RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THE
EXISTENCE OF A PUBLIC NUISANCE FOR 1979 WEED ABATEMENT.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. There now exists in the City of San Bernardino,
on the lots and parcels of property herein described, public
nuisances consisting of the existence of weeds, dry grass, dead
trees, tin cans, abandoned asphalt or concrete, rubbish, refuse,
and waste materials, being situated upon sidewalks, vacant lots,
parkways and other property; the existence of said nuisances
create an unhealthy ahd unsanitary condition and a fire hazard to
the inhabitants of said City; and the removal thereof is necessarl
to protect the health'and. safety of the inhabitants of said City.
SECTION 2. The Street Superintendent shall cause a notice
to be given to the owners of all property on which or in front of
which said nuisances exist which notice shall be substantially in
the form prescribed ih Section Five of Ordinance No. 2022. Such
notices shall be ~iled' to.,the property owners as their names and
addresses appear on the last equalized assessment roll of the
County of San Bernardino, or as they may be known to the Street
Superintendent. As an alternative to mailing the notices in the
manner and form prescribed above, such notices may be conspicu-
ously posted on or in front of the properties on which, or in
,
front of which saidc'nuis;:ux:eg,-enst. Said notices shall be posted or
mailed at least ten (10) days prior to the time set for the hear-
ing of objections by the Mayor and Common Council of the City of
San Bernardino, and the date of said hearing of said objections
and protests is hereby set for the 7th day of May, 1979, at the

SECTION 3. Any property owner shall have the right to have

any such nuisance removed at his own expense, provided the same iSI

done within ten (10) days after the posting or mailing of the

"Notice to Clean Premises", and to the satisfaction of the Chief
7
Engineer and Street Superintendent.

SECTION 4. Upon the conclusion of said hearing, the Council
9
may, by resolution, order the Street Superintendent to abate said
nuisances, and the entiie cost of abating assessed against each
lot or portion of the lQt, all of which said assessments shall

constitute special assessments, and under the provisions of Ordi-
nance No. 2022 of:said git:y shali\entitle said City to a lien
thereon until paid.

SECTION 5. It is hereby found, determined, and declared

that the lots and parcels of property on which said public
nuisances exist, include each of the lots and parcels of land in
17

the City of San Be~nardjno, California, more particularly des-
cribed in Exhibit "A", a copy of which is attached hereto and
19
20
incorporated by reference herein as fully as though set forth at
21
length, and which are designated by reference to the official maps
22
of the County Assessor of San Bernardino, County.

I HEREBY CERTIFY that the foregoing resolution was duly
