HomeMy WebLinkAbout1979-065 1 2 3 RESOLUTION NO. 7p-w A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 5 ALONG "E" STREET FROM MILL STREET TO RIALTO AVENUE. 4 WHEREAS, a public hearing has been called for February 19,1979, at 5 the hour of 2:00 o'clock p.m., at the Council Chambers, City Hall, San 6 Bernardino, California, to determine whether the public necessity, health, 7 safety or welfare requires the formation of an underground utility district 8 along "E" Street, from Mill Street to Rialto Avenue, San Bernardino, California; 9. 10 and WHEREAS, notice of such hearing has been given to all affected propert 11 owners as shown on the last equalized assessment roll and to all utilities 12 concerned in the manner and for the time required by law; and 13 WHEREAS, such hearing has been duly and regularly held and all 14 persons interested have been given an opportunity to be heard. 15 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF 16 THE CITY OF SAN BERNARDINO AS FOLLOWS: 17 SECTION 1. It is hereby found and determined pursuant to Ordinance 18 No. 2919 and the definitions contained therein that the public necessity, 19 health, safety and welfare require the formation of an underground utility 20 district along "E" Street, from Mill Street to Rialto Avenue, San Bernardino, 21 California, a public street which is extensively used by the general public 22 and carries a heavy volume of vehicular traffic, in order to remove utility 23 poles, overhead wires and associated structures and to underground utilities 24 along said port ton of "E" Street. 25 26 27 28 SECTION 2. An Underground utility district to be known as Under- ground Utility District No.5 is hereby established in that area along "E" Street, from Mill Street to Rialto Avenue, San Bernardino, California, more particularly described as follows: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Those portions of Brown and Waterman Subdivision, M.B. 16/31, Whites Subdivision, M.B. 5/76, Sunnyside Addition, M.B. 1/35, F. J. Halls Subdivision, M.B. 6/45, The Peppers Subdivision, M.B. 17/8 and a portion of Rancho San Bernardino, M.B. 7/2, Records of the County Recorder, San Bernardino County, State of California; described as follows: Beginning at a point on the North line of Mill Street, 100 feet East of the center line of "E" Street; thence North and parallel to the center line of "E" Street to a point 50 feet North of the North line of Rialto Avenue; thence West and parallel to the North line of Rialto Avenue 200 feet; thence South and parallel to the center line of "E" Street to the North line of Oak Street; thence East and parallel to the center line of Oak Street 100 feet to the center line of "E" Street; thence South along the center line of "E" Street to the center line of Oak Street; thence West along the center line of Oak Street to a point 100 feet West of the center line of "E" Street; thence South and parallel to the center line of "E" Street to the North line of Mill Street; thence East along the North line of Mill Street to the point of beginning. NOTE: Drawing No. 5317 by the Engineering Division, City of San Bernardino, is attached hereto and made a part of this description of the "E" Street Underground Utility District No.5. SECTION 3. All poles, overhead wires and associated overhead structures shall be removed and underground installations made in said under- ground utility district within the following times: a. Underground installation by utility ,companies and property owners and reconnect ions not later than January 15, 1980; b. Removal of poles, overhead wires and other associated structures not later than February 15, 1980. SECTION 4: The City Clerk is hereby directed to mail a copy hereof and a copy of Ordinance No. 2919 to all affected property owners as shown on the last equalized assessment roll and to all affected utilities within ten (10) days after the adoption of this resolution.
