RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
FOR MUTUAL FIRE PROTECTION SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute on behalf of said City
an Agreement with the County of San Bernardino for mutual fire
protection services, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

AGREEMENT
(Fire Protection Services)
y<. THIS AGREEMENT is made and entered into this

the CITY OF SAN BERNARDINO, a municipal corporation, here-
inafter referred to as "City", and the COUNTY OF SAN BERNARDINO,
a political subdivision of the State of California, hereinafter
referred to as "County".
WITNESSETH:
WHEREAS, fire protection for certain areas
geographically located near, but outside of, the City
is the responsibility of the County; and
WHEREAS, the City maintains a number of fire
near the City limits; and
WHEREAS, both Ci ty and

NOW, THEREFORE, the parties agree as follows:
1. City shall have primary responsibility for fire
protection in all County areas marked in green on the attached
map and generally delineated as follows:
(a) All unincorporated area east of the City
which lies south of the San Bernardino National Forest; west of
Victoria Avenue between said National Forest and Highland
Avenue; west of Sterling Avenue between Highland Avenue and
Norton Air Force Base; and north of Norton Air Force Base.
(b) All totally enclosed unincorporated
County islands within the City.
(c) Unincorporated County area north of the
Santa Ana River, generally between an extension of Sierra Way
and Tippecanoe Avenue, extending to City limits.

2. City and County will jointly respond to fires in
all areas marked in red on the attached map. The respective
fire chiefs of both parties may, from time to time, review said
joint response areas and make adjustments to same where they
mutually agree that joint response to fires is of equal benefit
to both parties.
3. The Chief Engineer of City's Fire Department and
the Chief of the San Bernardino County Forestry and Fire Warden
Department shall be, and they are hereby, directed to develop
a dispatch system for response to fires in the areas delineated
for joint response. County shall have prime responsibility for
fire protection in the joint response areas outside the City
limits, and the City shall have prime responsibility for fire
protection in the joint response areas within the City limits.
4. City's Fire Department shall respond pursuant to
said dispatch system to help control fires in the County portion
of the joint response areas. Companies of the City's Fire
Department shall function under the operational direction of
the senior officer of the County Forestry and Fire Warden
Department present at the scene in such areas.
5. The San Bernardino County Forestry and Fire Warden
Department is hereby directed to respond pursuant to said dis-
patch system to help control fires in the City portion of the
joint response areas. Companies of the San Bernardino County
Forestry and Fire Warden Department shall function under the
operational direction of the senior officer of City's Fire
Department present at the scene in such areas.
6. It is the policy of City and County to mutually
aid each other in the case of fire or any other disaster occurring
within the City or in the unincorporated territory of the County.
(a) The Chief Engineer of City's Fire Depart-
ment, or his designee, shall have sole discretion as to what
men and equipment shall be sent from the City for such mutual
aid.

(b) The Chief of the San Bernardino County
Forestry and Fire Warden Department, or his designee, shall
have sole discretion as to what men and equipment shall be
sent from the County for such mutual aid.
(c) The parties hereto are both signatories
to that certain agreement entitled "California Disaster and
Civil Defense Master Mutual Aid Agreement", and it is the
intention and purpose of the parties entering into this
agreement to provide an agreement covering situations not
contemplated by the Master Mutual Aid Agreement, and it is
mutually understood and agreed that in the circumstances
where the Master Mutual Aid Agreement is applicable, the
Master Mutual Aid Agreement shall apply and control and this
agreement shall be of no force and effect.
(d) It is further mutually understood and
agreed that provisions of Paragraph 6 will be invoked only
when, in the opinion of the head of the department of the
party requesting aid, it is deemed necessary to request
outside assistance because all of the normal facilities at
his command have been exhausted, and outside assistance is
needed to control and suppress a fire, disturbance, or other
local emergency; or when, in the opinion of the department
head requesting the aid, the other contracting parties can
respond more expeditiously.
7. The City shall conduct all fire investigation
and fire prevention inspections in that area described in
Paragraph 1 of this agreement, and all other fire investigation
and fire prevention inspections shall be handled by the agency
within whose territorial jurisdiction the property is located.
8. In consideration of the above, County agrees to
pay City for fire protection services rendered to those areas
specified in Paragraph 1 of this agreement, the sum of fifty-
three thousand four hundred sixty dollars ($53,460.00) for the
period of July 1, 1978, to June 30, 1979. The amount payable
for each succeeding fiscal year shall be negotiated between the
parties and decided upon on June 1 of the immediately preceding
fiscal year, or as soon thereafter as possible.

9. This agreement shall continue in full force and
effect for succeeding fiscal years unless terminated by either
party after thirty (30) days' written notice to the other.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement on the date first hereinabove written.

MINUTES OF THE BOARD OF SUPERVISORS
OF SAN BERNARDINO COUNTY, CALIFORNIA

RE: AGREE. #79-102; COUNTY W!CITY OF SAN. BDNO.; FIRE PRO. SVCS. IN CSA
NO. 38;, COLLATERAL AGREE. REIMBURSING COUNTY: APPROVED
On motion of Supervisor Townsend, seconded by Supervisor McElwain, and
carried, the Board of Supervisors approves Agreement No. 79-102, be-
tween the County and the City of San Bernardino, whereby the City will
provide fire protection and rescue services in certain portions of County
Service Area 38, at a cost of $53,460 for FY 1978/79; said agreement
further provides for joint response in certain areas.
By the same motion, acting as governing body of County Service Area 38,
the Board approves a collateral agreement, between the County and CSA 38,
providing for reimbursement by CSA 38 to the County of the $53,460 paid
to the City of San Bernardino; further, the Board authorizes the Chairman
to sign both agreements, indicating the Board's approval of the terms and
conditions therein contained.
