RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION
OF DISTRICT NO. 314 (LAFC 1865).

WHEREAS, pursuant to the provisions of the Municipal Organization
4
Act of 1977 (Gov. Code Section 35000, et seq.), proceedings were initiated
5
by the Common Council of the City of San Bernardino, to annex to the City
6
of San Bernardino certain contiguous uninhabited territory hereinafter
7
described; and
8
WHEREAS, a Negative Declaration was issued by the County Environmenta
9
Review Committee in connection with said uninhabited territory and said
10
information is on file in the office of the Clerk of the Board of Supervisors
11
of the County of San Bernardino; and
12
WHEREAS, at its meeting of December 13, 1978, the Local Agency
13
Formation Commission of the County of San Bernardino duly adopted its
14
Resolution No. 1482, granting approval to proceed, subject to conditions;
15
established the City of San Bernardino as the conducting authority, and
16
set forth that the distinctive short form designation to be used throughout
17
this proceeding shall be: LAFC 1865; and
18
WHEREAS, on the 8th day of January, 1979, a resolution was adopted
19
y the aforesaid Common Council of the City of San Bernardino, California,
20
ec1aring that proceedings had been initiated by said Council, and proposing
21
he annexation of the hereinafter described uninhabited territory to the City
22
of San Bernardino, and that said resolution provided that the proposed
23
annexation should be generally known and identified as Annexation District
24
No. 314; and
25
WHEREAS, said resolution set forth therein that all the property
26
included in the aforesaid territory should be taxed equally with the other
27
roperty within the City to pay the bonded indebtedness and any and all
28
eneral indebtedness of the City of San Bernardino contracted prier to or

1 existing or outstanding at the time of the aforesaid proposed annexation
2 of said described property as provided in said Act; and
3 WHEREAS, said resolution did fix, determine and declare that a
4 hearing be held on the 19th day of February, 1979, at the hour of 7:30
5 o'clock p.m., in the Council Chambers of the City Hall, 300 North "D" Street,
6 San Bernardino, California, and the same was the day, hour and place
7 designated where any person owning real estate within such territory so
8 proposed to be annexed and having any objections to the proposed annexation
9 might file a written protest, appear before the Common Council of the City of
10 San Bernardino and present evidence or objections why such uninhabited
11 territory should not be so annexed to the City of San Bernardino; furthermore,
12 said resolution provided that such written protest should be filed with the
13 City Clerk at any time before the conclusion of said hearing; and
14 WHEREAS, there were no written protests filed with the City Clerk
15 of the City of San Bernardino prior to the conclusion of said hearing on
16 February 19, 1979; and thereafter, on the 19th day of February, 1979,
17 Resolution No. 79-67 was adopted by the Mayor and Common Council declaring
18 that a majority protest has not been presented; and
19 WHEREAS, it appears to the Common Council of the City of San
20 Bernardino that the aforesaid annexation proceedings have been completed and
21 all acts performed in accordance with said Government Code, conditions of
22 LAFC Resolution No. 1482, adopted December 13, 1978, and any and all other
23 laws in any way connected with the said annexation proeedure; and
24 WHEREAS, the Common Council of the City of San Bernardino desires
25 to approve at this time the annexation of the aforesaid territory.
26 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
27 BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation

1 District No. 314 is hereby annexed and incorporated in and made a part of the
2 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
4 the City of San Bernardino is particularly described as follows, to wit:
5 Those portions of Sections 26, 27, 28 and 34, Township 1 North,
Range 3 West, San Bernardino Base and Meridian, according to
6 the official plat of said land approved by the Surveyor General,
September 19, 1883, and that portion of Tract No. 5299, as per
7 plat thereof recorded in Book 76 of Maps, pages 74, 75 records
of the County Recorder, County of San Bernardino, State of
8 California, and those portions of the adjoining streets described
as follows:

