RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A FIRST AMENDMENT TO LEASE WITH FRANK RUIZ RELATING
TO THE USE OF AN OFFICE BUILDING LOCATED AT 1287 WEST FIFTH STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
a First Amendment to Lease with Frank Ruiz relating to the use of
an office building located at 1287 West Fifth Street, a copy
of which is attached hereto, marked Exhibit "An and incorporated
herein by reference as fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

FIRST AMENDMENT TO LEASE
(Community Development Neighborhood Office)
THIS FIRST AMENDMENT TO LEASE is made and entered into
this 71't/ day of .ffl~ ' 1979, by and between FRANK
RUIZ, an individual, hereinafter called uLessorn, and the CITY OF
SAN BERNARDINO, a municipal corporation, hereinafter called
IILessee n .
WIT N E SSE T H.
WHEREAS, Lessor and Lessee entered into a lease on
November 3, 1975" relating to the use of an office building
located at 1287 West Fifth Street, San Bernardino, California; and
WHEREAS, the "parties now desire to amend said lease to
,-set forth more specificcl).ly the maintenance responsibility of
Lessor and Lessee, and to provide for an additional one year
term,
NOW, THERErORE, the parties hereto agree as follows:
1. Paragraph 1 of that lease dated November 3, 1975, is
hereby amended to r~ad as follows:
"1. Maintenance. (a) Acceptance o!. Premises: Lessee
,
agrees to accept the premises on possession as in good state of
repair and in sanitary co~ition.
(b) Repairs and Replacements: (1) Lessee shall maintain
,
and keep in good repair the interior portion of the building on
said premises, and any repairs an~ replacements by Lessee shall bel
limited to those caused by Lessee's negligence.
(2) Lessor
shall maintain roof, foundation, and structural- soundness of
exterior walls.
(3) Lessee agrees to surrender the premises
at the end of the lease in the same condition as when it took

1 possession, allowing for reasonable use and wear, and damage by
2 acts of God, including fire and storms. (4) Lessee agrees to
3 remove all business signs or symbols placed on the premises by it
4 before redelivery, and to restore to the Lessor the premises on
5 which they were placed in the same condition as before their
6 placement.
7 (c) Equipment Warranty: Lessor warrants that the heating
8 and air conditioning system and all plumbing and wiring are in
9 good operating condition, and agrees to maintain said equipment
10, in good repair.
11 (d) Lessee's Right to Repair and Deduct: Lessor agrees
12 that, upon notification by Lessee, he shall perform all repairs
n l:equired bY' him within a reasonable period of time. If Lessor
14 does not make said repairs within a reasonable period, Lessee
15 may have the work performed, pay the cost therefor, and deduct
16 said costs from the succeeding months' rentals."
'17 2. Pursuant to Paragraph 7 of the lease dated ~ovember 3,
18 1975, relating to the extension of the lease for successive one
19 year periods by giving written notice to the Lessor of the City's
20 intent, said lease is hereby extended for an additional twelve
21 month period beginning July 1, 1979, through June 30, 1980, for
22 the sum of $235.00 per month.
