LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR THE
3 ANNEXATION OF UNINHABITED TERRITORY REFERRED TO AS: PARCEL NUMBER ONE,
LOCATED AT THE NORTHEAST CORNER OF HIGHLAND AND WATERMAN AVENUES, AND PARCEL
4 NUMBER TWO, LOCATED NORTH OF MARSHALL BOULEVARD, EAST OF VALENCIA AVENUE,
AND DETACHMENT FRCM COUNTY SERVICE AREA NO. 38, IMPROVEMENT ZONE G OF CSA
5 NO. 38, COUNTY SERVICE AREA NO. 70, AND IMPROVEMENT ZONE A OF CSA NO. 70.
6 WHEREAS, the Mayor and Common Council as the governing body of the
7 City of San Bernardino are initiating proceedings for a change of organization
8 (annexation) pursuant to Government Code Part 2 of Division 2 of Title 4,
9 Section 35000, et seq.,
10 NOW, THEREFORE, the Mayor and Common Council do hereby resolve,
11 determine and order as follows:

SECTION 1. Application and a proposal is hereby made to the Local
13 Agency Formation Commission of the County of San Bernardino for the annexation
14 of uninhabited territory referred to as: Parcel Number One, located at the
15 Northeast corner of Highland and Waterman Avenues, and Parcel Number Two,
16 located north of Marshall Boulevard, east of Valencia Avenue, and the detachmen
17 from County Service Area No. 38, Improvement Zone G of CSA No. 38, County
18 Service Area No. 70, and Improvement Zone A of CSA No. 70, as outlined in the
19 justification form marked Exhibit "A", and the plan and narrative marked
20 Exhibit "B", which are attached hereto and incorporated by reference as fully
21 as though set forth at length herein.

SECTION 2. The Clerk of the governing body is hereby authorized
23 and directed to file a certified copy of this resolution with the Executive
24 Officer of the Local Agency Formation Commission of the County of San
25 Bernardino.

'NARRATIVE FOR PROVIDING SERVICES FOR A PROPOSED ANNEXATION TO TIlE CITY OF SAN
-BERNARDINO: PARCEL NO.1. NORTHEAsT CORNER OF HIGHLAND AND WATERMAN AVENUES
PARCEL NO.2. NORTH OF MARSHALL BLVD. AND EAST OF VALENCIA AVENUE
The Mayor and Members of the Common Council of the City of San Bernardino agrees
,and desires to annex the above described uninhabited territory to the City of San
Bernardino as Parcel No.1 and Parcel No.2 for the following reasons:
a) The territory proposed to be annexed is completely surrounded by the
'corporate limits of the City of San Bernardino. and whereas all surface streets
~resently leading to and from this area are currently controlled and maintained by the
City of San Bernardino.
b) The incorporation of this territory will contribute to and facilitate the
,~rderly growth and development of both the City and the territory proposed. to be
,annexed. and will also provide a uniform and orderly manner for planning and 2;oning of
lands. and the subdivision of lands in said City and said unincorporated territory in
-a manner most conducive to the welfare of said City and said uninhabited territory.
c) And the proposed annexation will contribute to and facilitate the orderly
-growth and development of the remaining undeveloped portion and orderly layout. design
'BUd construction of streets. gutters. sidewalks. sanitary and storm sewers and drainage
'facilities. both within the existing City limits and within the unincorporated terri-
..tory proposed to be annexed.
"The City of San Bernardino has planned and has .made projections for providing
-all typical City services. which includes this proposal.' 'This proposed annexation
is in an area that is surrounded completely by the corporate limits of the City of
.San Bernardino and is currently rect<iving some of the City services through contractural
.agreements with the County.
The following is an enumeration and description of services which will be extended
to the affected territory. which describes the level and range of such services that
will be provided. the feasibility of extending such services. and any improvements
that will be required by the City. as well as a description of when the services will
,COllllllence and the financing of such improvements and services and any condition imposed
by the City:
1. Planning. Zoning. Code Enforcement and Building 'Inspection - The City shall
provide these services in conformance with appropriate government codes and City
Ordinances as well as following the City's General Plan for zoning. This function is
supported under the City's tax rate.
2. Parks and Recreation - The area proposed for annexation will have no
impact on park or recreational facilities or programs, and no additional service will
be required as a result of the annexation. Recreation services available to Parcel No. 1
are presently provided through the programs and recreational activities currently
conducted at Perris Hill Park, approximately one fourth (1/4) mile east of this proposal.
Parcel No. 2 is mid-way between Perris Hill and 40th Street Park facilities. which is
approximately 1 mile north of and 1 mile south of said parks respectively. The cost
to the taxpayer within the proposed annexation will be collected through the property
taxes, and by required fees charged to those individuals who wish to participate in
City sponsored recreational activities where charges and fees are applicable.

