Staff Report
SUBJECT:
Resolution authorizing agreement between the City of San Bernardino and Little League
Baseball, Inc. for civic and promotion funding in the amount of $5,000 from the FY 07/08
budget to assist with the conduct of their Western Regional tournament on August 3-12, 2007.
The organization is also requesting a waiver of applicable departmental fees in connection with
the event.
BACKGROUND:
James Gerstenslager, Western Regional Director, is requesting financial assistance from the FY
07/08 civic and promotion fund in the amount of$5,000 to aid in the conduct of their 2007
tournament scheduled for August 3-12, 2007. They are also requesting a waiver of fees for
department personnel and equipment connected with the event. These fees are as follows:

Attached for your review is a letter to the City dated June 6, 2007 and a completed Request for
Funding Assistance including a proposed budget and anticipated revenue from other sources.
Last year, the Mayor and Council approved $5,000 in civic and promotion funding to support the
activity with a similar waiver of fees. Attached is the organization's accounting of those funds.
FINANCIAL IMPACT:
Included in the FY07/08 budget is $153,500 (Acct. #001-091-5186) in civic and promotion funds
which are traditionally used to support events of common interest to the community. Attached is
a matrix illustrating FY06/07 funding activity.
RECOMMENDATION:
1. Adopt resolution.
2. That direct funding in the amount of$5,000 be approved; that indirect funding in the
amount of$38,396 be transferred from the FY07/08 civic and promotion fund to various
City departmental accounts as listed in the attached staff report; and that a waiver of fees
and use of City personnel and equipment be authorized to assist in the 2007 Western
Regional Little League tournament.

OF SAN BERNARDINO AUTHORIZING AN AGREEMENT WITH THE CITY OF
SAN BERNARDINO AND WESTERN REGIONAL LITTLE LEAGUE BASEBALL
FOR FINANCIAL ASSISTANCE FROM THE CIVIC AND PROMOTION FUND FOR
FY 2007/08.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The City Manager of the City of San Bernardino is hereby authorized
and directed to execute on behalf of said City an Agreement with San Bernardino Western
Regional Little League Baseball, Inc., for civic and promotion funding in the amount of$5,000
in direct funding from the FY 2007/08 Budget, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as though set forth at length.
Section 2.
Expenditure of indirect funding in the amount of $38,396 is further
authorized to be transferred from the civic and promotion fund to various general fund
departmental accounts as noted in the staff report included as Attachment "B".
Section 2.
The authorization to execute the above referenced agreement IS
rescinded if the parties to the agreement fail to execute it within sixty (60) days of the adoption
of this resolution.

Civic and Promotion Funding
The parties agree to as follows:
1. Recitals.
A. Organization has requested financial assistance from City for the
Fiscal year 2007/2008 in order to assist in defraying the expenses connected with the conduct of
events related to a baseball tournament on August 3-12, 2007, as outlined in the Request for
Funding Assistance and letter.to the City, dated June 6, 2007 copies of which are attached hereto
marked Attachment "A". The terms of the request are incorporated herein by reference and shall
govern the uses of the funds provided herein. The financial assistance provided for in this
Agreement is made on a one-time basis, and receipt of said funds shall not imply a continuing
obligation of the City beyond the terms of this Agreement.
B. The expenditure is for a valid municipal public purpose, to wit: for the
conduct of events related to their annual Little League baseball tournament.
2. Payment.
Upon presentation of a claim to the City Finance Director, City shall pay to Little League
Baseball, Inc., Western Regional Headquarters, on behalf of Organization from the civic and
promotion budget for the 2007/08 fiscal year, the total sum of FIVE THOUSAND DOLLARS

3. Use of Funds.
The funds paid on behalf of Organization shall be used solely for the purposes set
forth in Paragraph I above. No deviation from these provisions shall be made without the
express approval of the City of San Bernardino. Any unexpended funds shall be returned to the

Accountability.

fees), suits, or losses, however occurring, or damages arising or growing oui of the use or

4 receipt of the funds paid hereunder and all operations under this Agreement.
Payments
5 hereunder are made with the understanding that the City is not involved in the performance of
6 services or other activities of Organization. The costs, salary and expenses of the City Attorney
7 and members of his office in enforcing this Agreement on behalf of the City shall be considered
8

as "attorney fees" for the purposes of this paragraph.
6. Insurance.

