RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH RUSS CHRISTIANSON RELATING TO A
DEPOSIT OF MONEY TO COVER THE COST OF HAVING REAL PROPERTY
APPRAISED AND ADVERTISED FOR SALE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
an Agreement with Russ Christianson relating to a deposit of
money to cover the cost of having real property appraised and
advertised for sale, a copy of which is attached hereto, marked
Exhibit "I" and incorporated herein by reference as fully as
though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

WHEREAS, City owns certain real property shown on Exhibit
10 "A" attached hereto and incorporated herein by reference which
1] real property is located within the City of San Bernardino; and
12 ~VHEREAS, City no longer has a need for the property and
13 desires to sell it; and
14 ~VHEREAS, the property needs to be appraised to determine
15 its fair market value; and
16 WHEREAS, the Prospective Buyer is willing to post a
17 deposit with City to cover the cost of having the property
18 appraised and advertised for sale,
]9 NOW, THEREFORE, the parties agree as follows:

1. The Prospective Buyer shall, concurrently with the
2] execution of this agreement, deposit with City the sum of

One Thousand Dollars ($1,000.00),
in lawful money
23 of the United States of America.

2. City shall use the funds deposited by the Prospective
25 Buyer to have the property appraised and advertise the property
26 for sale pursuant to the Charter and ordinance provisions within
27 sixty (60) calendar days from the date of the agreement.

3. If the Prospective Buyer's bid is accepted for the
purchase of the property, the deposit will be credited to the
purchase price.
4. Upon sale of the property by City to another buyer, I
the deposit posted by the Prospective Buyer will be returned
to the Prospective Buyer within thirty (30) days from the sale
of said property.
5. If no bids are received by City, or if all bids are
rejected by City, City shall retain the deposit to compensate

costs incurred.
The Prospective Buyer agrees to, and shall, hold City, I

its elective and appointive boards, commissions, officers, agents,
and employees harmless from any and all liabilities and claims of
the Prospective Buyer as a result of City's agreement with the
Prospective Buyer.
7. All notices given pursuant to this agreement shall be
in writing and delivered in person or sent by first class mail,
postage prepaid, addressed as follows:
