Staff Report
Subject:
Resolution of the Mayor and Common Council of the City of San Bernardino establishing the
San Bernardino Ad Hoc Committee for the purpose of planning the celebration of the 200th
anniversary of the founding of San Bernardino.
Background:
At the June 18, 2007 meeting of the Mayor and Common Council, a discussion took place
relative to the proposed resolution establishing the San Bernardino Ad Hoc Committee for the
purpose of planning the celebration of the 200th anniversary of the founding of San Bernardino.
Staff was directed at that meeting to make the following changes to the Resolution: 1) increase
the number of appointments by each Council member to two each; and, 2) allow said Council
appointments to be "at large". This would change the number of members of the Ad Hoc
committee from twelve with two alternates to nineteen with two alternates.
Subsequent to the June 18th Council meeting, the Mayor had the opportunity to meet with Dr.
William Coleman, Chairman of the 1976 Bicentennial Commission. Dr. Coleman gave the
Mayor a brief recap of the accomplishments of the Commission from 1976, which included a
grand pageant and a Rose Parade float. The evolution of the Commission and its membership
was also discussed. When first established in March of 1972, the Commission was made up of
15 members appointed by the Mayor. As the need arose to establish additional working sub-
committees, the Commission returned to the Mayor and Common Council in January of 1974
requesting approval to expand to the Commission membership. Thus, the 1976 Commission
evolved over the years to thirty-one members.
Staff recommends that the initial San Bernardino Ad Hoc Committee for the purpose of planning
the celebration of the 200th anniversary of the founding of San Bernardino follow the same
formula as current Commissions, with one member appointed by each Council member and two
appointments and two alternates appointed by the Mayor. As the Ad Hoc Committee moves
forward in the planning process, the Committee can then return to the Mayor and Common
Council with recommendations for expansion of the committee membership.

8 Whereas, May 20, 2010 will mark the 200th anniversary of the date when Father Dumetz,
9 a Franciscan missionary, traveled from Mission San Gabriel to establish the first Spanish mission
10 in the valley and named the area "San Bernardino" after Saint Bernardine of Sienna, the patron
11 saint of the day on the Catholic calendar.
12 SECTION 1. Purpose. It is the desire of the Mayor and Common Council to establish
13
an Ad Hoc Committee for the purpose of celebrating the 2001h anniversary of the founding of
14
San Bernardino.

16 SECTION 2. Name of Committee/Members. The Committee formed for the purpose of
17 celebrating the 2001h anniversary of the founding of San Bernardino shall be called The San
18 Bernardino Bicentennial Ad Hoc Committee and shall consist of 19 members appointed "at-
19 large"by the Mayor and Common Council.
20 The Mayor shall nominate five members who shall serve during and for the term of the
21

5 replacement member at any time shall terminate the appointment of any member so replaced,
6 without need for formal removal action.
7 SECTION 3. Alternate Members. The Mayor shall nominate two alternate members who
8 shall serve during and for the term of the Mayor. Such alternate members may attend the
9
meetings of the Ad Hoc Committee and may participate in the discussions but shall not be
10
11 considered for the determination of a quorum, unless a quorum is not otherwise present. When a
12 quorum is not otherwise present, such alternate member or members shall be counted in the
13 determination of a quorum and may vote and have all other rights and responsibilities of a
14 member of the Ad Hoc Committee for that meeting. When any regular member of the Ad Hoc
15 Committee is not in attendance, but a quorum still exists, the most senior alternate member may
16 vote on any matter pending before the Ad Hoc Committee and shall have all other rights and
17
18 responsibilities of a member of the Ad Hoc Committee for that meeting. If two or more regular
19 members are not in attendance, then both alternate members may vote and have such rights and
20 responsibilities.
21 SECTION 4. Appointment of Members. Each member of the Ad Hoc Committee, after
22 having been nominated, shall be appointed by the Mayor, with the approval of the Common
23 Council. Each member shall be and remain a registered voter and each member of the Ad Hoc
24 Committee nominated by a Council member shall be and remain a resident of the City of San
25
26 Bernardino. Members shall serve, without compensation, at the pleasure of the Mayor and
27 Common Council. Any vacancy shall be filled and appointment shall be made in the manner
28 hereinbefore set forth as for an original appointment.

5 SECTION 5. Oath of Office. Prior to undertaking his or her duties as a member of the
6 Ad Hoc Committee, the member shall subscribe and file his or her official oath of office with the
7 City Clerk.
8 SECTION 6. Chairman — Meetings — Absences. The Ad Hoc Committee shall elect a
9
chairman and a vice-chairman from among its members, and the chairman and vice-chairman
10
11 shall serve for a term of one year. The Ad Hoc Committee shall meet not less than once a month
12 in the City Hall, San Bernardino, California, or such other place within the City as the Ad Hoc
13 Committee may select.
14 If a Committee member fails to attend three consecutive regular meetings without excuse
15 from the chairman, which excuse must be obtained before or within five calendar days after any
16 meeting date, he or she shall automatically cease to be a member of the Ad Hoc Committee and
17
the chairman shall notify the former member and the nominating official of the declared
18
19 vacancy. The vacant office shall be filled by nomination and appointment made in the manner of
20 the original appointment.
21 Meetings of the San Bernardino Bicentennial Ad Hoc Committee shall be open to the
22 public and shall be governed by the provisions of the Ralph M. Brown Act, Sections 54950.5, et
23 seq., California Government Code.

