RESOLUTION NO. 7f-/tfl 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING THE EXISTENCE OF A PUBLIC NUISANCE FOR 1979 WEED ABATEMENT. 1 3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 4 CITY OF SAN BERNARDINO AS FOLLOWS: 5 SECTION 1. That there now exists in the City of San 6 Bernardino, on the lots and parcels of property herein described, 7 a public nuisance consisting of the existence of weeds, dry grass, 8 dead trees, tin cans, abandoned asphalt or concrete, rubbish, 9 refuse, and waste materials, being situated upon sidewalks, 10 vacant lots, parkways and other property, and that the existence 11 of said nuisance creates an unhealthy and unsanitary condition 12 and a fire hazard to the inhabitants of said City, and the remov- 13 al thereof is necessary to protect the health and safety of the 14 inhabi tants of said City. 15 SECTION 2. That the Street Superintendent shall cause a 16 notice to be given in regard to all property on which or in fron 17 of which said nuisance exists which notice shall be substantial 1 18 in the form prescribed, in Section Five of Ordinance No. 2022. 19 Such notices shall be mailed to the property owners as their 20 names and addresses appear on the last equalized assessment roll 21 of the County of San Bernardino, or as they may be known to the 22 Street Superintendent. As an alternative to mailing the notices 23 in the manner and form prescribed above, such notices may be 24 conspicuously posted on or in front of the property on which, 25 or in front of which said nuisance exists. Said notices shall 26 be posted or mailed at least ten (10) days prior to the time for 27 hearing or objections by the Mayor and Common Council of the 28 City of San Bernardino, and the date of said hearing of said 20 21 22 23 24 25 26 27 28 1 objections is hereby set for the 2nd day of April, 1979, at the 2 hour of , in the Council Chamber of City Hall located 3 at 300 North "D" Street, San Bernardino, California. 4 SECTION 3. That any property owner shall have the right to 5 have any such nuisance removed at his own expense, provided the 6 same is done within ten (10) days after the posting or mailing of 7 the "Notice to Clean Premises", and to the satisfaction of the 8 Chief Engineer and Street Superintendent. 9 SECTION 4. Upon the conclusion of said hearing, the Council 10 may, by resolution, order the Street Superintendent to abate said 11 nuisance, and the entire cost of abating assessed against each lot 12 or portion of the lot, all of which said assessments shall consti- 13 tute special assessments, and under the provisions of Ordinance 14 No. 2022 of said City shall entitle said City to a lien thereon 15 until paid. 16 SECTION 5. It is hereby found, determined, and declared 17 that the lots and parcels of property on which said public 18 nuisance exists, include each of the lots and parcels of land in 19 the City of San Bernardino, California, more particularly des- cribed in Exhibit "A", a copy of which is attached hereto and is hereby referred to and made a part hereof as fully as though set forth at length herein, and which are designated by reference to the official maps of the County Assessor.
