RESOLUTION NO. 2007-47
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
DIRECTING THE EXECUTION OF A RIGHT OF WAY CONTRACT FOR A
TEMPORARY CONSTRUCTION EASEMENT WITH THE STATE OF CALIFORNIA
FOR PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF
VALLEY STREET AND W ALKINSHA W STREET RELATIVE TO THE WIDENING OF
THE 1-215 FREEWAY.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor of the City of San Bernardino is hereby authorized and
directed to execute on behalf of said City, a Right of Way Contract for a temporary construction
easement with the State of California, for property generally located at the northeast corner of
Valley Street and Walkinshaw Street, known as Assessor's Parcel Number 0136-084-04, relative
to the widening of the 1-215 freeway, attached hereto as Exhibit "A" and made a part hereof.
SECTION 2. This resolution is rescinded if the parties to the contract fail to execute it
within sixty (60) days of the passage ofthe resolution.

This Document No. 20334-1 in the form of Temporary Construction Easement. covering the
property particularly described in the above instrument has been executed and delivered to Anthony Rizzi,
Right of Way Agent for the State of California.
In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as
follows:
1. (A) The parties have herein set forth the whole of their agreement. The performance of this agree-
ment constitutes the entire consideration for said document and shall relieve the State of
all further obligation or claims on this account, or on account of the location, grade or
construction of the proposed public improvement.
(B) Grantee requires said property described in Document No. 20334-1 for State highway purposes,
a public use for which Grantee has the authority to exercise the power of eminent domain.
Grantor(s) is/are compelled to sell, and Grantee is compelled to acquire property.
Both Grantor(s) and Grantee recognize the expense, time, effort, and risk to both parties in
determining the compensation for the property by eminent domain litigation. The compensation
set forth herein for the property is in compromise and settlement, in lieu of such litigation.
2. The State shall:
(A) Pay the undersigned grantor(s) the sum of $ 8,000 for the Temporary Construction
Easement.
(B) This transaction will be handled through an internal with the State of California, Department of
Transportation at 464 West Fourth Street, San Bernardino, California, 92401.

3. It is agreed and confirmed by the parties hereto that notwithstanding other provisions in this contract, the
right of possession and use of the subject property by the State, including the right to remove and dispose
of improvement, shall commence on December 1.2006 and that amount shown in Clause 2(A) herein
includes. but is not limited to, full payment for such possession and use, including damages, if any, and
interest from said date.
4. This Temporary Construction Easement shall terminate on Januarv 12. 2009 with the
completion of the project known as construct widen Interstate 215 in San Bernardino from Oranl!:e
Show Road to Rialto Avenue.
At least 48 (forty eight) hours advance written notice shall be given before any entry on grantor's property.
In the event said actual use extends beyond the prescribed period of time and said use is verified through
the State's contractor logs, the State shall pay the grantor( s) by Amended Right of Way Contract at the
same contract rate of$ 45.10 per month prorated to the actual date said actual use terminated.

5. The undersigned warrants that they are the owner ofthe property herein described and further agree
to indemnify the State against all adverse claims, and to pay all ofthe State's legal fees and all other
expenses resulting from the undersigned knowingly and falsely claiming ownership of the property
referred to in this document.

6. It is understood and agreed that in the event the grantor plans to sell, lease, or rent the grantor's
property prior to the final expiration date of this temporary construction easement, the grantor( s) shall
inform, in writing, any and all parties involved in said sale, lease, or rental of this temporary
easement and associated construction project by the State.
7. State agrees to indemnify and hold harmless the undersigned from any liability arising out of State's
operation under this agreement. State further agrees to assume responsibility for any damages proximately
caused by reason of State's operation under this agreement and State will, at its option, either repair or pay
for such damages.
8. It is agreed by and between the parties hereto that access to the subject property will be maintained at all
times. It is acknowledged between the parties that this Temporary Construction Easement contains (I) one
electronic sign message board, and that the State, or it's agents will utilize the area encumbered by this
Temporary Construction Easement in a manner that will allow the Grantor to maintain and operate the
electronic sign message board, yet allow the State to construct the project in the manner proposed.
9 . Excluding the electronic sign and any landscape or other improvements required or mandated by any
controlling governmental entity, the grantor( s) agrees that no improvements, other than those already on
the property, shall be placed thereof; and the planting of any crops, trees, or shrubs, or alterations, repairs,
or additions to existing improvements which may hereafter be placed thereon are at grantor's risk and
without expectation of payment if removed by the State.
10. Within the parameters set forth in Clause 4 of this Contract, the estimated time of usage for the Temporary
Construction Easement on Grantor's property is thrity-nine(39) months.
II. It is agreed that the net proceeds of the amount payable under Clause 2(A) above shall be divided as follows:

