6 WHEREAS, the Mayor and Common Council as the governing body of the
7 City of San Bernardino are initiating proceedings for a change of organization
8 (annexation) pursuant to Government Code Section 35000, et seq.

10 NOW, THEREFORE, the Mayor and Common Council do hereby resolve,
11 determine and order as follows:

SECTION 1, Application and a proposal is hereby made to the Local
13 Agency Formation Commission of the County of San Bernardino for the annexatbn
14 of inhabited territory located south of Base Line Street, east and west of
15 Tippecanoe Avenue, and the detachment from County Service Area No. 38,
16 Improvement Zone G of CSA No, 38, County Service Area No, 70, Improvement
17 Zone A of CSA No. 70, and CSA SL-1, as outlined in the justification form
18 marked Exhibit "A" and the plan and narrative marked Exhibit "B", which are
19 attached hereto and incorporated by reference as fully as though set forth
20 at length herein,

SECTION 2, The Clerk of the governing body is hereby authorized
22 and directed to file a certified copy of this resolution with the Executive
23 Officer of the Local Agency Formation Commission of the County of San
24 Bernardino,

26 the Mayor and Common Council of the City of San Bernardino at

RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND ESTABLISHING CHARGES FOR
SERVICES AND FACILITIES FURNISHED BY TilE CITY SEI~ERAGE SYSTEM.
BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
AS FOLLOWS:
SECTION 1. Pursuant to the provisions of Ordinance No. 2175 of the City of
San Bernardino, any premises which are served by a connection to the system of
sewerage and waste water treatment of the City or which are within 200 feet of and
situated on real property adjoining an existing sewer system and not connected
thereto but served by City water shall be charged and the owner thereof shall pay
a sewer service charge based upon the following schedule:
1. For each single family dwelling, the sum' of three dollars and thirty cents
($3.30) per month.
~. For each single family dwelling in any duplex, triplex, court and apartment
building, the sum of three dollars ,and thirty cents ($3.30) per month per dwelling unit.
3. For each hotel or motel the sum of three dollars and thirty cents ($3.30)
per month plus one dollar and sixteen cents ($1.16) for each dwelling unit maintained

4. For each rooming house, the sum of three dollars and thirty cents ($3.30)
per month plus one dollar and sixteen cents ($1.16~ for each room maintained for
rental in excess of four rooms.
5.' For each establishment engaged in the business of manufacturing, railroading,
~arehousing, processing or wholesaling and each public utility, governmental gency,
banking institution, local or national non-profit charitable organization the sum of
three dollars and thirty cents ($3.30) per month plus sev~nteen cents ($.17) for
each full-time employee in excess of ten (10) full-time employees.

6. For each commercial or business establishment not otherwise provided for in
this ordinance, the sum of three dollars and thirty cents ($3.30) per month plus.

fixed by this subsection shall be applicable only to that portion of any building

(8) For each office suite situated in any building other than an office
building, the sum of three dollars and thirty cents ($3.30) per month.
11. For each hospital, rest home, the sum of three dollars and thirty cents
($3.30) per month plus one dollar and sixteen cents ($1.16) per each patient bed
facility.
12. For each trailer camp or trailer park, the sum of three dollars and thirty
cents ($3.30) per month plus two dollars and forty eight cents ($2.48) for each
available trailer space.
13. For each theater, dance hall, s.kating rink, pool hall, bowling alley
or other places of amusement, the sum of six dollars and sixty cents ($6.60) per
month plus thirty three cents ($.33) for each eating seating facility in excess
of fifteen (15) such ~eatings.
14. . For each club house, lodge, the sum of six dollars and sixty cents ($6.60)
per month, plus thirty three cents ($.33) for each eating seating facility in

NEW SERVICE INSTALLATION CHARGES
RULE AND REGULATION NO. 5
Water services will be installed to the property line of property
located within the confines of the City of San Bernardino served by this
Department, upon application to the Department.by the property owner, or his
authorized agent, and the subsequent payment in.advance of the established
charges, providing that said property to be served fronts on or is adjacent
to a public roadway or right of way wherein the Department maintains a
standard domestic water line, and further provided that said service shall
conform to all rules and regulations established by the Department.
Where a regular charge has been fixed for the type of service
connection desired, such regular charge shall be paid in advance by the
applicant. ~~ere there is no regular charge, the Board reserves the right
to require the applicant to deposit an amount equal to the estimated cost of
such service connection. The schedule of regular service connection charges
is as follows:

APPLICATION FOR MAIN EXTENSION
RULE AND REGULATION NO. 20
(a) New Applicants For Service
To provide water service to-any parcel of land requiring an extension
<of the existing water pipeline system, the owner or his authorized
--.agent shall submit to the Board of -Water Commissioners an application
-~equesting service. The application shall include the following:
-~. A complete legal description of the parcel requiring
4lervice.
:2. A plat map showing the "proposed water service location,
_3. -Additional information as -may be requested_by the
~oard of Water-Commissioners.

