CURTIS & SONS FOR SELF-CONTAINED BREATHING APPARATUS IN THE AMOUNT OF $49,396.80. 4 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. That the Mayor and Common Council authorize the Director of Finance or 8 designee to issue a Purchase Order not to exceed $49,396.80 to L.N. Curtis & Sons, as a selected 9 source vendor for self-contained breathing apparatus as set forth in the Quotation, attached hereto 10 as Exhibit "A" and incorporated herein by this reference. 11 SECTION 2. That L.N. Curtis & Sons is the only distributor of Survivair breathing 12 apparatus in the Southern California area and currently all breathing apparatus used by the Fire 13 Department is the Survivair brand, and furthermore, that the National Institute for Occupational 14 15 Safety and Health does not allow for the integration of different brands of equipment, such as 16 17 regulators, face masks, and devices. SECTION 3. This awarding of the purchase order to L.N. Curtis & Sons is exempt from 18 the formal contract procedure set forth in San Bernardino Municipal Code Section 3.04.070 by 19 20 the exemption set forth in San Bernardino Municipal Code Section 3.04.01O(B)(3). SECTION 4. The Purchase Order shall reference this Resolution and shall be issued to 21 L.N. Curtis & Sons for 6 self-contained breathing apparatus in an amount not to exceed 22 $49,396.80; 23 SECTION 5.
