HomeMy WebLinkAbout2889 1 ORDINANCE NO. Y?,f'y I 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 198. (LAFC No. 540) 3 4 WHEREAS, heretofore, a petition was filed with the Common Council 5 of the City of San Bernardino requesting that certain uninhabited territory 6 contiguous to said City be annexed to the City of San Bernardino, and which 7 said petition described said territory and the boundaries thereof proposed 8 to be annexed to the City; and 9 WHEREAS, said petition was filed by the owners of not less than 10 one~fourth of the area of land in such territory, and representing not less 11 than one-fourth of the assessed value of such territory according to the 12 last preceding equalized assessment roll of the County of San Bernardino, in 13 which said County the City of San Bernardino is situated; and 14 WHEREAS, said petition requested the said territory to be annexed 15 to and included in the said municipal corporation in accordance with the 16 provisions of the Government Code, Section 35300, et seq.; and 17 WHEREAS, on the 22nd day of January, 1968, a Resolution was adopted 18 by the aforesaid Common Council of the City of San Bernardino, California, 19 proposing the annexation of the aforesaid uninhabited territory and that said 20 Resolution provided therein that the proposed annexation should be generally 21 known and identified as Annexation District No. 198; and 22 WHEREAS, said Resolution set forth therein that all the property . 23 included in the aforesaid territory should be taxed equally with the other 24 property within the said City to pay the bonded indebtedness and any and all 25 general indebtedness and liability of the City of San Bernardino contracted 26 prior to or existing or outstanding at the time of the aforesaid proposed 27 annexation of the aforesaid property as provided in the hereinbefore mentioned 28 Government Code; and 29 WHEREAS, said Resolution did fix, determine and declare that a 30 hearing be held on the 4th day of March, 1968, at the hour of 9:30 o'clock 31 A. M. in the Council Chambers of the City Hall in the City of San Bernardino, 32 and the same was the day, hour and place designated where any person owning . 1 real estate within such territory so proposed to be annexed and having any 2 objections to the proposed annexation might object before the Common Council 3 and show cause why such territory should not be annexed, and, furthermore, 4 the said Resolution provided that at any time not later than the said hour 5 set, as mentioned hereinbfore for the said hearing, any owner of property 6 within the said territory proposed to be annexed might file written protest 7 with the City of San Bernardino against such annexation; and 8 WHEREAS, no written protests of any kind or nature whatsoever were 9 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock 10 A. M. on the 4th day of March, 1968, and thereafter on the 4th day of 11 March, 1968, Resolution No. 9084 was adopted by the Mayor and Common Council 12 declaring that a majority protest has not been presented; and 13 WHEREAS, it appears to the Common Council of the City of San 14 Bernardino that the aforesaid annexation proceedings have been completed and 15 everything performed at this time in accordance with said Government Code, 16 as mentioned hereinbefore, and any and all other laws in any was connected 17 with the said annexation procedure having been complied with; and 18 WHEREAS, the Common Council of the City of San Bernardino desire 19 to approve at this time the annexation of the aforesaid territory. 20 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF 21 SAN BERNARDINO 00 ORDAIN AS FOLLOWS: 22 SECTION ONE: That said territory herein described as Annexation 23 District No. 198 is hereby annexed and incorporated in and made a part of 24 the City of San Bernardino. 25 SECTION TWO: The territory herein referred to as being annexed to 26 the City of San Bernardino is particularly described as follows, to wit: 27 That portion of Lots 3 and 4, Block 62, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2, 28 records of the County Recorder of San Bernardino County, State of California, described as follows: 29 31 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being 41.25 feet South of the intersection of the center lines of Sterling Avenue and East Third Street; thence Northerly along the center line of Sterling Avenue to the intersection with the center lines of Sterling Avenue and East Sixth Street; thence 30 32 . - 2 - 1 Easterly along the center line of East Sixth Street a distance of 1985.45 feet more or less to its intersection with the East line of the West one-half of said Lot 3; thence Southerly along the East line of the West one-half of said Lot 3 and its Southerly prolongation to the South line of East Third Street; thence Westerly along the South line of East Third Street to the point of beginning. 2 3 4 5 Containing 59.25 acres, more or less. 6 SECTION THREE: That the above described property will be subject 7 to taxation equally with the property within such municipal corporation to 8 pay its proportion of the following bonded indebtedness of the City of 9 San Bernardino, which said bonded indebtedness was outstanding or theretofore 10 authorized and is outstanding at the time of said annexation, to wit: 11 A bonded indebtedness of $490,000.00 incurred for the acquisition 12 and construction of a public library, including additions to and enlargements 13 of the public library system of said City, the outstanding indebtedness thereon 14 being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% and 15 3 1/2% per annum; 16 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 17 and construction of additions to, relocations of and replacements of the 18 fire fighting system of said City, the outstanding indebtedness thereon being 19 $910,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and 20 2.9% per annum. 21 SECTION FOUR: The property herein 'annexed ',is ,dee1al:1ed-tobe a part 22 of Ward 1 and the boundaries of Ward 1 are hereby altered to include said 23 annexed territory, with zoning classifications as shown on a map titled 24 "Exhibit A-, on file in the office of the City Clerk, consisting of portions 25 of Lots 3 and 4, Block 62, Rancho San Bernardino, described as follows: 26 R-3-2000 Multiple Family Residential District 27 That portion of Lots 3 and 4, Block 62, Rancho San Bernardino described as follows: 28 29 Beginning at the Southeast corner of East Sixth Street and Sterling Avenue; said corner being the Point of Beginning; thence Easterly along the South line of East Sixth Street 1944.25 feet more or less to its intersection with the East line of the West one-half of said Lot 3; thence Southerly along the East line of the West one-half of said Lot 3 to the North line of East Fifth Street; thence Westerly along the North line of East Fifth Street to the 30 31 32 . - 3 - 1 East line of Sterling Avenue; thence Northerly along the East line of Sterling Avenue to the Point of Beginning. 2 3 M-1A Limited LiRht ManufacturinR Industrial District 4 That portion of Lots 3 and 4, Block 62, Rancho San Bernardino described as follows: 5 Beginning at the Southeast corner of East Fifth Street and Sterling Avenue; said corner being the Point of Beginning; thence Easterly along the South line of East Fifth Street 1944.25 feet more or less to its intersection with the East line of the West one-half of said Lot 3; thence Southerly along the East line of the West one-half of said Lot 3 to the North line of East Third Street; thence Westerly along the North line of East Third Street to the East line of Sterling Avenue; thence Northerly along the East line of Sterling Avenue to the Point of Beginning. 6 7 8 9 10 11 SECTION FIVE: The City Clerk shall certify to the passage of this 12 Ordinance and shall cause the same to be published three consecutive times, , 13 exclusive of holidays, in the San Bernardino Evening Telegram, a daily 14 newspaper designated for that purpose. 15 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 16 the Mayor and Common Council of the City of San Bernardino at an adjourned regular meeting thereof, held on the ~~~ day of ~J~~ 1968, by the following vote, to wit: , 17 18 19 counci1men,'~ ~, '7l;~-~", .
