A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN I
BERNARDINO DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF II
THE CITY OF SAN BERNARDINO TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN AND DESIGNATED ANNEXATION DISTRICT NO. 314 (LAFC 1865), AND
GIVING NOTICE OF THE PROPOSED ANNEXATION. !

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN

BERNARDINO AS FOLLOWS:

SECTION ONE: That pursuant to the provisions of the Municipal
8
Organization Act of 1977 (Gov. Code Section 35000, et seq.), proceedings have
9
been initiated by the Council of the City of San Bernardino, on its own motion,
to annex to the City of San Bernardino all that uninhabited territory situate
in the County of San Bernardino, State of California, hereby designated as
Annexation District No. 314 (LAFC 1865), and described as follows:
Those portions of Sections 26, 27, 28 and 34, Township 1
North, Range 3 West, San Bernardino Base and Meridian,
according to the official plat of said land approved by the
Surveyor General, September 19, 1883, and that portion of
Tract No. 5299, as per plat thereof recorded in Book 76 of
Maps, pages 74, 75 records of the County Recorder, County of
San Bernardino, State of California, and those portions of the
adjoining streets described as follows:
Beginning at a point on the present Corporate Limits of the City
of San Bernardino, said point being the intersectmon of the
center line of City Creek Road, State Highway No. 207, and the
East line of said Section 28; thence North along said City Limit
Line and said East line, a distance of 1320 feet more or less
to an angle point in said City Limit Line, said point also being
the Northeast corner of the South one-half of the Northeast
one-quarter of said Section 28; thence leaving said City Limit
Line North along the West line of said Section 27, a distance
of 1320 feet more or less to the Northwest corner of said
Section 27; thence East along the North line of said Section
27, a distance of 5280 feet more or less to the Northeast corner
thereof; thence South along the East line of said Section 27, a
distance of 2640 feet more or less to its intersection with the
South line of the Northwest one-quarter of said Section 26; thence
East along said South line of said Northwest one-quarter, a
distance of 1320 feet more or less to the Southwest corner of
the Southeast one-quarter of the Northwest one-quarter of said
Section 26; thence North along the West line thereof, a distance
of 1320 feet more or less to the Northwest corner thereof; thence
East along the North line thereof, a distance of 1320 feet more
or less to the Northeast corner thereof; thence South along the

East line thereof, a distance of 1320 feet more or less to
the Southeast corner thereof; thence West along the South
line thereof, a distance of 600 feet more or less to its
intersection with the brow of the Southeasterly bluff of a
certain canyon (Cook's Canyon) extending in a general North-
easterly and Southwesterly direction across said section as
conveyed to Thomas T. Cook, et ux, by deed recorded December 6,
1890, in Book 122, page 144 of Deeds; thence Southwesterly
along said brow of the Southeasterly bluff of said canyon,
being the Southeasterly line of Parcel No. 2 as conveyed on
the deed to Wilmer C. Hansen, et ux, as Document No. 24,
recorded November 26, 1973, in Book 8314, page 31, Official
Records of said County and following its various courses and
distances, a distance of 3200 feet more or less to its inter-
section with the West line of said Section 26; thence South
along said West line of Section 26, a distance of 360 feet
more or less to the Southeast corner of said Section 27; thence
West along the South line of said Section 27, a distance of
2640 feet more or less to the Northwest corner of the North-
east one-quarter of said Section 34; thence South along the
West line of said Northeast one-quarter, a distance of 342
feet to its intersection with the Northerly terminus of
Orchard Road as said Road is delineated.on the map of said
Tract No. 5299; thence continuing South along the centerline
of said Orchard Road a distance of 53 feet more or less to its
intersection with the centerline of Terrace Drive as also
delineated on the map of said Tract 5299; thence East along
said centerline of Terrace Drive, a distance of 550 feet, more
or less to its intersection with the Northerly prolongation of
the West line of Lot 61 of said Tract No. 5299; thence South-
erly along said Northerly prolongation and West line of said
Lot 61 and along the Westerly boundary line of said Tract No.
5299, a distance of 693.43 feet to its intersection with the
centerline of Fairway Lane as said street is delineated on the
map of said Tract No. 5299; thence Southwesterly along the
centerline of Fairway Lane as conveyed to the County of San
Bernardino by Document No. 155, recorded June 13, 1969, in
Book 7249, Page 341, Official Records of said County and its
Southwesterly prolongation a distance of 236 feet more or less
to its intersection with the Southwesterly terminus of said
Fairway Lane, said point being on the arc of a curve concave
Northeasterly; thence Southeasterly along said right of way
line of Fairway Lane and said curve a distance of 30 feet more
or less to its intersection with the Southwesterly prolongation
of the Southeasterly right of way line of Fairway Lane as
delineated on the map of said Tract No. 5299; thence South
470 13' 45" West along said Southwesterly prolongation of the
Southeasterly line of Fairway Lane being the Northwesterly line
of the land conveyed to David E. Burns, et ux, by Document No.
887 recorded December 23, 1976, in Book 9079, page 1330, Official
Records of said County, a distance of 40 feet more or less to
its intersection with the Southwesterly line of that certain
parcel of land conveyed in the deed to Title Insurance and Trust
Company, recorded as Document No. 120 on August 11, 1961, in
Book 5507, page 397, Official Records of said County; thence

