RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
SALE OF ONE PARCEL OF REAL PROPERTY LOCATED AT 388 WEST 4TH STREET
IN THE CENTRAL CITY NORTH PROJECT AREA TO JAMES ALAN LONERGAN BY
THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO (HEALTH &
SAFETY CODE SECTION 33433).
WHEREAS, the Redevelopment Agency of the City of San
Bernardino proposes to sell to James Alan Lonergan, hereinafter
referred to as "Developer", one parcel of real property located
within the Central City North Project Area, described in Exhibit
"A" attached hereto and incorporated herein by reference as
though set forth in full, for the sum of Fifty Thousand Dollars
($50,000.00) which will be paid by the Developer in cash; and
WHEREAS, Developer proposes to develop on said real
property a private parking lot to provide parking for tenants of
the 3-story office building at 398 West 4th Street; and
WHEREAS, notice of the time and place of hearing has been
given as required by law; and
WHEREAS, the Redevelopment Agency has made available for
public inspection and copying a summary of financial aspects of
the proposed sale; and
WHEREAS, all hearings have been heard as required by
Health and Safety Code Section 33433,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. It is found and drclared that the considera-
tion for said real property, in accordance with covenants and
conditions governing such sale, may be less than the fair market
value of the property determined at the highest use permitted
under the plan, and that sale for such consideration is necessary

1 to effectuate the purposes of the plan for the following reasons:

(a) Pursuant to Ordinance No. 3366 adopted August 6, 1973,

the Redevelopment Agency and the City of San Bernardino have
4
heretofore adopted a redevelopment plan for the Central City
5

North Project Area.

The plan provides for the acquisition and sale of

real property within the project area.

(c)
The plan provides for and allows uses
9
out limitation, residential, retail and offices,
10
and professional areas, convenience neighborhood centers, general
11
commercial, hotel-motel and other compatible uses, as may be
12
directly of benefit to the general public.

(d) The Developer has offered to purchase the vacant land
14 to be paved and used as a private parking lot for the tenants
15 located at 398 West 4th Street. The Redevelopment Agency may be
compelled to offer this property located within the project area,
17
namely the property to ~e sold to Developer, at a price less
than fair market value as outlined in Section 33433 of the
California Health and Safety Code since the net cost to the
Agency included a commercial building that was determined unsafe
and the cost to rehabilitate the building was prohibitive.
SECTION 2. The Mayor and Common Council of the City of
23 San Bernardino hereby approve the sale of said property upon the
24 terms, conditions, and for the reasons set forth herein.
