2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 1991 KNOWN AS THE "lAND USE ZONING ORDINANCE"; AND MODIFYING
3 PROVISIONS THEREOF REIATING TO STREETS, PRIVATE ROADS AND THE
ISSUANCE OF BUILDING PERMITS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION ONE: Ordinance Noo199l Section Twenty Sub-section
7 20.2 A. is hereby amended to read as follows:

"A" No building permit shall be issued for a building or
9 structure on a lot which does not have access on a dedicated and
10 improved street or on a private road acceptable to the Planning
11 Commission and the City Engineer,,"

SECTION TWO: Ordinance No. 1991 Section Twenty Sub-section
13 20,,2 Eo 1. is hereby amended t~ read as follows:
14 "E.

10 No building shall be erected or enlarged by more than
16 25% on, or moved to, any lot in any zoning district, except the
17 "R-l" and "R-2" districts, if such lot abuts or adjoins a street
18 designated as an arterial or collector street in the Select System
19 of City Streets, if such street is deemed deficient in the
~ quadrennial report prepared pursuant to Section 2156 of the Street
21 and Highways Code, unless that half of the street located on the
22 same side as such adjoining lot has first been dedicated and
23 improved on the entire adjoining f~ontage or side of the lot so
~ as to comply with the standards for such street as set forth in
25 Section 186.8 of the Streets and Highways Code and the official
26 standards as approved by the City Engineer. Such dedication and

improvement shall not be required in the event the erection or
enlargement of the building is on a lot or lots which has an
adjoining frontage or side of less than 100 feet unless the
erection or enlargement of the building is on a corner lot or
lots on arterial or collector streets in the Select System or on
a lot or lots adjacent to or adjoining property on such streets
which have been previously dedicated and improved pursuant

1 to a street widening project.."

SECnoN THREE: Ordinance No.. 1991 Section Twenty Sub-section
3 20.2 E. 5 is hereby amended to read as follows:
4 "E.

50 The owner, developer or applicant for the building
6 permit shall pay all costs of said dedication and improvement,
7 including any cost for the removal or relocation of utilities,
8 including traffic signals and street lighting, and of preparation
9 of plans and blueprints."