3. Library Service - The City presently serves both Parcels 1 and 2 with two (2)
-branch libraries. Coddington Branch Library, located at 1003 E. Highland Avenue, is the
closest of the two; while Rowe Branch Library, at 108 -E. Marshall Blvd., is the
alternate branch. It is important to note that the resources of the entire library
system are readily made available to the proposed annexation, including the Downtown
-Central Library. The library facilities are partially supported by a designated
library tax rate of $0.21 @ $100 of assessed valuation, which is included in the
$1.5513 tax rate for the City.
4. Public Safety, Police - The San Bernardino Police Department is authorized
~ complement of 199 sworn officers and approximately 63 civilians not counting 53
school crossing guards.
The Patrol Division Maintains a 12 Beat or section split of the City. The Patrol
Division presently averages 15 Police Units on Patrol 24 hours a day, counting
Supervisory and Traffic personnel. .
The Detective Division has 30 sworn officers and works from 8:00 a.m. to 5:00
p.m. daily, Monday through Friday.
The Services Division maintains all records and identification and provides
support services to the other two divisions On a 24 hours a day basis.
5. Public Safety, Fire, Paramedic and Rescue - The City of San Bernardino is
-currently prOviding fire protection to the proposed annexation area under CSA #38.
Fire protection service which will continue upon annexation and the affected residents
will be provided with a Class 3 rated Fire Department with ten (10) different fire _
Stations to respond. The closest of th~se to either parcel is Station No. 6 located at
~920 Del Rosa Avenue. A typical structural fire on the first alarm deploys two(Z)-
engine companies, one (I) ladder truck company, a paramedic squad and one (I) Battalion
Chief. In addition to fire protection, the City also has a minimum of three (3)
paramedic units on duty 24 hours a day, each unit has two (2) paramedics each, giving
a total of six (6) paramedics on duty at all times. Also, the City is equipped with
helicopter assistance for rescue and/or evacuation service when required. The depart-
ment's operation is financed under the City's tax rate.
The only cost for these Police Services is property taxes to the City.
6. Public Safety, Ambulance Service - The City of San Bernardino under Ordinance
No. 1987 franchise to Cour~esy Ambulance Company as the only medical transportation
carrier within the City limits. The rates are established by the above ordinance and
said fees are paid hy the user as set forth below.
(I) Ambulance rates:
(a) Response-to a routine non-emergency call, $45.00;
non-routine emergency call, $10.00 additional
{b} Each mile or fraction of a mile $2.00.
(c) On scene time $.50 per minute for calls requiring emergency
response.
(d) Night service charge 7:00 p.m. to -7:00 a.m., $7.50.
(e) Response to a call for ambulance not used. $15.00.
(f) For each additional patient, 50% over charge for one patient.
(g) Carrier shall be permitted in its discretion to fix the
rates for special services.
(2) Wheelchair Passenger Transportation Vehicle rates:

(b) Each additional passenger (from and to same addresses) $4.50.
(c) Each mil~ or fraction thereof - one way, $ .65.
(d) Sunday and legal holiday charge. $5.00.
(e) Night service charge, 7:00 p.m. to 7:00 a.m., $5.00.
(f) Waiting time or standby time after first 15 minutes at
request of or for the benefit of the passenger for each
15 minute period or fraction thereof. $5.00.
.(g) Passengers covered by Medi-Cal will be charged and billed at
the State's schedule of maximum allowances.
7. Public Safety, Animal Control - The City provides for the regulation
of animals as required by the Health and Safety Codes and City Ordinances. The City
presently provides animal control to. this County area under a present contract.
Once annexed. the cost will be absorbed in the City's tax rate. There are present
~lans for expanding the City's animal shelter facilities located at 333 Blood Bank
Bead that will allow for an additional 12 new holding pens. Currently. the City
.has 4 full time animal control officers, equipped with 4 appropriate vehicles.
.8. Street Construction, Maintenance and Sweeping - Parcel No. 1 is comprised
~ompletely of a cemetery lot. The streets, etc.. are maintained by the private
property owner under endowment care. Parcel No. 2 is an area which does not front
...on any public right-of-way. nor are there any plans indicating that this area will
require any street improvement or construction. Upon annexation. the City would continue
the regular maintenance and sweeping program in those areas which are applicable and

