The Mayor of the City of San Bernardino is hereby 8 authorized and directed to execute on behalf of said City a Second 9 Amendment to Agreement with Fleming & Associates, providing for a 10 one year extension of the term and change in consultant's 11 compensation, a copy of which is attached hereto, marked Exhibit 12 "A" and incdrporated herein by reference as fully as though set 13 forth at length. 141 HEREBY CERTIFY that the foregoing resolution was duly 15 adopted by the Mayor and Common Council of the City of San 16 Bernardino-at a reqular meeting thereof, held 17 on the 7th day of November , 1983, by the following 18 vote, to wit: 19 AYES: Council Members Castaneda. City and Consultant agree as follows: 1. Recitals. (a) City and Consultant entered into an agreement on . AU9ust 14, 1981, relating to the administration of City's legally uninsured program for its employees pursuant to the workers' compensation laws of the State of California, and of its self- insurance program for general claims liability against City. (b) On July 9, 1982, City and Consultant entered into a 'First Amendment to Agreement changing Consultant's total compensation and extending the agreement for an additional one year period. (c) The parties now desire to amend the agreement dated August 14, 1981, to provide for an additional one year extension of the term and to effect a change in Consultant's compensation from $5.00 for each claim to $8.00 for each claim. 2. Term. The term of the agreement is extended for an additional period of one year commencing July 1, 1983, and terminating June 30, 1984, unless sooner terminated as provided in the agreement dated August 14, 1981. 3. R~pOrt Expense. Paragraph 4(b) of the agreement of August 14, 1981, is amended to read: "Additional Compensation. Other Provisions.