$ 0.00 to City of San Bernardino

specified in the Proposal/Bic! Forms submitted by the Contractor in response to the above referenced
Notice Inviting Bids. Such amount shall be subjectto adjustment in accordance with the applicabl.e
terms of this Contract. All Work shall be subjeci to, and performed in accordance with the above
referenced documents. '

and comistent with the standards genetally recoil1i2:ed as being employed by professionals in the
same disciplirle in the State of California. Contractor represents and maintains that it is skilled in the
profeSsional calling necessary to perfonn the Work. Contractor wmanlS that all employees and
Subcontractors shall have sufficient skill and experience to perfoml the Work assigned to them.
Finally, Contractor further represents thllt it, its employees and Subcontractors have all licenses.

d. Period of Perfonnan.;e.
Contractor shall perform and cOlnplete all Work under this Contrax;t within twenty (20)
working days, beginniag ten (10) calendar days alter the date on which the Notice to Proceed is
sent by Owner to the Contractor. Moreover. Contractor shall perform its Work in strict acc07dance
with any completion schedule.. construction schedule or project milestones developed purSUfll)t to
provisions of the Contract, including but not limited to the project schedule ("Project Schedule")
located in the specifications ("SpecifICations").
Contractor agrees that ifsuch Work is notcomplctc:d within the aforementioned periodandlor
pursuant to any such completion schedule, construction schedule or project milestones developed
pursuant to provisions of the Contract, including but not limited to the Project Schedule located in
the Specificatio.ns, it is understood, acknowledged and agreed that Owner will suffer damage.
Pursuant to Government Code Section 53069.85. Contractor shall pay to Owner as fixed and
liquidated damages the sum of One TholUaad and No/lOO Dolla" ($1,000.00) 'PER DAY as
provided by the applicable provisions of the General Conditions. found in Part "N' oftbe Contract
Appendix and the Special Provisions.
e. Owner's Basic Obli~.
Owner agrees to engage and does hereby engage Contractor as an independent contractor to
furnish all materials and to perform all Work according to the terms and conditions herein contained
for the sum set forth above. Except as otherwise provided in the Contract. Owner shall pay to
Contractor, as full consideration for the satisfactory performance by the Contractor of the services
and obligations required by this Contract, the above referenced compensation in accnrdance with
compensation provisions set forth in the Contract.
f. Contractor's Labor Certification.
Contractor maintains that he is aware of the provisions of Section 3700 of the California
Labo.r Code which require every employer to be insured against liability for Workers' Compensation
or to undertake self.insurance in accordence with the provisions of that Code. and agrees to comply
with such provisions before commencing the performance of the Work. A certification fonn. f'Or this
purpose is attached hereto as Exhibit" A" and inC01'pQrated herein by reference, and sbalI be executed
simultaneously with this Contract.
g. Attornevs' Fees.
If either party commences an action against the other party, either legal, administrative or
otherwise, arising out of or in connection with this Contract, the prevailing party in such at;tion shall
be entitled to have end recover from the losina party reasonable attorneys' fees and all other costs of
such action.
h. Successors.
The partks do for themselves, their hein, executors, admicistrators, successors, and assigns
agree to the full performance of all ofthe provisions contained in !b.is Contract. Contractor may not

j.Prevailing Wages; Apprentices; Payroll Records.
This Project is a public work for purposes of the California Labor Code, which requires
payment ofprcvailing wages. Accordingly, Contractor and all Subcontractors shall be requin:d to
pay not less than the prevailing tate of per diem \I\'lIieS, as determined by the Director of the
California DepartIJient of Industrial Relations. and otherwise comply with the provisions of Section
1770 et sea. of the California Labor Code and any applicable laws; rules and regulations adopted
with respect thereto ("California Prevailing Wage Laws"). Copies of such prevailing rates of per
diem wages are on file at the office of the Engineer, and copies shall be made available to any
interested party on request. The Contractor shall post a copy of the rates at the Projcct site. The
Contractor shall, l\ll a penalty to Owner, forfeit fifty dollars ($50.00) (o.r any higher rate established
by the California Prevailing wage Laws) for each calendar day, or portion thereof, for each work.er it
or its Subcontractors pay at less than the prevailing rates, as determined by the Director, for such