-within this prcposal the cost will be borne at the developer's expense and shall be
constructed to City Standards.
9. Lighting - The City of San Bernardino's Electrical Divisbn of the Public
Vorks Department maintains the street lighting. There are presently no facilities
located within either parcel of this proposal. Future plans will include upgrading
these lights to a sodium vapor energy source, which will be financed out of the City's
tax rate. Any expansion of the present services or future additional lighthlg would
be contingent upon development of the area, which cost would be paid at the expense of
the developer.
10. Flood Control - This service is provided by the County and remains so after
annexation to the City.The East Twin Creek Channel is the only channel which is adjacent
to Parcel No. 2 of this project on the East side and is not a part of this project.
11. Parking - The only public parking proyided within this project area is on
street parking, which is regulated under City Ordinances and enforced by the City
Police Department~ When the area is further developed. the City's Planning and Engineer-
ing Departments will make the appropriate recommendations for off street parking in
conformance to City Ordinances that regulate parking for the t}~e of development which
would be applicable. The cost of off street parking would be borne by the developer
and/or property owners.
12. Wastewater: Collection, treatment, Disposal and Reclamation - The City has
an existing main within Waterman Avenue and Highland Avenue for Parcel No.1. The
City Records indicate that the adjacent property owners within this proposal are
presently connected to this service. Should the City extend sewer mains into either of
the two areas and should the residences hookup to said City main there will be a $400
connection fee, plus the appropriate charges set forth in Exhibit "A" attached at the
end of this narrative.

The cost for service main extensions and future hookups are determined by the City's
Public Works Department.
The City owns and operates its own Wastewater Treatment Plant which disposes and
Teclaims the various wastewaters collected. There would be no need to expand the
present facilities to provide service to the area proposed to be annexed.
13. Water Service: Acquisition, Storage and Distribution _ Presently, the City
of San Bernardino has no facilities within the project. However, the City does provide
Water Service to the adjacent areas currently within the City limits. Upon annexation,
the property owners could have service when requested and subject to Exhibits "B" and "c"
attached hereto.

The operation and financing of the Water Dept. is totally supported by its rates
and connection fees as set forth in the attached Exhibits "B" and "c" and is not

,14. Cable TV - No cable T.V. service is presently provided to this area.
15. Public Utilities: Electricity, Gas and Telephone Service _ These services
,are currently provided to the project area. The City will allow service to continue
upon annexation under the present franchise agreements between the various'utility
-companies. The rate structure and cost to the property owners are controlled by the
Public Utilities Commission and any expansion of future services will be created by the
request of developers andlor property owners.
16. Solid Waste: Collection and Disposal - The current provider is a private
firm to the unincorporated areas for refuse collection. The City. cannot service the
existing customers for a period of five (5) years, unless the property owners.so request
our service, or when new homes are constructed the City will then provide collection
for these homes automatically. The City service for residential areas is a bi-weekly
pickup with a $3.50 per month charge, which is billed through the City Water Department's
monthly billing. All disposal of solid waste is transported to the various County
Dump Sites which are owned and operated by the County of San Bernardino.
17. Transit - Upon annexation, the bus service provided for this area will
remain under the control of Omnitrans, which is as follows:
Omnitrans currently provides service along Waterman and Highland for Parcel No. 1
and along Valencia between Highland Avenue and 40th Street for Parcel No.2. This
service is provided by Route 1 40th Street between the hours of 5:30 a.m. and 7:30 p.m.
Monday through Saturday. No direct charge is assessed the property owner. There are
no immediate plans for changes in the current level of service. Changes in service may
be made through the Omnitrans long range transit plan or at the request of residents
in the area through their Councilman or directly to Omnitrans. Such change must have
approval of the City Council. Omnitrans operations are financed through S.B. 325 and
local funds.

-Dn the basis of this initial evaluation:
We find the proposed project COULD NOT-have a significant effect On
the environment, and a NEGATIVE OECLARATlON will be prepared.
We find that although the proposed project could have a significant
effect on the environment, there will not be a significant effect
in this case because the mitigation measures described on an attached
sheet have been added to the project. A NEGATIVE DECLARATION WILL BE
PREPAREO.
We find the proposed project MAY have a significant effect on the

PARCEL NO.1: Currently this area is a.cemetery and will probably
be used as one for sometime.
PARCEL NO.2: This area is made up pf parcels of abutting land
which is adjacant to frontage parcels that are in the City. These
County parcels are used primarily for boarding of horses. There
is no known historical or cultural aspects within this project.
