HomeMy WebLinkAbout2908 ORDINANCE NO. -:t.?/fIY 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE SECOND DAY OF JULY, 1968, PERTAINING TO THE 3 ANNEXATION OF A DISTRICT CALLED "ANNEXATION DISTRICT NO. 203". (LAFC No. 504) 1 4 WHEREAS, by Resolution, the mayor and Common Council of the City 5 of San Bernardino declared its intention to call a special election to be 6 held in certain inhabited territory contiguous to said City, proposed to be 7 annexed to said City, for the purpose of submitting to the qualified electors 8 residing in said territory the question whether or not said territory shall 9 be annexed to said City; and 10 WHEREAS, a copy of said Resolution was published as required by 11 law; and 12 WHEREAS, at a time not later than the hour set by said Resolution 13 for hearing objections to the proposed election, no written protests were 14 made by the owners of one-half of the value of the territory proposed to be 15 annexed, as shown by the last equalized assessment roll of the property 16 within the territory proposed to be annexed; and 17 WHEREAS, thereafter on the 6th day of May, 1968, Resolution 18 No. 9169 was adopted by the Mayor and Common Council declaring that a majority 19 protest has not been presented; and 20 WHEREAS, all proceedings have been had in accordance with said 21 Resolution and the Annexation Act of 1913, reference thereto hereby being 22 made for further particulars. 23 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 24 SAN BERNARDINO DO ORDAIN AS FOLLOWS: 25 SECTION ONE: A special election hereby is called, to be held on 26 the 2nd day of July, 1968, in the territory hereinafter described and 27 proposed to be annexed to the City of San Bernardino, for the purpose of 28 submitting to the qualified electors residing in said territory the question 29 whether or not such territory shall be annexed to, incorporated in and made 30 a part of the City of San Bernardino, and whether or not the property in 31 said territory shall after such annexation be subject to taxation equally 32 with the property within the City of San Bernardino to pay the entire bonded . . 10 11 12 13 14 15 16 17 18 1 indebtedness of the City of San Bernardino outstanding at the date of the 2 first publication of the notice of election for annexation. 3 Said territory is described as follows: 4 That portion of Lot 3, Block 8, Orange Grove Tract as per plat thereof recorded in Book 11 of Maps, page 14, records 5 of the County Recorder of San Bernardino County, State of California, described as follows: 6 7 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the Northeast corner of the South 654.63 feet of said Lot 3, Block 8, said point being also the Northeast corner of that certain parcel described in deed to Del Rosa Plaza Company, a partnership, recorded July 19, 1963, Document No. 196 in Book.595l, Page 558, Official Records of said County; thence Southerly along the East line of said Del Rosa Plaza Company property (also being the east line of said Lot 3) a distance of 654.63 feet to the Southeast corner thereof; thence Westerly along the South line of said Del Rosa Plaza Company property (also being the south line of said Lot 3) a distance of 440.42 feet to the Southwest corner thereof; thence Northerly along the West line of said Del Rosa Plaza Company property (also being the west line of said Lot 3) a distance of 653.53 feet to the Northwest corner thereof, said point being on the present corporate limits of said City; thence easterly along said City limit line a distance of 440.08 feet to the point of beginning. 8 9 Containing 6.55 acres, more or less. SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at 19 said election shall be opened at 7 o'clock A. M. of the day herein fixed for 20 the holding of said election, and shall be kept open until 8 o'clock P. M. 21 of the same day, when the polls shall be closed. 22 SECTION THREE: BALLOTS. Upon the ballots to be used at said 23 election there shall be printed the words: 24 SHALL ANNEXATION DISTRICT NO. 203 BE ANNEXED TO. INCORPORATED IN 25 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH 26 TERRITORY BE. AFTER SUCH ANNEXATION. SUBJECT TO TAXATION EQUALLY WITH THE 27 PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, 28 BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF 29 SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE 30 NOTICE OF ELECTION FOR ANNEXATION? 31 Opposite these words there shall be printed the words "YES" and 32 ''NO'', and to the right of each of these last two words, there shall be a . - 2 - 1 voting square. If an elector shall stamp a cross (+) in the voting square 2 after the printed word "YES", the vote of such elector shall be counted in 3 favor of the annexation of said territory to the City of San Bernardino, and 4 if an elector shall stamp a cross (+) in the voting square after the printed 5 word "NO", the vote of such elector shall be counted against such annexation. 6 In all particulars not herein recited, said election shall be held 7 in conformity as near as may be with the laws of the State of California 8 concerning general elections and with said Annexation Act of 1913. 9 SECTION FOUR: For purpose of said election there hereby is 10 established in the territory described herein one (1) consolidated voting 11 precinct which shall include all of said territory.
