RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO RELATING TO RELOCATION OF TENANTS - NUNEZ PARK EXTENSION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an Agreement with the Redevelopment Agency of the City of San Bernardino relating to relocation of tenants - Nunez Park Extension, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. I AGREEMENT RELOCATION OF TENANTS - NUNEZ PARK EXTENSION SAN BERNARDINO, CALIFORNIA THIS AGREEMENT is made and entered into this 14th day of February, 1979, by and between the CITY OF SAN BERNARDINO, a municipal corporation, hereinafter referred to as "City", and the REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, State of California, hereinafter referred as the "Agency". WITNESSETH: that the City and the Agency, for the consideration stated herein, mutually agree as follows: ARTICLE I: STATEMENT OF WORK: The Agency shall provide all relocation counseling and assistance, in accordance with Federal Regulations, to the current tenants of 1921 West 5th Street and 1931 West 5th Street, San Bernardino, California for the City. More specifically the tenants shall include and be limited to: Mr. Frank Stevens Frank's Mobile Home Supply 1931 West 5th Street San Bernardino, California Mr. Jerry Onken Harold Onken Sales Storage Area, 1931 West 5th Street San Bernardino, California Mr. John Davis 1921 West 5th Street, Apt. #1 San Bernardino, California Ms. Bernita C. Barona 1921 West 5th Street, Apt. #3 San Bernardino, California ;' t,; f . Ms. Barbara Jennings & daughter 1921 West 5th Street, Apt. #4 San Bernardino, California Ms. Marchette Daniels & daughter 1921 West 5th Street, Apt. #5 San Bernardino, California The Agency representatives shall provide periodic progress reports to and advise the Director of Community Development (hereinafter "The Director") of any problems encountered in providing relocation assistance. The Director shall make the final determination on actions to be taken to resolve relocation problems based on facts presented by the Agency and/or tenant. The Director shall sign or have signed all written communications with the above tenants pertaining to Rental Agreements and relocation. The Agency shall provide the aforementioned tenants with the necessary required documents for submitting claims, assist tenants in completing these forms and verify entitlements. The Director shall approve or disapprove all claims for relocation payments. All approved claims shall be paid direct to the claimant by the City of San Bernardino. It is further understood that this contractual agreement between the City and the Agency pertains to relocation assistance only and that the Agency has no res- ponsiblity for the payments of relocation benefits from its funds or for the maintenance and/or repairs to the real properties being vacated or the adjacent properties. -2- ! . ~ . . ARTICLE II: COMPENSATION: The City shall reimburse the Agency for the actual costs incurred while performing relocation requirements relevant to this contract. These costs will include, but are not limited to, preparation of correspondence and/or forms, telephone calls, coordination, counseling, physically looking for comparable replacement housing and business locations, inspecting proposed new locations for compliance with Federal requirements and other administrative functions in support of these requirements; and Shall include reimbursement at the rate of pay of the staff member performing a requirement associated with this contract multiplied by the actual number of hours expended, plus the actual mileage driven at the Agency rate per mile at the time of submission. Said compensation shall be subject to receipt by the City of requistions for payment from the Agency certifying that it has performed the services under this agreement. ARTICLE III: RELATIONSHIP OF PARTIES: The relationship of the Agency to the City is that of an independent contractor. ARTICLE IV: TERMINATION: This agreement shall terminate upon relocation of all individuals and businesses listed in Article I or upon written agreement between the City and the Agency. whichever first occurs. -3- ~~.