While not restricting or limiting the foregoing, during the term of this
11
12 Agreement, Organization shall maintain in effect policies of comprehensive public, general and
13 automobile liability insurance, in the amount of $1 ,000,000, per occurrence combined single
14 limit, naming the City of San Bernardino, its departments, agencies, boards, commissions,
15
elected officials, officers, attorneys, employees, and agents as additionally insured. A certificate
16

of insurance evidencing such coverage shall be provided to the Mayor or his designee, with the
added notation that the insurance policy shall not be terminated or materially altered without 10
days prior written notice to the City.
7.
Termination.
City shall have the right to terminate this Agreement and any funding
22 remaining unpaid hereunder at its sole discretion by mailing a ten-day written notice to

Organization and this Agreement shall terminate ten days after the mailing of such notice. In the
24
event this Agreement is terminated for reasons of improper use of funds or use of funds for any
25
26
purpose other than those authorized, any unexpended portion of the funds provided by City shall
27 be returned to City, and the Organization shall reimburse to City any funds expended which were

3 used for any purpose other than those authorized under this Agreement, as set forth in Exhibit

5 8. Authorization to Execute.
6 Organization hereby covenants that it has taken all actions necessary to
7 take the adherence to the obligations imposed by this Agreement a binding obligation of the

9. Notices.
All notices herein required shall be in writing and delivered in person or
12 sent by certified mail, postage prepaid, addressed as follows:

10. Entire Agreement.
This Agreement and any documents or instruments attached hereto or
referred to herein integrate all terms and conditions mentioned herein or incidental hereto, and
supersede all negotiations and prior writing in respect to the subject matter hereof. In the event
of conflict between the terms, conditions or provisions of this Agreement, and any such
document or instrument, the terms and conditions of this Agreement shall prevail.
In witness whereof, the parties hereto have executed this Agreement on the day and date

Dear Mayor Morris:
The 2007 Little League Baseball Western Regional Tournament is scheduled for Friday,
August 3, 2007 through Sunday, August 12,2007. Twelve Championship teams from the
11 states of the Little League Western Region will begin arriving on Wednesday, August
1,2007.
In past years, we have greatly appreciated the financial support from the San Bernardino
City Council. The financial support will again help defray the cost of the tournament. I
am respectfully requesting a grant of $5,000.00 for our 2007 event.
These funds will be used to offset costs associated with transporting teams to and from
the airport in rented buses and serving approximately 9000 meals for teams and
volunteers for the 10 day event.
Each year more that 200 players, managers and coaches come to San Bernardino to
compete for the opportunity to advance to the Little League Baseball World Series in
WiIliamsport, P A. We will again be sending two representatives from the Western
Region. Both championship games will be televised live on ESPN2 from AI Houghton
Stadium here at the Western Regional Headquarters. The West Division Championship
will be televised on August Illb and the Northwest Division Championship will be
televised live on August 1211J. We again anticipate between 50 and 60 thousand visitors
from throughout the eleven Western Region States. Their return is testimony to the warm
family welcome they receive from the City of San Bernardino.
We sincerely thank the City Council for the outstanding support we have received in the
past and hope that you will look favorably on this request. We ask that you again honor
us with your presence at some of the activities listed on the enclosed schedule.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
Staff Report
SUBJECT:
Resolution authorizing agreement between the City of San Bernardino and Little League
Baseball, Inc. for civic and promotion funding in the amount of$5,000 from the FY 07/08
budget to assist with the conduct of their Western Regional tournament on August 3-12, 2007.
The organization is also requesting a waiver of applicable departmental fees in connection with
the event.
BACKGROUND:
James Gerstenslager, Western Regional Director, is requesting financial assistance from the FY
07/08 civic and promotion fund in the amount of$5,000 to aid in the conduct of their 2007
tournament scheduled for August 3-12, 2007. They are also requesting a waiver of fees for
department personnel and equipment connected with the event. These fees are as follows:

