EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO

COUNTY OFFICE OF COMMUNITY DEVELOPMENT.

SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City

an Agreement with the County of San Bernardino relating to the
Housing Information Center to be operated by the County Office of

community Developmeot, a copy of which i, attached hereto, marked 1
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly

This agreement provides for partial funding by the City of San Bernardino
of the Housing Information Center to be operated by the County Office of
Community Development. The City will contribute $25,000 to operations of
the Center. The remaining operational budget is allocated from the County's
Community Development Block Grant.
The agreement specifies the services to be provided by the Housing Information
Center and the County's obligation to the City of San Bernardino.

AGREEMENT
This Agreement is between the County of San Bernardino and the City of
San Bernardino for the purpose of utilizing Community Development .Block
Grant funds (CDBG) to establish a Housing Information Center.
The City of San Bernardino will provide $25,000 for operation of the
Center for fiscal year 1978-79. The County of San Bernardino has
allocated $155,000 for the project during the Fiscal Year 1978-79.
This Agreement is made and entered into this IZ~ day of ~
1979, by and between the County of San Bernardino, a Body Politic,
hereinafter referred to as "COUNTY", and the City of San Bernardino, a
Municipal Corporation, hereinafter referred to as "CITY".
WITNESSETH
WHEREAS, the City and the County are authorized pursuant to 570.206
(b) CFR to establish arid operate a center for distribution of housing
purchase, housing rental and related information.
WHEREAS, County and City propose to provide the community with a
central location for housing and referral services; and,
WHEREAS, the County and City desire to expand the availability of
housing information so as to meet the ever increasing needs of low and
moderate income families,
WHEREAS, County and City recognize that the community has no
central location for referral resources for the residents of San .
Bernardino to go and obtain housing information; and,
WHEREAS, the County has received Community Development Block Grant
funds from the Department of Housing and Urban Development, hereinafter
referred to as "HUD", to be used for the implementation and maintenence
of a Housing Information Center for San Bernardino County; and,
WHEREAS, the County and City have approved the Housing Information
Center and have included them in their respected CDBG application; and,
WHEREAS, both County and City seek to coordinate implementation and
administration of the Housing Information Center; and,
WHEREAS, the County shall administer the operation of the Center
including preparation of the operational budget. The City will provide
its share of funding in one (1) payment upon request by the County. The
County will maintain accurate records of expenses to be made available
to the City as may be required.

WHEREAS, the County and the City will maintain the confidentiality
to the extent protected by law of all Pertinent information obtained
from applicants who visit the Housing Information Center; and,
NOW THEREFORE, County and City for and in consideration of the
mutual promises and agreements herein contained, do agree as follows:
1. County shall act as the Lead Agency.
2. City shall provide $25,000 from the City's Community Develop-
ment Block Grant Funds from fiscal year 78-79 for the
implementation of the Housing Information Center.
3. As Lead Agency, County is responsible for conducting all
necessary services or activities necessary prior to opening of
the Center.
4. County reserves the right to review and approve action and/or
decisions related to all applicable regulations.
5. County and City shall imdemnify, hold harmless and defend the
other, its officers, agents and employees against all lia-
bility, claims, losses, demands and actions for injury to or
death of persons, or damage to property arising out of, or
alleged to arise out of or in consequence of this Agreement,
provided such liability, claims, demands, losses, or actions
claimed to be due to the acts or omissions of either party,
its officers, agents, or employees in the performance of this
Agreement.
6. In addition, County shall indemnify, hold harmless, and defend
City against any liability, claims, losses, demands and actions
incurred by City as a result of a determination by HUD that
activities undertaken by the County under this project failed
to comply with any laws, regulations, or policies applicable
thereto or that any funds forwarded to the County under this
Agreement were improperly expended.
7. County's obligation under this agreement is limited to
budgeting $155,000 of the County CDBG for fiscal year 78-79
for operation of the Housing Information Center.

County shall be responsible for the following:
a. Providing all staff and materials for use by the
Housing Information Center;
b. County shall maintain the facility.
c. All utilities, which shall be listed in the name of
the County.
d. To make periodic reports on the status of project,
persons or families served, categories of infor-
mation provided and related information.
8.
The Housing Information Center shall distribute available
housing information to residents of the City of San Bernardino
and shall provide all Housing Information Center services to
said residents during the term of this agreement.
9.
The Housing Information Center shall give services to
residents of the unincorporated area of San Bernardino County
and cooperating Cities.
10.
Operation of the Center shall include the following services:
a. Provide information to prospective home buyers or
available housing purchase programs such as Federal
Housing Administration, Veterans Administration,
California Housing Finance Agency, Conventional Mortgage
programs and such others as may be available during the
term of this agreement.
b. Provide liaison between private lenders and public sector
for training and educational activities relating to home
purchase programs.
c. Provide information to prospective renters to assist them
in securing safe, sanitary and standard housing.
d. Conduct training for prospective buyers, renters, and
tenants in the area of dwelling maintenance.
e. Conduct outreach to appropriate community organizations
and groups as to services available from Housing Infor-
mation Center.
f. Act as referral agency for those persons who require
technical or professional information as may be available
from existing community organizations or institutions.

12. This Agreement may be amended or modified only by written
agreement signed by both parties and failure on the part of
either party to enforce any provision of this agreement shall
not be construed as a waiver of the right to compel enforce-
ment of such provision or provisions, nor to act to release
any surety from its obligation under this Agreement.
13. This agreement provides for the operation of the Housing
Information Center for the Fiscal Year 1978-79 and shall
terminate June 30, 1979 unless extended by mutual agreement.
IN WITNESS WHEREOF, The parties have caused this Agreement to be
executed as of the day and year first written above.