Northwesterly along said Southwesterly line of said Title
Insurance Co. land and following its various courses and
distances a distance of 636 feet, more or less, to its inter-
section with the West line of the Northeast one-quarter of
said Section 34; thence North along said West line a distance
of 174 feet more or less to its intersection with the centerline
of Orchard Road as said Road is delineated on the map of said
Tract No. 5299; thence Southwesterly along said centerline and
following all its various courses and distances, a distance of
310 feet, more or less, to its intersection with the centerline
of Highland Avenue; thence in a general Northwesterly and westerly
direction along said centerline of Highland Avenue and following
its various courses and distances, a distance of 4400 feet more
or less, to its intersection with the Present Corporate Limits
of the City of San Bernardino; thence Northeasterly along said
City Limit Line and along the centerline of said City Creek Road,
State Highway 207, a distance of 3600 feet, more or less, to the
point of beginning.

That there are less than twelve qualified electors residing in said
territory and that said territory is uninhabited as defined by said Act.
SECTION TWO: That the said council of the City of San Bernardino
14 desires to annex said uninhabited territory to the City of San Bernardino for
15 the following reasons: Said territory is contiguous to the City of San
Bernardino and its proposed annexation will contribute and facilitate the
16

orderly growth and development of both the City of San Bernardino and the
18
territory proposed to be annexed, and will provide and facilitate proper
19
over-all planning and zoning of lands in said City and said uninhabited
20
territory in a manner most conducive to the welfare of said City and said
21
uninhabited territory.

SECTION THREE: That upon the completion of said annexation of said
23
territory, all of the property included in said Annexation District No. 314
u
(LAFC 1865) shall be taxed equally with the other property within the City of
25
San Bernardino to pay the bonded indebtedness and any and all general indebted-
26
ness of the City of San Bernardino contracted prior to or existing or outstand-
27
ing at the time of the aforesaid proposed annexation of said described property
28
as provided in said Act.

SECTION FOUR: That Monday, the 19th day of February, 1979, at the
2 hour of 7:30 o'clock P.M. of said day, in the Council Chambers of the City
3 Hall, located at 300 "D" Street, San Bernardino, California, is hereby fixed
4 as the time and place when and where any person owning real property within
5 the uninhabited territory, above described and proposed to be annexed to the
6 City'of San Bernardino, and having any objections to the proposed annexation
1 may appear before the Council of the City of San Bernardino and show cause
8 why such uninhabited territory should not be so annexed to the City of San
9 Bernardino. Such protest must be in writing, may be filed with the City
10 Clerk at any time before the hour set for hearing objections to the proposed
11 annexation, and shall state the name or names of the owner or owners of
12 property affected, and the description of such property in general terms.

SECTION FIVE: The City Clerk of the City of San Bernardino is
14 hereby authorized and directed to cause a copy of this resolution to be
15 published at least twice but not oftener than once a week in the San Bernardino
16 Evening Telegram, a newspaper of general circulation in the City of San
17 Bernardino, the city to which it is proposed to annex the aforesaid territory,
18 and in the County of San Bernardino, California, the county in which is located
19 the territory proposed to be annexed to the City of San Bernardino, said
20 publication to be complete at least twenty (20) days prior to the date set
I for hearing;

The said City Clerk is further authorized and directed to cause
23
written notice of such proposed annexation to be mailed to each person to
24
whom lands within the territory proposed to be annexed is assessed in the
25
last equalized county assessment roll available to said clerk on the date the
26
above said proceedings were initiated, at the addresses shown on said assess-
27
ment roll or known to said Clerk, and to any person who has filed his name
28
and address and the designation of the lands in which he has an interest,

either legal or equitable, with said Clerk, such notice to be given not less
2
than twenty (20) days before the first public hearing on the proposed
3
annexation;

And in the event that any land within the territory proposed to be
5
annexed is owned by a county, the said City Clerk is directed to cause written
6
notice of such proposed annexation to be mailed to the Board of Supervisors of
7
such county, such notice to be given not less than twenty (20) days before the
8
first public hearing on the proposed annexation;
9
And in the event there is upon the land proposed to be annexed a
10
structural improvement owned, being acquired or leased by a county fire pro-
11
tection district, the said City Clerk is directed to cause written notice of
12
such proposed annexation to be mailed to the governing body of such district,
13
such notice to be sent not less than ten (10) days before the first public
14
hearing upon such proposed annexation;
15
And the City Clerk is directed to cause written notice to be given
16
to such other persons as may be legally entitled thereto, in the manner re-
17
quired by law.

I HEREBY CERTIFY that the foregoing resolution was adopted by the