-:1Jpon receipt of said application, ,the -General Manager of the Water
,Department shall make a complete investigation, including costd,
,availability of supply, the adequacy<of the supporting zone and
~he facilities that would tie into the proposed extension and shall _
;report _his findings to the Board of Water Commissioners. Upon
~onsideration of this report, thp. Board shall either approve or
,disapprove the application. . <

(e) Main Line Extension A~reement
If the applicant is not the owner of all l?roperty fronting on or
adjacent to the proposed main extension, then a contract may be
entered into by the applicant and the Board setting forth the
following:
1. The official_number and legal description of the
tract or property to be served, and a plat showing
the various parcels included therein.
2. The location and description of the proposed main
extension and total amourtt of the water main
construction charge to be paid in advance by said
applicant to the City.
3. Designation of the parcels of property in said
application not owned by the applicant that will be
benefited by the main installation which are to be
subject to Water Department rules, and charged a
per front foot charge prior to and in addition to
water service installation charges.

4. A provision that over a period of ten (10) years from
the date of installation, the Water-Department will
refund semi-annually to the- applicant, or his assignee,
the water main extension charges that are collected
from other consumers requiring service from the
applicant's water main extension paid for by the
applicant. Any balance remaining on deposit at the
expiration of the said ten-year period shall become
the property of the Municipal Water Department of the
.City of San Bernardino.
S. All extensions thus provided for, in accordance with
these regulations, shall be and remain the property
of, the City of San Bernardino l!unicipal-Water Department.
(f) Dead-end Lines

No dead-end lines shall be permitted, except at the descretion of
the General ~rnnager of the Water Department, and in cases where
circulation lines are necessary, they shall be designed and
installed by the I-later Department at the applicant's expense,
including any necessary easements, and in addition to other
charges properly applicable, as elsewhere set forth.

(g) All individual parcels requesting service that are bordered by .
dedicated right-of-way on more than one side shall make payment
to the Water Department based on the total of the footages.
(Individual residential lots of less than 20,000 square feet
will make payment based on the parcel frontage.)

Sub-divisions and/or tracts requiring main lines will be charges
on a per foot basis for all main installed.

* Multiple family dwellings shall be charged @ $200.00 per
dwelling unit or by meter size, whichever is the greater
amount.
On October I, 1978 and each October 1 thereafter, the acquisition
. of service ,charge shall increase in proportion to the most
recently published twelve month increase in the Construction Cost
Index published in "Engineering News Record", a publication of McGraw-
Hill, Inc.; provided that the Water Board may, atits option, determine
by resolution adopted prior to October 1, that such' an increase shall
not be effective for the next succeeding fiscal Year~ In the event the
Construction Cost Index has not changed or has decreased, the charge shall
not be changed.

All applicants for new water service in the City shall pay an
acquisition of service charge in accordance with the schedule
in section (i) hereof. The charge shall be paid prior to any
water service connection and shall be in addition to all other
charges imposed by the Water Department. (Fire services excluded.)
(j) If the applicant is an individual property owner and certifies to
the Board of Water Commissioners that he is financially unable to
make the advance payments as hereinabove required, he may request
that such payments be prorated over a period of five (5) years,
pursuant to an agreement with the Municipal Water Department.
Said applicant shall provide the Board with sufficient financial
data to support his request for said exception.
. Said agreement shall provide for the amount as determined by the
foregoing schedule, plus a carrying charge of $40.00, and interest
cO!IIPuted at 9% per year on the unpaid balance, payable in monthly
installments. In no event shall such payments extend beyond five
(5) years.
Any failure to pay the successive monthly installments shall con-
stitute a breach of said agreement and entitle the Department to
discontinue construction of such main extension or water service
to the property benefited under said agreement.
The full amount of any such charge for proposed main extensions,
or value of work performed or services rendered, prior to a breach
thereof under this extended pa~ent agreement, less amounts
already paid, shall constitute a lien upon the property benefited
under said agreement. Said lien shall have a priority over any
other liens, and be payable and collectible in the same manner as
any tax liens upon real property, or payable and collectible in
full by ~he applicant or his successors in interest prior to a
resumption of water service to the property benefited.

