RESOLUTION OF THE CITY OF SAN BERNARDINO
PRELIMINARILY DETERMINING THAT PUBLIC
CONVENIENCE AND NECESSITY REQUIRE ADDITION
OF PARKING PLACES TO THE CENTRAL CITY
PARKING DISTRICT AND SETTING AND DIRECTING
PUBLICATION OF NOTICE OF A TIP~ AND DATE
OF A PUBLIC HEARING .
WHEREAS, the City of San Bernardino (the "City")
as an exercise of its mu~icipalaffairs powers has enacted
an Off-Street Parking Ordinance, as amended, (Ordinance
No. 3589) to provide a procedure for the formation of off-
street parking districts within the City; and
WHEREAS, pursuant thereto, the Central City
Parking District (the "District") was formed within the City
and a lease arrangement was entered into with the San
Bernardino Redevelopment Agency for certain parking places,
and it is now deemed necessary and desirable to add
additional parking places to the District pursuant to said
Off-Street Parking Ordinance; and
WHEREAS, as a further exercise of the powers
vested in the City by virtue of Section 19, Article XVI,
California Constitution, the City intends to conduct a
hearing and hear protests, if any, as to why the acquisitions
and improvements for the additional parking places should
not be completed without compliance with a Special Assess-
ment Investigation, Limitation and Majority Protest Act of
1931.

NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED
AND ORDERED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
Section 1. The Mayor and Common Council of the
City hereby preliminarily find and determine that public
interest, convenience and necessity require, and it is the
intention of the Mayor and Common Council, pursuant to
Procedural Alternative III of the Off-Street Parking
Ordinance and Section 6(r) thereof, to add parking places
to the Central City Parking District, the boundaries of
which are, generally, 2nd Street on the south, 5th Street
on the north, extended to Church Street between "F" and "0"
Streets, "G" Street on the west and Arrowhead Avenue on the
east, excepting the Central City Mall area also shown on
Exhibit "A", attached hereto, and incorporated herein.
Section 2. The property (land, rights-of-way and
easements) to be acquired is indicated on Exhibit "A", and
the proposed improvements thereto shall include, but are
not limited to, grading, leveling, paving, installation of
curbs, gutters and sidewalks, lighting, and striping of
parking areas, and other site improvements necessary to
prepare the property to be acquired for use as public parking
places. The estimated cost of such improvements, acquisitions,
maintenance, operation and security is set forth on Exhibit
liB" attached hereto.

Section 3. An annual assessment is to be levied
on land only. The estimated amount of such first annual
assessment, based upon the estimated costs, is indicated
on Exhibit "C", attached hereto and incorporated herein.
Section 4. It is not proposed to issue bonds
under said Procedural Alternative III of said Off-Street
Parking Ordinance, but instead to proceed under Section
6(r) thereof to levy each year an ad valorem assessment
on all taxable land, as the case may be, within the Central
City Parking District to provide moneys for all or any part
of the costs and expenses of providing parking places without
issuing bonds. The costs and expenses of providing parking
places may include, but shall not be limited to, lease pay-
ments, the costs and expenses of operating, maintaining,
repairing and improving the parking places, engineering fees,
appraisal fees, legal fees, financial consultant fees, cost
of land and rights-of-way acquisition, expenses of all
proceedings and all other costs and expenses for carrying
out the purposes of the Off-Street Parking Ordinance. The
rate of ad valorem assessment shall be fixed by the Mayor
and Common Council each year so as to produce sums required
to pay the estimated costs and expenses above mentioned.
The assessment shall be levied, collected and enforced in
the same manner, at the same time, and with the same penalties
and interest, as in the case of taxes levied for the City.

This assessment levy shall be separate and distinct and
shall not be commingled with any assessment levy necessary
to pay the rent due from the City to the Redevelopment
Agency of the City of San Bernardino under and pursuant to
that certain "Parking Facilities Lease" dated for convenience
as of February 1, 1977, by and between the City and said
Redevelopment Agency. Further, the assessments levied to
pay the aforesaid rent shall have priority over any assess-
ments levied pursuant to these proceedings to provide
additional parking places.
Section 5. Any person interested may file a protest,
in writing, with the City Clerk, containing therein a descrip-
tion of the property in which the signer thereof is interested,
sufficient to identify the same, and, if the signers are not
shown on the last equalized assessment roll as the owners of
such property, such protests must contain or be accompanied
by written evidence that such signers are the owners of such
property.
Section 6. A public hearing is hereby set and ordered
to be held and notice is hereby given that a public hearing will
be held at:

At said hearing, any and all interested persons may appear
to show cause, if any they have, why the Mayor and Common
Council should not find and determine the public convenience
and necessity require the proposed acquisition and improve-
ments without compliance with the Special Assessment
Investigation, Limitation and Majority Protest Act of 1931.
Section 7. The City Clerk is authorized and
directed to cause a copy of this Resolution to be published
in a newspaper of general circulation published in the City
and a copy to be posted in three (3) public places within
the proposed improvement district at least fifteen (15) days
before the time fixed for the hearing.
Section 8. The City Clerk is authorized and
directed to cause a copy of this Resolution to be mailed at
least fifteen (15) days before the time fixed for the hearing,
to each holder of title to taxable land within the proposed
improvement district, as such ownership is shown on the last
equalized county assessment roll.
