RESOLUTION NO. 83-399
RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO,
APPROVING THE INCREASE BY THE CITY
OF ITS "CITY OF SAN BERNARDINO INDUS-
TRIAL DEVELOPMENT REVENUE NOTE, TRI-
CITY INDUSTRIAL PARK, LTD. PROJECT,
1981 SERIES (CONSTRUCTION LOAN)" AND
MAKING CERTAIN DETERMINATIONS RELATING
THERETO (TEFRA)
(TRI-CITY PROJECT)
WHEREAS, pursuant to Ordinance No. 3815 (the "Law") .
the City is financing, in phases, certain industrial build-
ings at a site located on 15 acres of industrial zoned land
fronting on Cooley Avenue in the Southeast Industrial Park
in San 3ernardino, California (the "Project"); and
17 WHEREAS, the City has taken proveedings resulting
18 in the issuance and sale of its "City of San Bernardino
19 Industrial Development Revenue Note, Tri-City Industrial
20 Park, Ltd. Project, 1981 Series (Construction Loan) the
21 ("Note")", to obtain moneys to finance the Project, all
22 under and in accordance with said Ordinance No. 3815, the
23 Constitution and laws of the State of California; and
24 WHEREAS, completion of the Project requiers an
25 increase in the amount of the Note; and

1 WHEREAS, pursuant to the Tax Equity and Fiscal
2 Responsibility Act of 1982, the increase of the Note must
3 be approved by an elected representative of the City after
4 a public hearing; and
5 WHEREAS, the City Clerk has caused notice of such
6 public hearing to be published once a week for two weeks
7 (giving at least fourteen days' notice) in The Sun and has
8 reported to the Mayor and Common Council that such notice
9 has been duly and regularly given; and
10 WHEREAS, the subject matter of the Hearing was the
11 proposed increase b7 the City of the Note in an amount of
12 not to exceed $75,000; and
13 WHEREAS, at the time and place stated in said
14 Notice, the proposed increase of the Note was presented, and
15 any and all persons who so desired appeared and were heard,
16 and the Mayor and Common Council are fully informed in the
17 premises.
18 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF
19 THE CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY RESOLVE,
20 DETERMINE AND ORDER AS FOLLOWS:

Section 1. The above recitals are true and correct
2 in all respects; and all actions heretofore taken by or at
3 th~ direction of the City and its officers directed toward
4 the increase of the Note therefor are hereby approved and
5 ratified.

Section 2. The increase by the City of its "City
7 of San Bernardino Industrial Development Revenue Note, Tri-
r
8 City Industrial Park, Ltd. Project, 1981 Series (Construction
9 Loan)" in an amount not to exceed $75,000 is hereby approved
10 and the Mayor is hereby authorized and directed to execute
11 this Resolution pursuant to said Tax Equity and Fiscal
12 Responsibility Act of 1982.

Section 3. Effective Date. This Resolution shall
14 take effect upon adoption.