NARRATIVE FOR PROVIDING SERVICES FOR A
PROPOSED ANNEXATION TO THE CITY OF SAN
BERNARDINO, LOCATED SOUTH OF 'BASELINE
STREET, EAST AND WEST OF TIPPECANOE AVENUE
The Mayor and Members of the Common Council of the City of San 'Bernardino
agrees and desires to annex the above described inhabited territory to the City
of San Bernardino, for the following reasons:
1. The territory proposed to be annexed is encompassed on three sides by the
corporate limits of said City, and whereas a request for annexation has been received
from within the area proposed to be annexed.
2. The incorporation of this territory will "help contribute to and facilitate
the orderly growth and development of the existing City area and the territory proposed
to be annexed.
3. This annexation will also help to provide a uniform and orderly manner of
growth, planning and zoning of lands, and the subdivision of lands therein in such a
manner most conducive to the welfare of said City and said inhabited territory. '
The City of San Bernardino has planned for providing all typical City services
to the area under consideration for annexation. Currently through contractural
agreements with the County this area is already receiving partial services provided
by"the City of San Bernardino.
The following is an enumeration and description of services which will be extended
to the affected territory, which describes the level and range of such services that
will be provided, as well as the feasibility of extending such services and any
improvements that will be required"by the City, along with a description of when the
services will conunence and the financing of such improvements and services and any
condition imposed by the City.
1. Planning, Zoning, Code Enforcement and Building Inspection - The City shall
provide these services in conformance with appropriate government codes" and City
Ordinances as well as following the City's General Plan for zoning and subject to the
provisions of Land Use Ordinance No. 1991. This ,function is supported under- the City's
tax rate and appropriate zoning, building and permit fees.
2. Parks and Recreation - The area proposed for annexation will have no impact
on park or recreational facilities or programs, and no additional service will be
required as a result of the annexation. Recreation services available to this area
are presently provided through the programs and recreational activities currently con-
ducted at Perris Hill Park, approximately one (1) mile north of this proposal, and the
facilities located at Patton Farms located at Arden and Pacific, approximately one and
three-quarters (1-3/4) of a mile southwest of said proposal. The cost to the taxpayer
within the proposed annexation will be collected through the property taxes, and by
required fees charged to those individuals who wish to participate in City sponsored
recreational activities where charges and fees are applicable.
3. Library Service - The City presently serves the area with two (2) "branch
libraries. Coddington Branch Library, located at 1003 E. Highland Avenue, is the
closest of the two. It is important to note thllt the resources of the entire library
system are readily made available to the proposed annexation, including the Downtown
Central Library. The library facilities are partially supported by a designated
library tax rate of $0.21 @ $100 of assessed valuation, which is included in the tax

rate for the City.
4. Public Safety, Police - The San Bernardino Police Department is authorized
a complement of 199 sworn officers and approximately 63 civilians not counting 53
school crossing guards.
The Patrol Division maintains a 12 beat or section split of the City. The
Patrol Division presently averages 15 police units on patrol 24 hours a day, counting
supervisory and traffic personnel.
The Detective Division has 30 sworn officers and works from 8:00 a.m. to 5:00
p.m. daily, Monday through Friday.
The Services DiVision maintains all records and identification and provides
-~upport services to the other two divisions on a 24 hour a day basis.
--The only cost for these police services is property taxes to the City.
5. Public Safety, Fire, Paramedic and Rescue - The City of San Bernardino is
currently providing fire protection to the proposed annexation area under CSA 1138. _ "_
Fire protection service which will-continue upon annexation and the affected resfdents
will be provided with a Class 3 rated Fire Department with ten (10) different fire
~tations to respond. The closest of -these is Station No. 8 located at 3398 East
cHighland Avenue. A typical structural fire on the first alarm deploys two (2) engine
--companies, one (1) ladder truck company, a paramedic squad and one (1) Battalion Chief.
In addition to fire protection. the City also has a minimum of three (3) paramedic
~its on duty 24 hours a day, each unit has two (2) paramedics each, giving a total
of six (6) paramedics on duty at all times. Also, the City is equipped with helicopter
~sistance for rescue and/or evacuation service when required. The department's
~perhtion is financed under the City's tax rate.
6. Public Safety, Ambulance Service - The City of San Bernardino under
Ordinance No. 1987 franchise to Courtesy Ambulance Company as the only medical trans-
portation carrier within the City limits. The rates are established by the above
.,.ordinance and said fees are paid by the user as set forth below.
(1) Ambulance Rates:
,(~) Response to a routine non-emergency call, $45.00;
non-routine emergency call. $10.00 additional.
(b) Each mile or fraction of a mile $2.00.
(c) On scene time $.50 per minute for calls requiring
emergency response.
(d) Night service charge 7:00 p.m. to 7:00 a.m., $7.50.
(e) Response to a call for _ambulance not used, $15.00.
(f) For each additional patient. 50% over charge for one patient.
(g) Carrier shall be permitted in its discretion to fix the
rates for special services.

