RESOLUTION NO. 17"- 1tJ
2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
SALE OF APPROXIMATELY 5.57 ACRES OF REAL PROPERTY LOCATED NORTH
3 OF RIVERVIEW, EAST OF RICHARDSON AND WEST OF MT. VIEW IN THE
SOUTHEAST INDUSTRIAL PARK PROJECT AREA TO MCGREW-KRUGER PARTNER-
4 SHIP BY THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
(HEALTH & SAFETY CODE SECTION 33433).

WHEREAS, the Redevelopment Agency of the City of San
7
Bernardino proposes to sell to McGrew-Kruger Partnership, herein-
8
after referred to as "Developer", approximately 5.57 acres of
9
real property located within the Southeast Industrial Project
10
Area, described in Exhibit "An attached hereto and incorporated
11
herein by reference as though set forth in full, for the sum of
12
Forty-four Thousand Two Hundred Eighty-four Dollars and Forty-
13
five Cents ($44,284.45) which will be paid by the Developer in
14
cash; and
15
WHEREAS, Developer proposes to develop on said real
16
property an office, yard and shop area, consisting of a 5,000
17
square foot building; and
18
WHEREAS, notice of the time and place of hearing has been
19
given as required by law; and
20
WHEREAS, the Redevelopment Agency has made available for

public inspection and copying a summary of financial aspects of

I the proposed sale; and
WHEREAS, all hearings have been heard as required by
23
24 Health and Safety Code Section 33433,
25 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
26 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. It is found and declared that the considera-
28 tion for said real property, in accordance with covenants and

conditions governing such sale, is less than the fair market
value of the property determined at the highest use permitted
under the plan, and that sale for such consideration is necessary
to effectuate the purposes of the plan for the following reasons:
(a) Pursuant to Ordinance No. 3583, adopted June 21,
1976, the Redevelopment Agency and the City of San Bernardino
have heretofore adopted a redevelopment plan for the Southeast
Industrial Park Project Area.
(b) The plan provides for the acquisition and sale of
real property within the project area.
(c) The plan provides for and allows industrial and
commercial uses including, without limitation, industrial and
industrial park development which will include manufacturing,
fabrication, productions and assembly, wholesale and resale dis-
tribution uses, technical service businesses, research and de-
velopment and other related compatible uses and further provides
for and permits commercial uses including without limitation,
business offices, professional offices, retail stores and shops
land other office functions, as may be directly related to industry
and commerce, as well as the general public.
(d) Other states throughout the Nation have adopted
legislation permitting and authorizing the foregiveness of up to
five years taxes to industrial concerns which located within those
states and have adopted legislation permitting and authorizing
the issuance of industrial bonds for the industrial development
for those businesses locating within those states.
(e) There is extremely strong competition from said
states and other cities and counties within the State of

1 California. If the Redevelopment Agency does not sell this
2 property for the sale price stated, this Developer may go else-
3 where with his development, the land could remain undeveloped for
4 some time resulting in the community being deprived of economic
5 betterment that would be derived from the development.

(f) Through the efforts of the Redevelopment Agency staff,
7 this Developer has been contacted and persuaded to locate within
8 the Southeast Industrial Park and to construct industrial
9 facilities and development therein, and as an inducement to said
10 Developer, to meet the competition, the Agency has been compelled
II to offer this property located within the project area, namely
12 the property to be sold to Developer, at a reduced price and less
13 than fair market estimated value determined at the highest use
14 permissible under the said redevelopment plan.

SECTION 2. The Mayor and Common Council of the City of

San Bernardino hereby approve the sale of said property upon the
17
terms, conditions, and for the reasons set forth herein.

I HEREBY CERTIFY that the foregoing resolution was duly
19
adopted by the Mayor and Common Council of the City of San
