AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, APPROVING THE ANNEXATION OF DISTRICT NO. 133.
WHEREAS, heretofore, a petition was filed with the Common Council of
the City of San Bernardino requesting that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino, and which
said petition described said territory and the boundaries thereof proposed to
be annexed to the City; and
WHEREAS, said petition was filed by the owner of not less than one-
fourth of the area of land in such territory and representing not less than
one-fourth of the assessed value of such territory according to the last preceding
equali~ed assessment roll of the County of San Bernardino, in which said County
the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed to
and included in the said municipal corporation in accordance with the provisions
of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 27th day of March, 1961, a resolution was adopted by
the aforesaid Common Council of the-City of San Bernardino, California, proposing
the annexation of the afores~i4 uninhabited territory, to be generally known as .
ANNEXATION DISTRICT NO. 133, to the city of ,$,ap. Bernardino, and that said reso-
lution provided therein that the prop()~e4,anne~ation should be generally known
and identified as ANNEXATrONllrSTRICT NO. 133;- and
WHEREAS, sa.id resolution set. fonh therein that all the property in-
cluded within the afor~sa.Dd territory should be.taxed'aqually with the other
property within the said City to pay the bonded indebtedness, . and any and all
general indebtedness a.nd liability of the City of San Bernardino, contracted
prior to or existing or outstanding attbe time of the aforesaid proposed
annexation of the aforesaid property as proVided in the hereinbefore mentioned
Government Code; and
WHEREAS, said resolution did fix, determine and declare that a hearing
be held on the 1st day of May, 1961, at the hour of 9:30 o'clock A. M. in the
Council Chambers of the City Hall in the City of San Bernardino, and the same

1 was the day, hour and place designated where any person owning real estate within
2 such territory so proposed to be annexed and having any objections to the pro-
3 posed annexation migh~ appear before the Common Council and show cause why such
4 territory should not be annexed; and furthermore, the said resolution provided
5 that at any time not later than'the said hour set, as mentioned hereinbefore
6 for the said hearing;' 'any owner of property within the said territory proposed
7 to be annexed might file written protest with the City of San Bernardino against
8 such annexation; 'and
9 WHEREAS, no written protest of any kind or nature whatsoever were
10 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
11 A. M. on the 1st day of May, 1961; and
12 WHEREAS, it appears to the Common Council of the City of San Bernardino
13 that the aforesaid annexation proceedings have been completed and everything
14 performed at this time in accordance with said Government Code, as mentioned
15 hereinbefore, and any and all other laws in any way connected with. the said
16 annexation procedure having been complied with; and
17 WHEREAS, the Common Council of the City of San Bernardino desire to
18 approve at this time the annexation of the aforesaid territory.
19 NOW, THEREFORE, THE COMMON COUNOIL OF THE CITY OF SAN BERNARDINO JjQES
20 HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
22 District No. 133 is hereby annexed and incorporated in and made apart o~the
23 City of San Bernardino,

SECTION TWO: The territory herein referred to as being annexed to
25

the City of San Bernardino is particularly described as follows, to wit:
Lots 4 and 7 , Tract No. 5065 and a portion of Mountain Avenne
as shown on the plat recorded in Book 63 of Maps, Page 5,
Records of the Oounty Recorder of San Bernardino County, State
of California described as follows:

Commencing at a point on the present corporate limits of the
Oityof San Bernardino, said point also being the intersection
of the Easterly prolongation of. the l'Iortber1y line of said
Lot 4 with the East line af MouhtainAvenue,60.00 feet wide;
thence westerly along said Easterly prolongation and the North
line of said Lot 4 and tot 7 of said Tract' to the Northwest
co..ner af said Lot 7" said Northwest corrierbeing on the East
line of Fairfax J;lrive, as delineated On the map of said Tract;

thence Southerly along said East line to the Southwest corner
of said Lot 7; thence Easterly along the South line of said
Lots 7 and 4 and the Easterly prolongation of said South line
of Lot 4, to the intersection with the East line of Mountain
Avenue, said East line also being the present corporate limits
of the City of San Bernardino; thence Northerly along said
East line to the point of beginning.

SECTION THREE: That the above described property will be subject to
6 taxation equally with the property within such municipal corporation to pay its
7 proportion of the following bonded indebtedness of the City of San Bernardino,
8 which said bonded indebtedness was outstanding or theretofore authorized and is
9 outstanding at the time of said annexation, to wit:
10 A bonded indebtedness of $200,000.00 incurred for the construction and
11 completion of a convention hall, the outstanding indebtedness thereon being
12 $5,000.00, bearing interest at the rate of 5% per annum;
13 A bonded indebtedness of $275,000.00 incurred for the acquisition and
14 ,'construction of water works, including "DeVil Canyon Water Works", water rights,
15 rights of way; pipe line~, wells and pumpi~ plailts, the outstanding indebtedness
16 thereon being .$27,500.00, bearing interest at the rate of 5% per annum;
17 A bonded indebtedness of $490,000.00 incurred for the acquisition and
18 COnstruction of a public' library, including additions to and enlargements of the
19 public library system of said City~ the6utstanding indebtedness thereon being
20 $450,000.00, bearin~ irit:dest :!It the.rariMl of4 3f41., 31/4% and 3 1/2% per annum.

S~CTION FOUR: The property herein annexed is declared to be a part of
22 Ward 4 and. the boundaries of Ward 4 are hereby altered to include said annexed
23 territory; and said property is placed and declared to be in R-l, Single Family
24 tles.idential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
26
ordinance lind 'shall cause the same to be published three consecutive times,
27
exclusive of holidays, in the San Bernardino ~venit\g Telegram, a daily newspaper
28
designated for that purpose.