SECTION 7. Quorum. Any seven members in attendance at any meeting shall constitute
25
26 a quorum. Except for public hearings (which shall not be conducted without a quorum), the Ad
27 Hoc Committee may meet in the absence of a quorum as a committee of the whole, and

5 recommend actions and propose resolutions which, if ratified at a subsequent meeting of the
6 committee at which a quorum is present, shall constitute the official action of the Committee.
7 SECTION 8. Monthly. /Yearly Reports. The Committee is required to submit to the City
8 Manager a monthly report of its activities. The report to the City Manager is due on the 10th day
9
of each month, until such time as the Committee is disbanded. In addition, beginning with the
10
11 first Council meeting in January 2008, the Committee is required to submit an annual report to
12 the Mayor and Common Council noting its activities and plans for the celebration of the 2001h
13 anniversary of the founding of San Bernardino. Such annual reports will be submitted in
14 subsequent years at the first Council meeting in January until such time as the Ad Hoc
15 Committee is disbanded.
16 SECTION 9. Dissolution of the Committee. The San Bernardino Bicentennial Ad Hoc
17
18 Committee will exist until such time as the Mayor and Common Council formally disband the
Committee.

14 If a Committee member fails to attend three consecutive regular meetings without excuse
15 from the chairman, which excuse must be obtained within five calendar days before or after any
16 meeting date, he or she shall automatically cease to be a member of the Ad Hoc Committee and

19 vacancy. The vacant office shall be filled by nomination and appointment made in the manner of

21 Meetings of the San Bernardino Bicentennial Ad Hoc Committee shall be open to the

of each month, until such time as the Committee is disbanded. In addition, beginning with the

11 first Council meeting in January 2008, the Committee is required to submit an annual report to
12 the Mayor and Common Council noting its activities and plans for the celebration of the 200th
13 anniversary of the founding of San Bernardino. Such annual reports will be submitted in
14 subsequent years at the first Council meeting in January until such time as the Ad Hoc
15 Committee is disbanded.
16 SECTION 9. Dissolution of the Committee. The San Bernardino Bicentennial Ad Hoc

May 20, 2010 will mark the 200th anniversary of the date when Father Dumetz, a Franciscan
missionary, traveled from Mission San Gabriel to establish the first Spanish mission in the valley
and named the area"San Bernardino' after Saint Bernardine of Sienna, the patron saint of the
day on the Catholic calendar.
The San Bernardino Bicentennial Ad Hoc Committee will be established for planning the
celebration for the 200th anniversary of the founding of San Bernardino. The Committee shall
consists of 12 members, two of whom may be considered"at-large" and not subject to residency
requirement. The Mayor shall nominate five members and each Council member shall nominate
one member.

20 the residency requirement.

The Mayor shall nominate five members who shall serve during and for the

23 term of the Mayor. Each Council member shall nominate one member who shall
24 serve during and for the term of the nominating member. The terms of the
25 committee members shall coincide with the term of the nominating Council member
26 or the Mayor. If a vacancy occurs in the office of the Council member or the Mayor
27 who originally nominated any member, the applicable term of that member shall

4 continue until a successor has been appointed. Nomination and appointment of a
5 replacement member at any time shall terminate the appointment of any member so
6 replaced, without need for formal removal action.
7 SECTION 3. Alternate Members. The Mayor shall nominate two alternate
8 members who shall serve during and for the term of the Mayor. Such alternate
9
members may attend the meetings of the Ad Hoc Committee and may participate in
10
11 the discussions but shall not be considered for the determination of a quorum, unless
12 a quorum is not otherwise present. When a quorum is not otherwise present, such
13 alternate member or members shall be counted in the determination of a quorum and
14 may vote and have all other rights and responsibilities of a member of the Ad Hoc
15 Committee for that meeting. When any regular member of the Ad Hoc Committee is
16 not in attendance, but a quorum still exists, the most senior alternate member may
17
18 vote on any matter pending before the Ad Hoc Committee and shall have all other
19 rights and responsibilities of a member of the Ad Hoc Committee for that meeting.
20 If two or more regular members are not in attendance, then both alternate members
21 may vote and have such rights and responsibilities.
22 SECTION 4. Appointment of Members. Each member of the Ad Hoc
23 Committee, after having been nominated, shall be appointed by the Mayor, with the
24
approval of the Common Council. Each member shall be and remain a registered
25
26 voter within the City and each member of the Ad Hoc Committee nominated by a
27 Council member shall be and remain a resident of the ward of such Council member

5 Members shall serve, without compensation, at the pleasure of the Mayor and
6 Common Council. Any vacancy shall be filled and appointment shall be made in the
7 manner herein before set forth as for an original appointment.
8 SECTION 5. Oath of Office. Prior to undertaking his or her duties as a

member of the Ad Hoc Committee, the member shall subscribe and file his or her
10
official oath of office with the City Clerk.
