Description: Construct Accessibility Improvements at Various Locations Finance: Council Notes: 7/'-/01 Agenda Item No. /5 e e e CITY OF SAN BERNARDINO REOUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution awarding a contract to Grand Pacific Contractors, Inc. for Construction of ADA Access Ramps and Sidewalk at Various Locations, Phase VII - 2005/06 (SS-B), per Project Plan No. 11501. Background: On August 7, 2006, the Mayor and Common Council allocated funds, as part of the FY 2006/07 Capital Improvement Program (CIP) for "Construct Accessibility Improvements at Various Locations" (SS-B). This project consists of the following: 1. Removal of existing curbs, gutters, spandrels, roadway improvements. 2. Construction of ADA ramps, sidewalk and spandrels. 3. Replacement of existing roadway improvements. The plans and specifications for this project were completed and the project was opened to public bidding on May 15, 2007. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Bid Board, High Desert Plan Room, San Diego Daily Transcript, Sub-Hub Online Plan Room, Reed Construction Data, Bid America Online, Construction Bid Source, Bid Ocean, the City's web sites, and with the San Bernardino Area Chamber of Commerce. FOR CONSTRUCTION OF ADA ACCESS RAMPS AND SIDEWALKS AT VARIOUS LOCATIONS (PHASE VII) - 2005/06 (SS-B), PER PROJECT PLAN NO. 11501. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Grand Pacific Contractors, Inc., 11405 Geyser Drive, Mira Lorna, CA 91752, is the lowest responsible bidder for construction of ADA access ramps and sidewalks at various locations (Phase VII) - 2005/06 (55-B), per Project Plan No. 11501. A contract is awarded accordingly to said bidder in a total amount of $256,327.00, with a contingency amount of $40,223.00, but such award shall be effective only upon being fully executed by both parties. All other bids, therefore, are hereby rejected. The City Manager is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3.
