RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH. THE INLAND MANPOWER ASSOCIATION
RELATING TO THE CETA TITLE II PROGRAM FOR PORTIONS OF THE 1977,
1978 and 1979 FISCAL YEARS WHICH SAID AGREEMENT SUCCEEDS TO AND
REPLACES A PRIOR AGREEMENT AUTHORIZED BY RESOLUTION NO. 13432.
WHEREAS, the Mayor and Common Council, by Resolution No.
13432 authorized the execution of an agreement, dated August
28, 1978, with the Inland Manpower Association relating to the
CETA Title II Program for portions of the 1977, 1978 and 197~
fiscal years and
WHEREAS, it is desired that said agreement with the Inland
Manpower Association be modified and,replaced by the agreement
attached hereto, marked Exhibit "A"and incorporated herein by
,reference in order to provide for a modification of the CETA
Title II ProgJ:'amas set forth in said Exhibit "A"; and
WHEREAS, it is the intention of the parties hereto that
said Exhibit "A" attached hereto be complementary and succeed to
the provisions of the prior agreement with the Inland Manpower
Association relating to the CETA II Program,
NOW, TREREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
authorized and directed to execute on behalf of said City th~t
agreement with the Inland Manpower Association relating to the
CETA Title II Program for portions of the 1977, 1978, and 1979
fiscal years, a copy of which is attached hereto, marked Exhibit
"A" and incorporated herein by reference as fully as though set
forth at length.
It is understood that this agreement
shall super,

cede the prior agreement relating to the CETA Title II Program
executed pursuant to the authority of Resolution No. 13432.

SPECIAL FISCAL YEAR 1979 ASSURANCES
A. New Requirements Effective Irrrnediate1y
All public service employment projects and activities funded under
this Subgrant/Contract are irrrnediately subject to the followingre-
quirements: -
1. All persons hired into public service employment on or after-,
October 27, 1978, must meet the eligibility criteria specified
in Section 99.42 (a) of-the October 18. 1977. Federal Reaister.
(Section 4 (c) (2) of reenactment specifies that the eligibility
criteria of Section 608 of the CETA of 1973 are to apply from
date of reenactment until Janu~ry 26. 1979.
2. Title VI projects funded under Section 607 (b) of the CETA of-
1973, as amended (Section 99.40 (a) (2) of- the October 18..1977~
Federal Reaister). may be extended. and new projects approved for
up to 18 months total operations from the date projects conmenced.

3. Any participant who is hired into a PSE position underl:itles I
or II following September 30, 1978. whose position is being ·
supplemented above the maximum rate of $lO.OPO (Section 96.34
-(c) of the October 18, 1977; regulations), must be terminated
or transferred to another program prior to January 26, 1979
(Section 122 (1) (4) of reenactment). . Any participant who is .

4. Effective October 1, no individual may participate in programs under
this Act for longer than 30 months in any 5-year period; no individual
may receive allowances for institutional or classroom training,for
more than 104 weeks in a 5-year period; and no individual may be
paid PSE wages for more than 78 weeks in a 5-year period (for those -
on board prior to October 1, 1978, no more than 26 weeks of PSE shall
be considered as part of the 78 weeks). Effective October 27, 1978,no
individual (except for in-school youth) may remain in work experience.

a'Subgrant/Contract of assistance pursuant to such Act shall
be fined not more that $10,000 or imprisoned for not more .
than 2 years, or both; but if the amount so embezzled. . .

such person shall be fined not more than $1.000 or imprisoned

These provisions are amendments to the criminal code and
are effective immediately upon enactment.