203-8 ASPHALT PAINT. Shall conform to ASTM D 41 or D 43 and be furnished and applied to
concrete surfaces as required and shown on the Plans.
203-9 SEALCOAT - ASPHALT BASED.
203-9.1 General. This specification applies to sealcoat intended to be used for sealing
miscellaneous areas such as asphalt parking lots, playgrounds, and similar areas. Sealcoat material
shall be a plant blended product composed of mineral aggregates uniformly distributed in a petroleum-
based asphalt emulsion. The asphalt emulsion shall conform to 203-3. The sealcoat material shall
contain non-asbestos fibers.
203-9.2 Testing Requirements. Sealcoat materials, undiluted except as noted, shall conform to
the following requirements:

203-10 LATEX MODIFIED ASPHALT CONCRETE.
203-10.1 General. Latex modified asphalt concrete shall be the product of mixing latex, asphalt
cement, and aggregate. Latex modified asphalt shall conform to 203-6 and the following requirements.
203-10.2 Materials.
203-10.2.1 Asphalt. Asphalt binder to be mixed with the latex and aggregate shall be paving
asphalt, Viscosity Grade AR-4000 conforming to 203-1, unless otherwise directed by the Engineer.
203-10.2.2 Latex. Latex shall be a water-based emulsified suspension of styrene butadiene rubber
(SBR) in liquid form. The ratio of styrene butadiene shall be 70 to 30. The rubber solids shall be 70 :l: 5
percent of the emulsified material unless otherwise directed by the Engineer.
At the time of delivery of each shipment of latex emulsion, the vendor supplying the material shall
deliver to the purchaser a certification document which includes, but is not limited to, the following
information:
Actual percent of rubber solids
Ratio of styrene to butadiene
Temperature range or limits for product use
Unit weight of the emulsion
Recommended storage conditions
I 203-10.2.3 Aggregates. Aggregates shall conform to 203-6.3.2.
203-10.2.4 Composition and Grading. The mix class shall be C2 unless otherwise directed by
the Engineer. Where Alternate Rock Products-Type S, Section 400, are specified, the class shall be
Type III-C3-AR4000 unless otherwise directed by the Engineer.

The amount of latex to be added shall provide 2 percent dry rubber solids, unless otherwise
directed by the Engineer. The percentage of dry rubber solids shall be based on the weight of asphalt
cement.
The exact proportions of aggregate and the amount asphalt binder for the mixture shall be
determined by Contractor so as to incorporate the specified amount of latex.
If the mix design and/or its individual components have no previous record of use by the Agency,
the Contractor shall submit a mix design with supporting test data at least 10 working days prior to
initial use.
203-10.3 Proportioning. Latex may be added to the mixture by any method approved by the
Engineer that will assure uniform distribution and accurate measurement of quantity of latex
introduced. The latex shall be introduced to the mix at the same time as the introduction of asphalt.
The latex emulsion temperature at the time it is introduced to the mixture shall be as recommended
by the manufacturer.
203-10.4 Mixing. The wet-mixing cycle for batch plant production shall be 50 seconds minimum.
Production rates of continuous mix plants shall be carefully regulated by the Contractor to ensure
complete and uniform mixing.
203-10.5 Storage. Latex emulsion shall be stored in a closed bottom-draw vessel and agitated as
recommended by the manufacturer's certificate of compliance.
A latex sampling outlet shall be provided in conformance to the requirements of 203-6.9. I
203-10.6 Placement. Latex modified asphalt concrete placement shall conform to the
requirements of 302-5 with the exception that pneumatic-tired rollers shall not be used.
203-11 ASPHALT RUBBER HOT MIX (ARHM) WET PROCESS.
20j-ll.1 Generill. Asphalt Rubber Hot Mix shall consist of Ii mixture of paving asphalt, asphalt
modifier, crumb rubber modifier (CRM), and aggregate mixed in a central mixing plant, all
conforming to these specifications.
203-11.2 Materials. The Contractor shall submit test reports and Certificates of Compliance for
the paving asphalt, asphalt modifier, and CRM to be used. In addition, when requested by the
Engineer, the Contractor shall submit samples of the tested material along with the Certificate of
Compliance.
203-11.2.1 Pav.ing Asphalt. The asphalt used for asphalt-rubber shall be AR 4000 conforming to
203-1 and shall be modified with an asphalt modifier.
203-11.2.2 Asphalt Modifier. The asphalt modifier will be a resinous, high flash point, aromatic
hydrocarbon compound and shall conform to the requirements in Table 203-11.2.2(A).
