will review such applications and determine the feasibility of each project so submitted, and will undertake to commence the financing thereof as soon as practicable; and WHEREAS, the Mayor and the Common Council of the City must now authorize and direct the City Clerk to publish such a notice. NOW, THEREFORE, THE MAYOR AND THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. Notice Inviting Applications. The invitation for applications for the financing of facilities under said Ordinance is hereby authorized, such invitation to be substantially in accordance with the Notice Inviting Applications attached hereto as Exhibit "A" and by this reference incorporated herein. Said Notice Inviting Appli- cations is herein approved. Section 2. Publication of Notice Inviting Applications. The City Clerk shall cause to be published in The Sun-Telegram, a newspaper published and of general circulation in the City of San Bernardino, California by (1) insertion on or before May 25, 1979, the Notice Inviting Applications. -2- B45-5 (gl) 5/15/79 o. cc:a.u Dt::.r:nara~no 60,O.99-4~2 . Section 3. Application Forms. The City Attorney is hereby authorized and directed to prepare a suitable application form and to request the assistance of any staff personnel and any of the City's consultants. EXHIBIT "A" CITY OF SAN BERNARDINO NOTICE INVITING APPLICATIONS FOR THE FINANCING OF INDUSTRIAL PROJECTS NOTICE IS HEREBY GIVEN THAT: (1) The City of San Bernardino has duly adopted and approved Ordinance No. 3815, seeking to promote indus- trial growth within the City so as to encourage increasing long-term employment for the residents thereof; and (2) The City will accept applications on forms approved by the City from all those interested in entering into project agreements for the financing of facilities as provided in said Ordinance; and (3) Those interested should write the City Clerk, City Hall, San Bernardino, California to request application forms. Such requests should state the identity of the persons involved and briefly describe the project in which they are interested. (4) The City will send out application forms to those requesting the same, and upon receipt of a completed B45-7 (gl) 5/15/79 ,i. ~ . no application, will review the same and determine the feasi- bility of each project so submitted, and, if the application is approved, will undertake to commence the financing thereof as soon as practicable. As a private citizen, I am in favor of the City using any powers it may have to encourage increased employment in the City; however, in my capacity as the City Clerk, I respectfully refuse to publish said Notice as so ordered on the grounds that it is in excess of the powers of the Mayor and Common Council and the City of San Bernardino, because the Ordinance is, or may be, invalid.
