2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 166.

WHEREAS, heretofore, proceedings were initiated by the Common
5
Council of the City of San Bernardino, on its own motion, to annex to the
6
City of San Bernardino certain contiguous uninhabited territory hereinafter
7
described; and
8
WHEREAS, on the 14th day of September, 1964, a resolution was
9
adopted by the aforesaid Common Council of the City of San Bernardino,
California, declaring that proceedings had been initiated by said Council,
11
and proposing the annexation, for the reasons therein stated, of the
aforementioned uninhabited territory to the City of San Bernardino, and that
said resolution provided that the proposed annexation should be generally
known and identified as Annexation District No. 166; and
WHEREAS, said resolution set forth therein that all the property

included in the aforesaid territory should be taxed equally with the other
17
property within the said City to pay the bonded indebtedness and any and all
18
general indebtedness and liability of the City of San Bernardino contracted
19
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, said resolution did fix, determine and declare that a
hearing be held on the 26th day of October, 1964, at the hour of 9:30 A. M.
in the Council Chambers of the City Hall in the City of San Bernardino, and
the same was the day, hour and place designated whece any person owning real
estate within such territory so proposed to be annexed and having any
objections to the proposed annexation might object before the Common Council
and show cause why such territory should not be annexed; and, furthermore,
the said resolution provided that at any time not later than the said hour
set, as mentioned hereinbefore for the said hearing, any owner of property
within the said territory proposed to be annexed might file written protest
w~th the City of San Bernardino against such annexation; and
1 WHEREAS, there was one written protest filed with the City Clerk of
2 the City of San Bernardino prior to 9:30 o'clock A. M. on the 26th day of'
3 October, 1964; and
4 WHEREAS, on the 26th day of October, 1964, the date set for the
5 hearing of protests against the proposed annexation, Resolution No. 7420 was
6 adopted by the Common Council of the City of San Bernardino declaring that a
7 majority of protests has not been presented; and
8 WHEREAS, it appears to the Common Council of the City of San
9 Bernardino that the aforesaid annexation proceedings have been completed and
10 everything performed at this time in accordance with said Government Code,
11 as mentioned hereinbefore, and any and all other laws in any way connected
12 with the said annexation procedure having been complied with; and
13 WHEREAS, the Common Council of the City of San Bernardino desire
14 to approve at this time the annexation of the aforesaid territory.
15 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
16 DOES HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
18 District No. 166 is hereby annexed and incorporated in and made a part of the
19 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
21 the City of San Bernardino is particularly described as follows, to wit:
22 That portion of Wiggins tract as per plat thereof recorded
in Book 3 of Maps, Page 74, Records of the County Recorder,
23 San Bernardino County, State of California and that portion
of Sections 8, 16 and 17, Township 1 North, Range 4 West,
24 San Bernardino Base and Meridian if said Section lines were
extended across the Muscupiabe Rancho as per plat thereof
25 recorded in Book 7 of Maps, Page 23, records of said County;
that portion of Tract 3177 as per plat thereof recorded in
26 Book 45 of Maps, Pages 59 and 60, records of said County
and that portion of Tract 3485 as per plat thereof recorded
27 in Book 45 of Maps, Page 82, Records of said County,
described as follows; ': ..

Beginning at a point, isaid point ,being the North-w.est:.<;orner of LoLl,
Block 2 of said Wiggins Tract; thence along the Corporate
limits of the City of San Bernardino, the following
bearing and distances; thence West along the North line
of Lot 2 of said Block 2 to an angle point on said City
Limit Line; thence North 2l~ 48' West, 1608.01 feet;
thence Southeasterly in a straight line to a point that
is 462.96 feet North of the North line of "A" Street

(also known as 42nd Street), said point being in the East
line of Western Avenue; thence South along said East line of
Western Avenue to the South line of said "A" Street; thence
West along said South line to the West line of said Section
16; thence Southerly along said West line of Section 16 and
said City Limit Line and then leaving the present Corporate
Limits of said City to the center line of Kendall Drive;
thence Northwesterly along said centerline of Kendall Drive
to the intersection with the Northeasterly prolongation of
the Southeasterly line of Lot 5 of said Tract 3177; thence
Southwesterly along said Northeasterly prolongation and
the Southeasterly line of said Lot 5 arid the Southeasterly
line of Lots 2 and 3 of said Tract 3485 and the Southwesterly
prolongation thereof to the center line of Sheridan Road as
delineated on the map of said Tract 3485; thence Westerly
along said center line to the intersection with the center
line of that certain 60.00 foot road, known as State Street
as conveyed to the San Bernardino County Flood Control
District by deed recorded February 25, 1945 in Book 1735,
Page 358, Official Records of said County; thence Northerly
along said center line of State Street to the intersection
with the center line of said Kendall Drive; thence North-
westerly along said center line of Kendall Drive to the
East line of Section 18, Township 1 North, Range 4 West,
San Bernardino Base and Meridian; thence Northerly along
said East line, 190.00 feet more or less to the Southwest
corner of Lot 2, Block 3 of said Wiggins Tract, said point
also being on the present Corporate Limits of said City;
thence Easterly along said City Limit Line to the Southeast
corner of Lot 2, Block 2 of said Wiggins Tract; thence
North along said City Limit Line to the point of beginning.

SECTION THREE: That the above described property will be subject to
18
taxation equally with the property within such municipal corporation to pay
19
its proportion of the following bonded indebtedness of the City of San
20
Bernardino, which said bonded indebtedness was outstanding or theretofore
21
authorized and is outstanding at the time of said annexation, to wit:
22
A bonded indebtedness of $490,000.00 incurred for the acquisition
23
and construction of a public librarY, including additions to and enlargements
24
of the public library system of said City, the outstanding indebtedness
25
thereon being $390,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
26
and 3 1/2% per annum;
27
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
28
and construction of additions to, relocations of and replacements of the fire
29
fighting system of said City, the outstanding indebtedness thereon being
30
$1,045,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4% and
31 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part

1 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
2 annexed territory; and said property is placed and declared to be in R-l
3 Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this

Ordinance and shall cause the same to be published three consecutive times,
6
exclusive of holidays, in the San Bernardino Evening Telegram, a daily
7
newspaper designated for that purpose.

I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
9
the Mayor and Common Council of -the City of San Bernardino at an adjourned
10
regular meeting thereof, held on the ~