(2) Wheelchair Passenger Transportation Vehicle Rates:
(a) Response to call, $9.00.
(b) Each additional passenger (from and to same addresses) $4.50
(c) Each mile or fraction thereof - one way. $ .65.
(d) Sunday and legal holiday charge. $5.00
(e) Night service charge, 7:00 p~m. to 7:00., $5.00.
(f) Waiting time or standby time after first 15 minutes at
request of or for the benefit-of the passenger for each
15 minute period or fraction thereof, $5.00.

(g) Passengers covered by Medi-Cal will be charged and billed at
the State's schedule of maximum a~lowances.
7. Public Safety, Animal Control ~ The City provides for the regulation of
animals as required by the Health and Safety Codes and City Ordinances. The City
presently provides animal control to this County area under a present contract.
Once annexed, the cost will be absorbed in the City's tax rate. There are present
plans for expanding the City's animal shelter facilities located at 333 Blood Bank
Road that will allow for an additional 12 new holding pens. Currently, the City has
4 full time animal control officers, equipped with 4 appropriate vehicles.
8. Street Construction, Maintenance and Sweeping - Upon annexation, the City .
would continue the regular maintenance and sweeping program, which is paid for out
of the City's tax rate. If any new streets, curb, gutter or sidewalks are constructed
within this proposal, the cost will be borne at the developer's or property owner's
expense and shall be constructed to City Standards. Also, under the jurisdiction
of the Street Division is the City's control and operation of the weed abatement
services which will also be extended to this area once annexed.
9. Lighting - The City of San Bernardino's Electrical Division of the Public
Works Department maintains the street lighting once annexed. Any expansion of the
present services or future additional lighting would be.contingent upon development
of the area, which cost would be paid at the expense of the developer, or at the
request of residents.
10. Flood Control - This service is provided .by the County and remains so
after annexation to the City. Please see the outline below which references the
existing and future services provided in this area.
1. The operation and maintenance of all District facilities are
financed by Flood Control Tax, which is a part of the overall
property tax.
2. Warm Creek occupies the south portion of the area, This is a
water channeling facility for control of run off.
11. Parking - The public parking provided within this project area is both
on and off street parking, which is regulated under City Ordinances and enforced by
the City Police Department. When the area is further developed, the City's Planning
Department and Engineering Division will make the appropriate recommendations
for off street parking in conformance to City Ordinances that regulate parking for
the type of development which would be applicable. The cost of off street parking
would be borne by the developer and/or property owners, when additional areas are
developed. .
12. Wastewater: Collection, Treatment, Disposal and Reclamation - The City of
of San Bernardino and the East San Bernardino County Water District partially serves
this area with existing mains located as follows:
The City of San Bernardino has an existing 21" V.C.P. main located 6' east of
centerline on Conejo Drive south of Baseline to the beginning of the cul-de-sac
where said main turns west and is enlarged to a 24" V.C.P. line. This line runs
west to a point 28' east of centerline on Tippecanoe Avenue, where said line runs
south and west clear of this project.

17. Transit - Upon annexation, the bus service provided for this area will
remain under the control of Omnitrans, which is as follows:
The area is served by Route 24 which provides hourly service in both directions
along 9th Street. The running hours are from 7:25 a.m. to 7:25 p.m. at 9th and Sterling,
Monday thru Saturday, with alternate routes available. Please see Exhibit ''D'' for
~dditional information.
Route 11 also provides this area with service along Baseline Street. The running
hours eastbound are from 6:21 a.m. to 6:48 p.m. at Baseline and Waterman. with half
hour service and westbound from 7:05 a.m. to 7:39 p.m. also at half hour intervals.
Omnitrans' long range transit plans are at the request of residents in the
.:area through their Councilman or directly to Omnitrans. Such change must have
~pproval of the City Council.
The Short Range Transit Plan calls for "continuation of the present service
l.evels on these routes. Service level changes are made twice yearly, in January
.and June, and are initiated at the request of the City Council and/or Omnitrans
planning staff.
Public transportation in the.Omnitrans service area is financed by the following

(1) Section 5 of the Urban Mass Transportation Act.
(2) Article 4 of the Transportation Development Act.