Parks/Rec 800

Attached for your review is a letter to the City dated June 6, 2007 and a completed Request for
Funding Assistance including a proposed budget and anticipated revenue from other sources.
Last year, the Mayor and Council approved $5,000 in civic and promotion funding to support the
activity with a similar waiver of fees. Attached is the organization's accounting of those funds.
FINANCIAL IMPACT:
Included in the FY07/08 budget is $153,500 (Acct. #001-091-5186) in civic and promotion funds
which are traditionally used to support events of common interest to the community. Attached is
a matrix illustrating FY06/07 funding activity.
RECOMMENDATION:
1. Adopt resolution.
2. That direct funding in the amount of$5,000 be approved; that indirect funding in the
amount of$38,396 be transferred from the FY07/08 civic and promotion fund to various
City departmental accounts as listed in the attached staff report; and that a waiver of fees
and use of City personnel and equipment be authorized to assist in the 2007 Western
Regional Little League tournament.

The 2007 Western Regional Little League Baseball Tournament is right around the
comer. This tournament is for the 11 and 12 year old State Champions from eleven
Westem States including Hawaii and Alaska.

We are again asking for your assistance in assigning Police Personnel to help with crowd
control and security. Additionally, we are again asking for the support of the Reserve
Units. Their services in the past have been greatly appreciated as they have been most
helpful in monitoring our parking areas and grounds surrounding the Stadium Field.
Their uniformed presence has made a positive difference.
Opening Ceremonies and Tournament Play for this year's Western Regional Tournament
are scheduled to begin Friday, August 3, 2007 and continue through Sunday, August 12,
2007. I have enclosed a copy of our 2007 Regional Tournament Schedule for your
convenience.
Thank you for your continued support of the Little League Baseball Program and our
Western Regional Tournament. Your help is greatly appreciated. I extend a personal
welcome to you to attend some or all of the games, as your busy schedule will allow.

HOLD HARMLESS AND INDEMNIFICATION
LicenseeIPermittee shall protect, defend, indemnify and hold the City and its elective and
appointive boards, commissions, officers, agents, employees and servants free and
harmless from any and all losses, claims, liens, demands and causes of action of every
kind and character including, but not limited to, the amounts of judgments, penalties,
interests, court costs, legal fees, and all other expenses incurred by the City arising in
favor of any party, including claims, liens, debts, personal injuries, including employees
of the City, death or damages to property (including property ofthe City) and without
limitation by enumeration, all other claims or demands of every character occurring or in
any ways incident to, in connection with or arising directly or indirectly out of this
agreement. LicenseeIPermittee shall investigate, handle, respond to, provide defense for
and defend any such claims, demand, or suit at the sole expense ofthe Licensee/
Permittee. LicenseeIPermittee shall also bear all other costs and expenses related thereto,
even if the claim or claims alleged are groundless, false or fraudulent. This provision is
not intended to create any cause of action in favor of any third party against
LicenseeIPermittee or the City or to enlarge in any way the LicenseeIPermittee's liability
but is intended solely to provide for indemnification of the City from liability for damage
or injuries to third persons or property arising from LicenseelPermittee's performance
hereunder.

barricades, a Daihatsu electric cart, 6 additional dumpsters to include daily pick up and

relieve us of the tremendous amount of refuse that is left behind by the thousands of
spectators.
If this request is granted, we would like the items delivered to 6707 Little League Drive,
San Bernardino no later than Tuesday, July 3 1,2007. AIl items may be picked up