Beginning at a point on the present Corporate Limits of the City
of San Bernardino, said point being the intersection of the
center line of City Creek Road, State Highway No. 207, and the
East line of said Section 28; thence North along said City
Limit Line and said East line, a distance of 1320 feet more or
less to an angle point in said City Limit Line, said point also
being the Northeast corner of the South one-half of the Northeast
one-quarter of said Section 28; thence leaving said City Limit
Line North along the West line of said Section 27, a distance of
1320 feet more or less to the Northwest corner of said Section
27; a distance of 1320 feet more or less to the Northwest corner
of said Section 27; thence East along the North line of said
Section 27, a distance of 5280 feet more or less to the Northeast
corner thereof; thence South along the East line of said Section
27, a distance of 2640 feet more or less to its intersection with
the South line of the Northwest one-quarter of said Section 26;
thence East along said South line of said Northwest one-quarter,
a distance of 1320 feet more or less to the Southwest corner of
the Southeast one-quarter of the Northwest one-quarter of said
Section 26; thence North along the West line thereof, a distance
of 1320 feet more or less to the Northwest corner thereof; thence
East along the North line thereof, a distance of 1320 feet more
or less to the Northeast corner thereof; thence South along the
East line thereof, a distance of 1320 feet more or less to the
Southeast corner thereof; thence West along the South line thereof,
a distance of 600 feet more or less to its intersection with the
brow of the Southeasterly bluff of a certain canyon (Cook's
Canyon) extending in a general Northeasterly and Southwesterly
direction across said section as conveyed to Thomas T. Cook, et
ux, by deed recorded December 6, 1890, in Book 122, page 144 of
Deeds; thence Southwesterly along said brow of the Southeasterly
bluff of said canyon, being the Southeasterly line of Parcel No.
2 as conveyed on the deed to Wilmer C. Hansen, et ux, as
Document No. 24, recorded November 26, 1973, in Book 8314, page
31, OfficiaL Records of said County and following its various
courses and distances, a distance of 3200 feet more or less to
its intersection with the West line of said Section 26; thence
South along said West line of Section 26, a distance of 360 feet

more or less to the Southeast corner of said Section 27;
thence West along the South line of said Section 27, a
distance of 2640 feet more or less to the .Northwest corner
of the Northeast one-quarter of said Section 34; thence
South along the West line of said Northeast one-quarter, a
distance of 342 feet to its intersection with the Northerly
terminus of Orchard Road as said Road is delineated on the
map of said Tract No. 5299; thence continuing South along the
centerline of said Orchard Road a distance of 53 feet more
or less to its intersection with the centerline of Terrace
Drive as also delineated on the map of said Tract 5299;
thence East along said centerline of Terrace Drive, a distance
of 550 feet, more or less to its intersection with the Northerly
prolongation of the West line of Lot 61 of said Tract No. 5299;
thence Southerly along said Northerly prolongation and West
line of said Lot 61 and along the Westerly boundary line of
said Tract No. 5299, a distance of 693.43 feet to its inter-
section with the centerline of Fairway Lane as said street
is delineated on the map of said Tract No. 5299; thence
Southwesterly along the centerline of Fairway Lane as conveyed
to the County of San Bernardino by Document No. 155, recorded
June 13, 1969, in Book 7249, Page 341, Official Records of
said County and its Southwesterly prolongation a distance of
236 feet more or less to its intersection with the Southwesterly
terminus of said Fairway Lane, said point being on the arc of
a curve concave Northeasterly; thence Southeasterly along said
right of way line of Fairway Lane and said curve a distance of
30 feet more or less to its intersection with the Southwesterly
prolongation of the Southeasterly right of way line of Fairway
Lane as delineated on the map of said Tract No. 5299; thence

South 47 13' 45" West along said Southwesterly prolongation
of the Southeasterly line of Fairway Lane being the Northwesterly
line of the land conveyed to David E. Burns, et UK, by Document
No. 887 recorded December 23, 1976, in Book 9079, page 1330,
Official Records of said County, a distance of 40 feet more or
less to its intersection with the Southwesterly line of that
certain parcel of land conveyed in the deed to Title Insurance
and Trust Company, recorded as Document No. 120 on August 11,
1961, in Book 5507, page 397, Official Records of said County;
thence Northwesterly along said Southwesterly line of said
Title Insurance Co. land and following its various courses and
distances a distance of 636 feet, more or less, to its intersection
with the West line of the Northeast one-quarter of said Section
34; thence North along said West line a distance of 174 feet more
or less to its intersection with the centerline of Orchard Road
as said Road is delineated on the map of said Tract No. 5299;
thence Southwesterly along said centerline and following all
its variojfs courses and distances, a distance of 310 feet,
more or r;ss, to its intersection with the centerline of Highland
Avenue; thence in a general Northwesterly and westerly direction
along said centerline of Highland Avenue and following its
various courses and distances, a distance of 4400 feet more
or less, to its intersection with the Present Corporate Limits
of the City of San Bernardino; thence Northeasterly along
said City Limit Line and along the centerline of said City

SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and construction of additions to, relocation of and replacements of the fire
fighting system of said City, the outstanding indebtedness thereon being
$290,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and
2-1/2% per annum.
SECTION FOUR: The property herein annexed is declared to be a part
of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
annexed territory with zoning classification of "0" Open District.
SECTION FIVE: That the area included in the above annexation is
hereby detached from County Service Area No. 38, Improvement Zone G of CSA
No. 38, County Service Area No. 70 and Improvement Zone "A" of CSA No. 70.
I HEREBY CERTIFY that the foregoing resolution was duly adopted by
the Mayor and Common Council of the City of
